SUBJECT: APPOINTMENT TO THE ENVIRONMENTAL QUALITY
CONTROL BOARD
SUMMARY OF REQUEST:
That the City Council appoint Rich Coles to the Environmental Quality Control
Board (EQCB) as representative for District Three.
BACKGROUND:
In accordance with Government Code Section 54974(a) (Maddy Act), whenever
an unscheduled vacancy occurs on any board, commission, or committee for
which the legislative body has the appointing power, an unscheduled vacancy
notice shall be posted and appointment to the board, commission, or committee
shall not be made by the legislative body for at least 10 working days after the
posting of the notice. The resignation of Mr. Ed Hirsch was received by the City
Clerk's Office on March 17th and the required Notice of Vacancy was posted that
same day.
Pursuant to Government Code 54974 9(b), on March 27, 2017, the City Council
found that an emergency existed and appointed Mr. Coles to fill the unscheduled
vacancy temporarily, to participate at the special EQCB meeting is scheduled for
April 5, 2017. This action is to appoint Mr. Coles to fill the unscheduled vacancy
as a permanent appointment until the regular term expires.
ENVIRONMENTAL IMPACT:
There is no environmental impact related to this item.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
