A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SEAL BEACH AMENDING THE
CIRCULATION ELEMENT OF THE GENERAL
PLAN (CIRCULATION ELEMENT
AMENDMENT 97-1)

THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
FIND, DETERMINE, AND RESOLVE:
Section 1. In October, 1996, Hellman Properties LLC ("Applicant"),
submitted to the City of Seal Beach an application for adoption of a revised Specific Plan
for the Hellman Ranch property and adjoining properties and related General Plan
Amendments, and approval of Vesting Tentative Tract Map No. 15381 and 15402
(collectively "application"). To achieve consistency between zoning restrictions set forth
in the revised Hellman Ranch Specific Plan and the General Plan, certain elements of the
General Plan, including the Circulation Element, are proposed to be amended.
Section 2. Pursuant to 14 Calif. Code of Regs. ~ 15025(a) and ~~ II.C
and ill of the City's Local CEQA Guidelines, staff prepared an Initial Study and a Draft
Environmental Impact Report (OEIR), to study the environmental impacts arising from the
revised Hellman Ranch Specific Plan and related General Plan amendments, including this
amendment. The DEIR was circulated for public review and comment from April 8, 1997
to May 27, 1997, in compliance with the provisions of the California Environmental I
Quality Act (CEQA) and the City's Local CEQA Guidelines. A Revised DEIR was
circulated for public review and comments from June 5, 1997 to July 23, 1997. Upon
completion of the public review 'period, a Final Environmental Impact Report was
reviewed by the Planning Commission at a public hearing held on Septem~r 3, 1997.
After the public hearing, the Planning Commission found, through the adoption of
Planning Commission Resolution No. 97-22 that the Hellman Ranch Specific Plan Final
Environmental Impact Report (EIR) is adequate under CEQA. After considering the Final
EIR and public testimony thereto at a public hearing on September 22, 1997, the City
Council adopted City Council Resolution No. 4562, certifying the Final EIR and adopting
a statement of overriding considerations. City Council Resolution No. 4562 is hereby
incorporated by this reference.
Section 3. After a duly noticed public hearing, the Planning
Commission recommended approval of Circulation Element Amendment 97-1.
Section 4. On September 22, 1997, the City Council conducted a
public hearing to consider the Planning Commission's recommendation. The City Council
received into evidence the following reports and minutes: the Planning Commission Staff
Report dated September 3, 1997, and Supplemental Staff Reports 1 and 2, also dated
September 3, 1997, all attachments thereto, the Minutes of the September 3, 1997
Planning Commission Meeting, and Planning Commission Resolutions 97-22 through 97-
34; the Environmental Quality Control Board Staff Report of September 9, Supplemental
Staff Report # 1, also dated September 9, 1997, and Supplemental Staff Report # 2, dated
September 16, 1997, the Minutes of the Environmental Quality Control Board of
September 9, and Environmental Quality Control Board Resolution 97-1; and, the
Archaeological Advisory Committee Staff Report and Minutes of August 27, 1997, and
Archaeological Advisory Committee Resolutions 97-1 and 97-2. The City Council also
considered all public testimony and written information presented. The record of the
hearings indicates the following:

(a) The proposed roadways currently indicated in the Circulation
Element within the Hellman Ranch Specific Plan are no longer necessary given the scale
and type of development proposed. The circulation system for an earlier development
proposal on the Hellman Ranch property proposing a total of 773 residential units is no
longer appropriate given the scale and type of development proposed in the current
specific plan revision, which comprises 70 single family homes and a public golf course.

Section 5. Based upon substantial evidence in the record of the
hearing, including the facts stated in G 4 of this resolution, and in the environmental
documentation prepared in conjunction with this project, and pursuant to U 28-2600 and
28-2602 of the City's Code, the City Council hereby finds the proposed General Plan ,
Amendments: are beneficial to the short term and long term land use goals of the City of
Seal Beach; promole the public health, safety and welfare; and are in the public interest.
(a) Pursuant to Section 15168 of the CEQA Guidelines, an EIR has
been prepared and has been certified by the City Council. This amendment is within the
scope of the certified EIR, which adequately describes the general environmental setting of
the project, its significant impacts, and the allernatives, and mitigation measures related to
each significant environmental effect. No additional environmental documentation is
needed.

of the City and Other General Plan Elements", subsection titled "Relationship
to Other Elements: Land Use", is revised to read as follows:

Ranch property indicating a total of 773 residential units. These proposed

proposed in the current specific plan revision.

"Section Four: Implementation", subsection titled "Capital Improvements
Program", the f"1I'St area of concern is deleted in its entirety, as the proposed
circulation system for an earlier development proposal on the Hellman Ranch
property indicating a total of 773 residential units is no longer appropriate given
the scale and type of development proposed in the current specific plan revision.
The deleted area of concern reads as follows:
