THE CITY OF SEAL BEACH ADOPTING
NEGATIVE DECLARATION 97-4, ADOPTING
AMENDMENT 97-2 TO THE "CIRCULATION
ELEMENT' OF THE SEAL BEACH .GIlli.EEAL
PLAN, AND APPROVING THE SUMMARY
VACATION OF THE SUBJECT STREET
RIGHT-OF-WAY IN ACCORDANCE WITH
CHAPTER 4 OF THE STREETS AND
HIGHWAYS CODE OF THE STATE OF
CALIFORNIA

THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:
WHEREAS, the California Government Code includes certain provisions regarding the
content of the "Circulation Element" of the General Plan; and
WHEREAS, this proposed amendment of the Circulation Element of the Seal Beach
General 'Plan is an amendment which provides internal consistency with I
Circulation Element Revision 97-1, approved by the City Council in
October 1997. Circulation EJement Revision 97-1 was adopted to
maintain consistency between the Circulation Element and the approved
HeIlman Ranch Specific Plan. Circulation Element Revision 97-1 was
necessary to delete roadways within Hellman Ranch designated for
construction in the General Plan that will not be constructed when the
Hellman Ranch Specific Plan project is constructed; and
WHEREAS, Circulation Amendment 97-1 deleted the subject roadway from the
Circulation Element as a future roadway, but left the roadway description
in the "Capital Improvement Program" portion of the Circulation Element,
resulting in an internal inconsistency within the Circulation Element; and

WHEREAS, the City is proposing to amend the Circulation Element to eliminate this
internal inconsistency and vacate the subject future roadway right-of-way;
and
WHEREAS, staff has prepared and circulated an Initial Environmental Assessment and
proposed Negative Declaration as required by the California Environmental
Quality Act (CEQA). The comment period on Negative Declaration 97-4
ended on December 8, 1997. The City has received responses on the
proposed Negative Declaration from:
I
1) State of California, Department of Transportation, mSlrict 12,
having no comments on the project; and
2) Southern California Association of Governments, project is not
regionally significant and does not warrant clearinghouse
comments: and

WHEREAS, a duly noticed public hearing was held by the Planning Commission on
December 3, 1997 to consider Negative Declaration 97-4, Circulation
Element Amendment 97-2, and the subject street vacation; and
WHEREAS, the Planning Commission received into evidence the Staff Report of
. December 3, 1997, along With all attachments thereto, and considered all
public testimony presented; and

WHEREAS, The Planning Commission made the following findings and recommended
adoption of Negative Declaration 97-4, Circulation Element Amendment
97-2, and the subject street vacation by the City Council on December 3,
1997:
1. The proposed Negative Declaration adequately discloses the
potential environmental impacts of the proposed Circulation
Element amendment and street vacation, and no substantial adverse
environmental impacts will result upon the approval of the subject
requests.
2. The proposed Circulation Element amendment will result in internal
consistency within the Circulation Element.
3.
The proposed Circulation Element amendment recognizes the
future roadway is longer necessary due to the reduction in future
traffic impacts from the Hellman Ranch property, which will
comprise only 70 single-family residences. If in the future
Boeing proposes additional facilities on their property which
would require additional roadway access, a future environmental
evaluation of those projects would identify if the anticipated
traffic generation would require a public roadway or private
driveway access. If this environmental evaluation were to
determine that a public roadway is required, that would be a
condition of approval of the proposed project.

4. The proposed street vacation is consistent with the Circulation
Element, as amended by Amendment 97-2 to the Circulation
Element; and
WHEREAS, a duly noticed public hearing was held by the City Council on December

4. The proposed street vacation is consistent with the Circulation
Element, as amended by Amendment 97-2 to the Circulation
Element and with the provisions of Chapter 4 of the California
Streets and Highways Code relating to "Summary Vacation"; and
WHEREAS, in compliance with CEQA and local CEQA guidelines, staff has prepared
the required "Response to Comments on Negative Declaration No. 97-4",
including' all responses received by the City to December 8, 1997, for
consideration by the City Council on December 8, 1997. The "Response
to Comments on Negative Declaration No. 97-4" is attached hereto and
incorporated herein by reference as "Exhibit B".
NOW, THEREFORE BE IT RESOLVED, that the City Council hereby:
1. Adopts Negative D~laration 97-4.
"Section Four: Implementation" , subsection titled
"Capital Improvemenls Program", the last area of
concern is deleted in its entirety. The deleted area of
concern reads as foUows:

3. Summarily vacates the subject vacant street right-of-way as shown on "Exhibit A",
attached hereto and incorporated herein by reference, in accordance with Chapter
4, ~~ 8333 and 8334 of the Streets and Highways Code of the State of California,
4. Finds that from and after the date of recordation of this resolution, the street
easement summarily vacated no longer constitutes a street, highway, or public
service easement.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council
finds that there is no substantial evidence that Circulation Element Amendment 97-2
will have a significant effect on the environment, involves no potential for adverse
effect, either individually or cumulatively, on wildlife resources and win not have an
adverse i!1lpact on fish and wildlife and directs the Director of Development Services to
file the appropriate De Minimis Impact Finding for the California Department of Fish
and Game Certificate of Fee Exemption.

Vacation. The proposal is to eliminate the
proposed future principal roadway located
between the Los A1amitos Flood Control
Basin and the Boeing space and Defense
facilities, west of Seal Beach Boulevard.
Caltrans District 12 is a reviewing agency
and has no commetn at this time.
