Home My WebLink AboutCC Res 4572 1997-10-20 RESOLUTION NO. k-z A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING A PROPOSED AMENDMENT TO THE REDEVELOPMENT }>LAN FOR THE RIVERFRONT REDEVELOPMENT PROJECT OF THE REDEVELOPMENT AGENCY OF THE CITY OF SEAL BEACH I THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. The Staff and Consultants of the Redevelopment Agency of the City of Seal Beach (the "Agency") have prepared a proposed amendment to the Redevelopment Plan, as amended, (the "Redevelopment Plan") for the Riverfront Redevelopment Project, as amended (the "Project Area") of the Agency, on file in the office of the City Clerk of the City of Seal Beach (the" Amendment"). The purpose of the Amendment is to change the land use designations set forth in the Redevelopment Plan of those portions of the Project Area which are affected by the Hellman Ranch Specific Plan to be consistent with the Specific Plan. Section 2. In connection with the proposed Amendment, the Staff and Consultants of the Agency have prepared the Report to the City Council, which consists of the reports and information required by Health and Safety Code Section 33352 (to the extent warranted by the proposed Amendment in accordance with Health and Safety Code Section 33457.1) (the "Report"). Such Report, together with the proposed Amendment, have been presented to the City Council and copies of the proposed Amendment and such Report are on file in the office of the City Clerk and have been made available to the public prior to the joint public hearing of the Agency and the City Council on the proposed Amendment. The City Council has duly considered the Report. I Section 3. The Planning Commission of the City of Seal Beach adopted Resolution 97-38 and reported to the City Council and to the Agency that the proposed Amendment is consistent with the General Plan of the City of Seal Beach, and has recommended approval of the proposed Amendment. Section 4. The City Council of the City of Seal Beach adopted Resolution No. 4562 on September 22, 1997 certifying the final environmental impact report (EIR) for the Hellman Ranch Specific Plan; adopting the mitigation monitoring program; adopting the findings and facts in support of findings as required by the California Environmental Quality Act; and adopting a Statement of Overriding Considerations. Resolution No. 4562 and the EIR are hereby incorporated by this reference. This amendment is within the scope of the certified EIR, which adequately describes the general environmental setting of the project, its significant environmental impacts, and the alternatives and mitigation measures related to each significant environmental effect. No additional environmental documentation is needed. I Section 5. A full and fair joint public hearing regarding the proposed Amendment has been duly noticed and held by the Agency and the City Council pursuant to law and the Agency and City Council have received testimony concerning such proposed Amendment. The City Council has duly considered the Resolution Number ~7...2. recommendations of the Agency and the report and recommendation of the project area committee and has evaluated the Report to the City Council, described in Section 2 hereof, and all evidence and testimony for and against the adoption of the proposed Amendment. All objections to such Amendment were heard and passed upon by the Agency and the City Council and are hereby overruled by the City Council. I Section 6. The proposed Amendment, a copy of which has been presented to the Agency and the City Council, and which is now on file in the office of the City Clerk, is hereby approved. Section 7. The City may expend funds which may be necessary or appropriate in connection with the redevelopment of the Project Area. The City Council hereby declares its intention to undertake.and complete any proceedings necessary to be carried out by the City under the provisions of the Redevelopment Plan, as amended by the Amendment.
