Mayor Massa-Lavitt pulled Item F from the consent calendar for separate consideration.
City Clerk Robin Roberts read into the record that the following items were received
after the posting of the agenda, email communication from Robert Goldberg!regarding
various items, email communication from Seth Eaker regarding Item E, City, Manager
Ingram distributed questions from Council Member Moore, a PowerPointi from the
Director of Finance regarding the City of Seal Beach Fee Schedule, and a memo and
changes from the Director of Public Works regarding Item H and attachment C was
replaced entirely.

ORAL COMMUNICATIONS
Mayor Massa-Lavitt opened oral communications. Speakers: Owen Pierce, Scott
Kredell, Debbie Steya, West Tonaka, and Rosemary Habolt spoke in opposition of the
proposed LA Fitness Project. Rosie Ritchie spoke on behalf of the Seal Beach
Chamber of Commerce thanking the City and the Seal Beach Police Department for
their assistance with the Be More Healthy Expo that was held on June 3, 2017,
additionally, she invited everyone to attend the summer concert series held at
Eisenhower Park beginning July 5, :2017. Joyce Ross-Parque thanked Recreation
Manager Tim Kelsey for making sure the cyclist had insurance for a recent cycling event
and commented on new State law regarding private emails and the creation of the
Parking Authority.
CITY ATTORNEY REPORT
City Attorney Craig Steele indicated that the City Council met in Closed Session
regarding the one item listed on the agenda, received a report from staff and took no
reportable action.
CITY MANAGER REPORT
City Manager Ingram indicated she and her family attended the Seal Beach Police
Department Open House thanking Interim Chief Miller and his team for a successful
event. Interim Chief Miller indicated that there were approximately 1000 ;people in
attendance. He thanked the Seal Beach Lions Club for the donation of food, Miss Seal
Beach Court for giving tours of the Police Station, the Long Beach Police Department,
California Highway Patrol, Cypress Police Department, Mothers Against Drunk Drivers,
CERTS, Veterans. Administration Volunteers, Seal Beach Police Foundation, West
County SWAT, RACES Group, Orange County Fire Authority, Golden West Police
Academy, Seal Beach Police Explorers, WestComm, Long Beach Animal Control
Services, and the Seal Beach Public Works Department.
COUNCIL COMMENTS
Council Member Moore stated he attended the Police Department Open House and
thanked the Police Department, Lions Club, and Miss Seal Beach Court for a;wonderful
event.
Council Member Sustarsic indicated she attended the Seal Beach Be More Healthy
Expo. She made an announcement that the Recreation and Parks Commission will be
holding a Special meeting on Wednesday, June 21, 2017 to discuss possibly dividing
the Arbor Dog Park to include a separate section for small dogs.
Council Member Deaton indicated she had a great. time at the Seal Beach Police
Department Open House. Additionally, she announced that the Federal Emergency
Management,Agency (FEMA) public meeting will be held at 7p.m. on June 15, 2017 in
the Council Chambers to discuss flood map revisions for Seal Beach being proposed by
FEMA.
Mayor Pro Tern Varipapa indicated he attended the Be More Healthy Expo and thanked
all participants. He then expressed his sincere apologies that he was unable to attend
the Police Department Open House due to a scheduling conflict.
COUNCIL ITEMS
A. Amendment to the Seal Beach,Public Financing Authority Agreement —
Adopt'the following: Resolution No. 6741, declaring a need for a parking authority
(the "Parking Authority") to function in the City and declaring the City Council to
be the Board of Directors of the Parking Authority, and Resolution No. 6742,
approving the execution and delivery of an amendment (the "Amendment') to the
Joint Exercise of Powers Agreement (the "Original Agreement") of the Seal
Beach Public Financing Authority (the "PFA")
Finance Director Beatley presented a comprehensive overview of the information
provided in the staff report.
City Attorney 'Steele provided background and benefits regarding the selection of a
Parking Authority as the replacement agency to the Seal Beach Public Financing
Authority.
City Attorney Steele addressed Council Member Deaton's questions regarding what a
parking authority would do, how it relates to our current parking study and current
parking improvements by explaining that the only direct relation would be the ability of
the City to finance parking improvements if the City Council desired to consider such
options in the future. He indicated that currently this is purely a financing mechanism
and that the, City of Seal Beach doesn't have a Housing Authority to move into his
position due to the dissolution of redevelopment agencies and the County of Orange
now'overseeing the Housing Authority on behalf of the City.
City Attorney Steele addressed Council Member Moore's question regarding why the
Parking Authority was chosen.
Finance Director Beatley confirmed for Mayor Pro Tem Varipapa that there is no
immediate financial impact and reaffirmed that any future actions would be brought to
the City Council for consideration and approval.
Council Member Deaton clarified that this does not create a new tax on the residents;
this is a way to avoid additional taxes. City Attorney Steele added that this is also a way
to ensure we can continue to make the debt service commitments that the City already
has in place. Without this change, the City will not have a Financing Authority when the
Successor Agency is dissolved over the next few years.
Deaton moved, second by Varipapa, to adopt Resolution No. 6741 , declaring a need for
a parking authority (the "Parking Authority") to function in the City and declaring the City

approving the execution and delivery of an amendment (the "Amendment') to the Joint

F. City of Seal Beach Appointment to the Joint Land Use Policy Committee for the
Development of a Joint. Land Use Plan in Collaboration with Naval Weapons
Station Seal Beach - Approve Resolution 6738 appointing a member of the City
Council and an alternate to serve on the Joint Land Use Policy Committee.
G. City of Seal Beach Participation in the Housing and Community Development
Block Grant (CDBG) Program for Grant Year 2018-2019, 2019-2020, 2019-2020,
and 2020=2021 - Adopt;Resolution No. 6739 of the City of Seal Beach approving
the on-going participation in the County of Orange Housing and Community
Development Program for 2018-2019 and for up to two (2) additional years
(2019-2020 & 2020-2021) if funded by the County, to fund the Leisure World
bathroom upgrade handicap accessibility program.
H. Approve Submittal of FY 2017/18 Measure M2 Eligibility Package and its
Components — Adopt Resolution No. 6740 Concerning the Status and Update of
the Circulation Element, Local Signal Synchronization Plan and Mitigation Fee
Program for the City of Seal Beach; adopt the 7-year Measure M2 Capital
Improvement Program (CIP) for Fiscal Years (FY) 2017/18 through 2023/24;
submit Maintenance of Effort Reporting Form and Supporting Documentation for
the, City of Seal Beach to Orange County Transportation Authority (OCTA);
submit Congestion Management, Program (CMP) monitoring checklists for the
City of Seal Beach to OCTA; submit a Local Signal Synchronization Plan update
to OCTA; submit the current, adopted Mitigated Fee Program to OCTA; submit
Measure M2. Eligibility Checklist to OCTA; direct the City Manager to file the
adopted.Resolution, CIP and the Measure M2 eligibility documents with OCTA in
compliance with the requirements of OCTA.
ITEMS REMOVED FROM THE CONSENT CALENDAR

Interim Community Development Director Landavazo presented a comprehensive
overview of the information provided in the staff report.
Council Member Deaton volunteered for the appointment to the Joint Land Use Policy
Committee and Mayor Pro Tem Varipapa volunteered to be the alternate.
Moore moved, second by Varipapa, to adopt Resolution 6738 appointing a member of
the City Council and an alternate to serve on the Joint Land Use Policy Committee.

PUBLIC HEARING
I. Adopt the Amended and Restated 2017/2018 Comprehensive Fee Resolution —
Adopt Resolution No. 6743 establishing new fees and charges for goods,
services, and facilities provided by the City and amending and restating the
2017/2018 Comprehensive Fee Resolution.
Finance. Director Beatley introduced Senior Account Technician Michelle Marquez who
presented a brief presentation on the fees.
In response to Council Member Deaton's inquiry regarding the film permit business
license fees, Finance Director Beatley indicated we could raise those rates significantly
without having too much push back. Recreation Manager Tim Kelsey indicated rates
were determined based on cities of similar size as well as additional fees beyond the
permit application. Council Member Deaton indicated that keeping the fee minimal
allows for the City to use,more discretion on what gets approved.
In response to Council Member Deaton's question regarding administrative fees, Senior
Account Technician .Marquez .indicated that this fee was implemented to help recover
partial staff time involved when processing business licenses.
In response to Council Member Moore's question, Senior Account Technician Marquez
clarified the policy regarding exemptions for business license applicants that make less
than $25,000 annually and explained why they pay the full fee their first year.
Mayor Massa-Lavitt inquired how the water shut-off and turn-on fees apply to Leisure
World residents. Senior Account Technician Marquez explained this does not apply
because the mutuals (associations) pay for the water bill.
In response to, Mayor Pro Tem Varipapa's inquiry, Finance Director Beatley; indicated
that the daily rate for beach parking increase from $10 to $18 is the largest increase in
fees. Additionally she clarified that the fee for use of the municipal athletic facility for
youth non-residential programs increased from $20.50 to $20.75.
In response to Council Member'Sustarsic's question regarding beach parking, Finance
Director Beatley discussed the increase in fees for parking passes at the beach over the
last several years and alternatives for residents. Additionally, there was discussion
regarding special event parking fees that will not exceed $25 a space.
Finance Director Beatley clarified for Council Member Deaton that special performer
permits would not be subject to a fee.
Mayor Massa-Lavitt opened the public hearing. Speakers: John Domain spoke
regarding the performer permits. Having no other requests to speak, Mayor Massa-
Levitt closed the public hearing.
Deaton moved, .second by Varipapa, to adopt Resolution No. 6743 establishing new
fees and charges for goods, services, and facilities provided by the City and amending
and restating the 2017/2018 Comprehensive Fee Resolution.
