HomeMy WebLinkAboutCC Res 4571 1997-10-20 RESOLUTION NO. ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING TENTATIVE TRACT MAP NO. 15402 THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY FIND, DETERMINE AND RESOLVE: I: Section 1. In October, 1996, Hellman Properties LLC ("Applicant"), submitted to the City of Seal Beach an application for adoption of a revised Specific Plan for the Hellman Ranch property and adjoining properties and related General Plan Amendments, and approval of Vesting Tentative Tract Map No. 15381 and 15402 (collectively "application "). Section 2. Pursuant to 14 Calif. Code of Regs. 0 15025(a) and 00 II.C and ill of the City's Local CEQA Guidelines, staff prepared an Initial Study and a Draft Environmental Impact Report (DEIR), to study the environmental impacts arising from the revised Hellman Ranch Specific Plan and related General Plan amendments, including this amendment. The DEIR was circulated for public review and comment from April 8, 1997 to May 27, 1997, in compliance with the provisions of the California Environmental Quality Act (CEQA) and the City's Local CEQA Guidelines. A Revised DEIR was circulated for public review and comments from June 5, 1997 to July 23, 1997. Upon completion of the public review period, a Final Environmental Impact Report was reviewed by the Planning Commission at a public hearing held on September 3, 1997. II After the public hearing, the Planning Commission found, through the adoption of Planning Commission Resolution No. 97-22 that the Hellman Ranch Specific Plan Final Environmental Impact Report (EIR) is adequate under CEQA. After considering the Final EIR and public testimony thereto at a public hearing on September 22, 1997, the City Council adopted City Council Resolution No. 4562, certifying the Final EIR and adopting a statement of overriding considerations. City Council Resolution No. 4562 is hereby incorporated by this reference. Section 3. After a duly noticed public hearing, the Planning Commission recommended approval of Vesting Tentative Tract Map No. 15402. Section 4. On September 22, 1997, the City Council conducted a public hearing to consider the Planning Commission's recommendation. The City Council received into evidence the following reports and minutes: the Planning Commission Staff Report dated September 3, 1997, and Supplemental Staff Reports 1 and 2, also dated September 3, 1997, all attachments thereto, the Minutes of the September 3, 1997 Planning Commission Meeting, and Planning Commission Resolutions 97-22 through 97- 34; the Environmental Quality Control Board Staff Report of September 9, Supplemental Staff Report # 1, also dated September 9, 1997, and Supplemental Staff Report # 2, dated September 16, 1997, the Minutes of the Environmental Quality Control Board of September 9, and Environmental Quality Control Board Resolution 97-1; and, the I Archaeological Advisory Committee Staff Report and Minutes of August 27, 1997, and Archaeological Advisory Committee Resolutions 97-1 and 97-2. The City Council also considered all public testimony and written information presented. Section 5. Applicant is proposing to subdivide the property in accordance with the conveyance subdivision approved in accordance with Vesting Tentative Tract Map 15381, in order to subdivide up to 70 single family homes on individual lots for implementation of the Hellman Ranch Specific Plan. Resolution Number~ (a) Vesting Tentative Tract Map (VTI'M) 15402 will create the interior roadways and the proposed residential subdivision. This map subdivides the 14.94 acre parcel created by VTTM 15381 into 70 single family residential lots, private roadways, and private greenbelt and access areas. A summary of the proposed residential subdivision is provided below: I c 70 single family residential lots, with minimum lot sizes of 5000 square feet c 7 open space landscape lots, comprising 2.08 acres c Private roadway system, providing access to the residential subdivision with a single access point at the intersection of Seal Beach Boulevard and Forrestal Drive. Section 6. Based upon substantial evidenct? in the record of the hearing, including the facts stated in 0 5 of this resolution, and in the environmental documentation prepared in conjunction with this project, and pursuant to 00 28-2600 and 28-2602 of the City's Code, the City Council hereby finds: (a) The proposed Vesting Tentative Tract Map will provide a less intensive use than is presently allowed under current General Plan, Specific Plan, and Redevelopment Plan regulations. (b) The proposed Vesting Tentative Tract Map: is beneficial to the short term and long term land use goals of the City of Seal Beach; will promote the public health, safety and welfare; and is in the public interest. (c) Vesting Tentative Tract Map 15402 is consistent with the General Plan, as amended, and the Hellman Ranch Specific Plan, as amended, in that the map would aIlow the construction of a~maximum of 70 single family homes on Lot 2 of VTTM 15381, a 14.94 acres parcel. I (d) The site is physically suitable for the proposed type of development, in that residential development will be limited to that portion of the property which has been identified as suitable for development by Converse Consultants Orange County in a report dated August 23, 1996 entitled "Evaluation of Geologic Hazards and Geotechnical Constraints, Hellman Ranch Property, Seal Beach, California. (e) The site is physically suitable for the proposed density of development, proposes less density than either the General Plan or the previous Hellman Specific Plan allowed, prior to the concurrently processed amendments, and generally conforms to the development standards for the adjaCent single family residential area known as Marina Hill. (f) The design of the subdivision is not likely to cause substantial environmental damage because all mitigation measures contained in the ErR done for this 'project have been incorporated as conditions of approval and will be implemented. (g) The design of the subdivision is not likely to cause serious public heal~ problems because all necessary utilities and services are available to serve the project. I (h) The design of the subdivision will not conflict with easements acquired by the public at large for access through, or use of, property within the proposed subdivision because all easements will be adequately preserved, maintained and/or abandoned with new easements created. (i) The discharge of water from the subdivision into the existing community sewer system will not violate existing requirements prescribed by the local regional water quality control board. Resolution NUmber~ (j) The project adequately preserves wetlands, and final approval of this wetlands configuration will be required by the Department of Fish and Game, and the U.S. Aimy Corps of Engineers. (k) The subdivision map addresses the Gum Grove area, and seeks to preserve the grove by dedication to the City of Seal Beach. (1) The Vesting Map is subject to Federal and State laws, and the Map could be affected if it conflicts with the provision or enforcement of these I regulations and conditions that have been placed on this Map reflecting these regulations. (m) Pursuant to Section 15168 of the CEQA Guidelines, an EIR has been prepared and has been certified by the City Council. This subdivision is within the scope of the certified ElR, which adequately describes the general environmental setting of the project, its significant environmental impacts, and the alternatives, and mitigation measures related to each significant environmental effect. No additional environmental documentation is needed. Section 7. Based upon substantial evidence in the record, and pursuant to GOvernment Code Section 65590(d),- the City Council hereby finds that the provision of housing units affordable to persons of low and moderate income on the Project site as part of the Project is not feasible for economic, environmental and technical reasons. The proposed residential development is considerably less dense than prior p~sals on the property, with residential structures located away from environmentally or geologically sensitive areas. Any provision of low and moderate income units on site would result in the loss of market-rate single family homes necessary to make the Project economica11y viable. The development of such units on portions of the remaining "lowland" areas of the site would conflict with the environmental benefits of the project, namely restoration of wetlands and preservation of open space. Such development also would be technica11y infeasible, since lowland development would be in close proximity to areas of geologic risk. However, the City Council hereby finds that it would be feasible for the developer to provide seven (7) housing units affordable to persons of low or moderate income off- site, but in the City and within three (3) miles of the Coastal Zone for a period of tell (10) years. The acquisition of units or rent subsidy required herein as a condition of this approval is a substantial contribution to the City's stock of affordable housing, is consistent with the requirements of neighboring coastal communities and is the maximum feasible contribution to affordable housing that can be supported by the current Project. I Section 8. Based upon the foregoing, the Vesting Tentative Tract Map 15402 is hereby approved, subject to the attached conditions shown as "Exhibit A" , which is incorporated herein by reference.
