HomeMy WebLinkAboutCC Res 4570 1997-10-20 RESOLUTION NO.~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING VESTING TENTATIVE TRACT MAP NO. 15381 I THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY FIND, DETERMINE AND RESOLVE: I Section 1. In October, 1996, Hellman Properties LLC ("Applicant"), submitted to the City of Seal Beach an application for adoption of a revised Specific Plan for the Hellman Ranch property and adjoining properties and related General Plan . Amendments, and approval of Vesting Tentative Tract Map No. 15381 and 15402 (collectively "application"). Section 2. Pursuant to 14 Calif. Code of Regs. 0 15025(a) and 00 II.C and ill of the City's Local CEQA Guidelines, staff prepared an Initial Study and a Draft Environmental Impact Report (DEIR), to study the environmental impacts"arising from the revised Hellman Ranch Specific Plan and related General Plan amendments, including this amendment. The DEIR was circulated for public review and comment from April 8, 1997 to May 27, 1997, in compliance with the provisions of the California Environmental Quality Act (CEQA) and the City's Local CEQA Guidelines. A Revised DEIR was circulated for public review and comments from June 5, 1997 to July 23, 1997. Upon completion of the public review period, a Final Environmental Impact Report was reviewed by the Planning Commission at a public hearing held on September 3, 1997. After the public hearing, the Planning Commission found, through the adoption of Planning Commission Resolution No. 97-22 that the Hellman Ranch Specific Plan Final Environmental Impact Report (EIR) is adequate under CEQA. After considering the Final EIR and public testimony thereto at a public hearing on September 22, 1997, the City Council adopted City Council Resolution No. 4562, certifying the Final EIR and adopting a statement of overriding considerations. City Council Resolution No. 4562 is hereby incorporated by this reference. Section 3. After a duly noticed public hearing, the Planning Commission recommended approval of Vesting Tentative Tract Map No. 15381. I Section 4. On September 22, 1997, the City Council conducted a public hearing to consider the Planning Commission's recommendation. The City Council received into evidence the following reports and minutes: the Planning Commission Staff Report dated September 3, 1997, and Supplemental Staff Reports 1 and 2, also dated September 3, 1997, all attachments thereto, the Minutes of the September 3, 1997 Planning Commission Meeting, and Planning Commission Resolutions 97-22 through 97- 34; the Environmental Quality ControI' Board Staff Report of September 9, Supplemental Staff Report # I, also dated September 9, 1997, and Supplemental StaffReportr # 2, dated September 16, 1997, the Minutes of the Environmental Quality Control Board of September 9, and Environmental Quality Control Board Resolution 97-1; and, the Archaeological Advisory Committee Staff Report and Minutes of August 27, 1997, and Archaeological Advisory Committee Resolutions 97-1 and 97-2. The City Council also considered all public testimony and written information presented. Section 5. Applicant seeks to establish the following uses as part of the Hellman Ranch Specific Plan: Resolution NUmber~ c 70 detached single-family residences on 14.7 acres c a 107.5 acre, 18-hole public golf course c 23.1 acres of restored saltwater wetlands c 9.7 acres of freshwater wetlands c 20,000 square feet of visitor-serving commercial uses, including an interpretative center and public facility (Krenwinke1 House), on 1.8 acres. In addition, the Specific Plan includes: c Dedication to the City of 10.2 acres to maintain Gum Grove Nature Park c Maintenance of mineral production on 28.2 acres c Maintenance of the Los Alamitos Retarding Basin on 34.7 acres. I (a) Applicant is proposing to subdivide the property for conveyance purposes in order to convey Gum Grove Nature Park, wetland restoration areas, a single family residentially zoned parcel, and other parcels for implementation of the Hellman Ranch Specific Plan. (b) Vesting Tentative Tract Map (VTI'M) 15381 will create nine large parcels for the golf course, the residential area, Gum Grove Nature Park, the saltwater wetland area, remaining oil production areas, and the remaining City parcel. Below is a summary of the proposed lots for VTTM 15381: c Lot 1 Oil Production 1.44 acres c Lot 2 Single Family Detached Residential 14.94 acres c Lot 3 Public Park (Gum Grove Park) 11.07 acres c Lot 4 Golf Course/Freshwater Wetlands 113.74 acres c Lot 5 Public Facilities 1.41 acres c Lot 6 Oil Production 19.28 acres Lot 7 . Oil Production 7.50 acres I c c Lot 8 Saltwater Wetlands 24.59 acres c Lot 9 Visitor Commercia1lPublic Benefit 2.52 acres TOTAL 196.49 acres Section 6. Based upon substantial evidence in the record of the hearing, including the facts stated in 0 5 of this resolution, and in the environmental documentation prepared in conjunction with this project, and pursuant to 00 28-2600 and 28-2602 of the City's Code, the City Council hereby finds: (a) The proposed Vesting Tentative Tract Map will provide a less intensive use than is presently allowed under current General Plan, Specific Plan, and Redevelopment Plan regulations. (b) The proposed Vesting Tentative Tract Map: is beneficial to the short term and long term land use goals of the City of Seal Beach; will promote the public health, safety and welfare; and is in the public interest. (c) The proposed Map is consistent with applicable General and Specific Plans in that the Map requires dedications that are consistent with said plans. (d) The design of the subdivision will not interfere with existing easements, acquired by the public or utilities that serve the public, because the proposed subdivision will preserve and maintain existing easements. I (e) The site is physically suitable for the proposed subdivision, and will allow for further subdivision that can meet the density and configurations of adopted Specific and General Plans. Resolution Numbe~~ . (f) The design of the subdivision is not likely to cause substantial environmental damage as all mitigation measures contained in the Environmental Impact Report (EIR) to protect the environment will be implemented. I (g) Pursuant to Section 15168 of the CEQA Guidelines, an EIR has been prepared and has been certified by the City Council. This subdivision is within the scope of the certified EIR, which adequately describes the general environmental setting of the project, its significant environmental impacts, and the alternatives, and mitigation measures related to each significant environmental effect. No additional environmental documentation is needed. Section 7. Based upon the foregoing, the City Council of the City of Seal Beach does approve Vesting Tentative Tract Map 15381, subject to the following conditions: 1. Prior to Final Map approval, an irrevocable offer to dedicate Lot 3 to the City of Seal Beach for public park purposes shall be accepted by the City of Seal Beach. 2. Prior to Final Map approval, the final configuration of Lot 3 shall be shown on the proposed Final Map. Minor changes in Lot 3 size and configuration will not require an amendment to this vesting tentative tract map. 3. Applicant shall comply with all Mitigation Measures required by the Hellman Ranch Specific Plan Environmental Impact Report.
