Home My WebLink AboutCC Res 4613 1998-03-31 RESOLUTION NUMBER 4b~ I A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, RECITING THE FACTS OF THE PRIMARY AND SPECIAL MUNICIPAL ELECTIONS HELD IN THE CITY OF SEAL BEACH ON THE 24TH DAY OF MARCH, 1998, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS PROVIDED BY LAW. WHEREAS, Primary and Special Municipal Elections were held and conducted in the city of Seal Beach, County of Orange, State of California, on Tuesday, the 24th day of March, 1998, as required by Ordinance Number 1425 and Ordinance Number 1426 of the city of Seal Beach, California; and WHEREAS, notice of said election was duly and regularly given in time, form, and manner as provided by law; that voting precincts were established; that election officers were appointed and in all respects said election was held and conducted and the votes were cast, received and canvassed, and the returns made and declared in time, form, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law and charter cities; and I WHEREAS, pursuant to Resolution Number 4586, adopted the 24th day of November, 1997, the city Clerk canvassed the returns of said election and has certified the results to this City Council, said results received, attached, and made a part hereof as "Exhibit A." NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That the whole number of ballots cast in the precincts except absent voter ballots was 4,089, the number of absentee ballots cast was 1,388, for a total of 5,477 ballots cast in Council Districts One, Three, Four, and Five. That the whole number of votes cast in the precincts except absentee votes was 4,038, the number of absentee votes cast was 1,367, for a total of 5,405 votes cast in Council Districts One, Three, Four, and Five. Section 2. That the names of the persons voted for at the Primary Municipal Election for Member of the City Council are as follows: District One - Charles J. Antos Shawn Boyd Matthew Duggan I District Three - Stanley G. Anderson, Jr. Bill Orton Paul Yost District Five - William J. Doane Harry R. That the Special Municipal Election was held for the purpose of submitting to the voters of Council District Four the following quest~on: Shall Patricia E. Campbell be recalled (removed) from the office of Member of the City Council, District Four? YES NO For Member of the City Council, District Four (Term Expires May 16, 2000) to succeed Patricia E. Campbell if recalled from office by the Election (any vote cast for a successor will not be counted unless the voter has also voted either "YES" or "NO" on the question of recall above). I Arden nAce" Yeam That the number of votes given at each precinct and the number of votes given in the City to each of such persons above named for the respective offices for which said persons were candidates and for and against each question and for each candidate is as listed in Exhibit "A" attached. The City Council does declare and determine: that Shawn Boyd and Matthew Duggan are nominated as a member of the city Council of the City of Seal Beach from Councilmanic District One for the full term of four years, to be further determined at the General Municipal Election to be held May 12, 1998; I that Paul Yost was elected as a member of the City Council from Councilmanic District Three for the full term of four years; that William J. Doane was elected as a member of the City Council from Councilmanic District Five,for the full term of four years; and that a majority of the voters voting on the measure relating to the recall of Patricia E. Campbell did not vote in favor thereof, and that patricia E. campbell was not recalled from the office of Member of the city Council, Councilmanic District Four. The the the City Clerk shall enter on the records of City Council of said City, a statement of results of said election showing: I (1) The whole number of ballots cast in the City; (2) The names of the persons voted for and the measures voted upon; (3) For what office each person was voted for; I I I Resolution Number~/~ (4) The number of votes given at each precinct to each person and each measure; and (5) The total number of votes given to each person and each measure. Section 7. That pursuant to the city Charter, on the seventh day following the General Municipal Election the City Clerk shall make and deliver to each of such persons so elected, a Certificate of Election signed by the city Clerk and duly authenticated; that the city Clerk shall also administer to each person elected, the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe thereto and file same in the office of the city Clerk. Whereupon, each and all of said persons so elected shall be inducted into the respective office to which they have been elected. That the city Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said city; and in the records of the proceedings of the City Council of said city in the minutes of the meeting at which the same is passed and adopted. Section 8.
