HomeMy WebLinkAboutCC Res 4563 1997-10-20 RESOLUTION NO. ~~ I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH AMENDING THE LAND USE ELEMENT OF THE GENERAL PLAN (LAND USE ELEMENT AMENDMENT 97-1) THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY FIND, DETERMINE AND RESOLVE: Section 1. In October, 1996, Hellman Properties LLC ("Applicant"), submitted to the City of Seal Beach an application for adoption of a revised Specific Plan for the Hellman Ranch pIOperty and adjoining properties and related General Plan Amendments, and approval of Vesting Tentative Tract Map No. 15381 and 15402 (collectively "application"). To' achieve consistency between zoning restrictions set forth in the revised Hellman Ranch Specific Plan and the General Plan, certain elements of the General Plan, including the Land Use Element, are proposed to be amended. I Section 2. Pursuant to 14 Calif. Code of Regs. fi 15025(a) and fifi II.C and ill of the City's Local CEQA Guidelines, staff prepared an Initial Study and a Draft Environmental Impact Report (DEIR), to study the environmental impacts arising from the revised Hellman Ranch Specific Plan and related General Plan amendments, including this amendment. The DEIR was circulated for public review and comment from April 8, 1997' to May 27, 1997, in compliance with the provisions of the California Environmental Quality Act (CEQA) and the City's Local CEQA Guidelines. A Revised DEIR was circulated for public review and comments from June 5, 1997 to July 23, 1997. Upon completion of the public review period, a Final Environmental Impact Report was reviewed by the Planning Commission at a public hearing held on September 3, 1997. After the public hearing, the Planning Commission found, through the adoption of Planning Commission Resolution No. 97-22 that the Hellman Ranch Specific Plan Final Environmental Impact Report (EIR) is adequate under CEQA. After considering the Final EIR and public testimony thereto at a public hearing on September 22, 1997, the City Council adopted City Councill,Wolution No. 4562, certifying the Pinal EIR and adopting a statement of overriding considerations. City Council Resolution No. 4562 is hereby incorporated by this reference. Section 3. After a duly noticed public hearing, the Planning Commission recommended approval of Land Use Element Amendment 97-1. I Section 4. On September 22, 1997, the City Council conducted a public hearing to consider the Planning Commission's recommendation. The City Council received into evidence the following reports and minutes: the Planning Commission Staff Report dated September 3, 1997, and Supplemental Staff Reports 1 and 2, also dated September 3, 1997, all attachments thereto, the Minutes of the September 3, 1997 Planning Commission Meeting, and Planning Commission Resolutions 97-22 through 97- 34; the Environmental Quality Control Board Staff Report of September 9, Supplemental Staff Report # I, also dated September 9, 1997, and Supplemental Staff Report # 2, dated September 16, 1997, the Minutes of the Environmental Quality Control Board of September 9, and Environmental Quality Control Board Resolution 97-1; and, the Archaeological Advisory Committee Staff Report and Minutes of August 27, 1997, and Archaeological Advisory Committee Resolutions 97-1 and 97-2. The City Council also considered all public testimony and written information presented. The record of the hearings indicates the following: Resolution NUmber~~ (a) Applicant seeks to establish the following uses as part of the Hellman Ranch Specific Plan: c 70 detached single-family residences on 14.7 acres c a 107.5 acre, 18-hOle public golf course c 23.1 acres of restored saltwater wet1ands c 9.7 acres of freshwater wetlands c 20,000 square feet of visitor-serving commercial uses, including an interpretative center and public facility (Krenwinkel House), on 1.8 acres. In addition, the Specific Plan includes: I c Dedication to the City of 10.2 acres to maintain Gum Grove Nature Park c Maintenance of mineral production on 28.2 acres c Maintenance of the Los Alamitos Retarding Basin on 34.7 acres. (b) The subject specific plan area is comprised of five (5) parcels, comprising a total of approximately 231.3 acres. Presented below is a summary of current General Plan and Specific Plan land use designations for the proposed Hellman Ranch Specific Plan area: HELLMAN RANCH PROPERTY CURRENT GENERAL AND SPECIFC PLAN LAND USE DESIGNATIONS Current General Plan Land Uses Current Specific Plan Land Uses Low Density Residential - 75 acres, 329 single family homes Low Density Residential- 18 acres, 113 single family homes Multiple Family Residential - 24 acres, 660 multiple family units 1 Industrial (Oil Extraction)- 36.4 acres Public Land Uses Community Park - 26 acres Flood Control Basin - 38 acres Wetlands - 41.4 acres Oil Production - 25 acres Public Land Uses Community Park - 17.7 acres Flood Control Basin - 35.3 acres Golf Course - 105 acres (c) If the proposed Hellman Ranch Specific Plan is adopted, the Land Use Element, among other elements of the General Plan, will need to be amended as proposed herein so that the Hellman Ranch Specific Plan and General Plan are consistent. In that the proposed Hellman Ranch Specific Plan provides zoning restrictions for the Specific Plan area, zoning would likewise be consistent with the General Plan. Section 5. Based upon substantial evidence in the record of the hearing, including the facts stated in fi 4 of this resolution, and in the environmental documentation prepared in conjunction with this project, and pursuant to fifi 28-2600 and 28-2602 of the City's Code, the City Council hereby finds: (a) The proposed General Plan Amendments and Specific Plan I Amendments will provide a less intensive use than is presently allowed under current General Plan and Specific Plan regulations. (b) The proposed Hellmap Ranch Specific Plan, and the necessary General Plan Amendments: are beneficial to the short term and long term land use goals of the City of Seal Beach; promote the public health, safety and welfare; and are in the public interest. Resolution Number~~ (c) Pursuant to Section 15168 of the CEQA Guidelines,' an EIR has been prepared and has been certified by the City Council. This amendment ,is within the scope Qf the certified'EIR, which adequately describes the general environmental setting of the project, its significant impacts, and the alternatives, and mitigation measures related to each significant environmental effect. Potential: This parcel of land, located in 8 Cellllly isllllHl north of 'Gum Grove Nature Park, is presently being utilized for oil products extraction. The life expectancy of this use is approximately 10 to 15 years. I Of primary environmental concern for future development of this area is the existence of the Seal Beach Fault (an active fault trace). The design for any use in this area will have to compensate for possible land movement due to the fault trace. " 2. Page 15-16 of the Land Use Element is revised to read as follows: "SUMMARY TABLE of EXISTING and PROPOSED LAND USES in ACRES Change is expected to occur within the City, mainly in the Coastal District where the impact of a beach attraction for visitors and an inviting residential environment exist. The remaining portions of the City are considered to be stable and of a high quality so that no substantial change is anticipated within the life span of the Land Use Element, 2010-l9ll5. LOW DENSITY RESIDENTIAL PROPOSALS (Minimum lot area of 5000 square feet per dwelling unit) This density classification allows for the typical subdivision patterns found throughout Southern California. 2. I Existing Low Density Marina Hill, College Park West, and College Park East are all very stable good quality low density residential neighborhoods. Due to the stability and excellent quality of these residential neighborhoods, it is not expected that there will be any significant change in these areas during the life span of the land Use Element. The Hellman Ranch Specific Plan provides an additional 14.7 acres of Low Density Residential development immediately to the north of Marina Hill, south of the Police Station, and along Seal Beach Boulevard. OIL EXrRACflON 2.1 Existing Oil Extraction Use Oil extraction use has been shown on the Hellman properties and is expected to continue for at least the time span of this Land Use Element. As part of the Hellman Specific Plan process, the oil production areas will be consolidated into approximately i!3-28.2 acres in various controlled drill sites to facilitate the implementation of the Afllellded Hellman Ranch Specific Plan. ft S. Although the City supports this project, it is not envisioned that the City will either own or maintaiil the wetlands areas.
