Minutes Approved by: C a Land vazo enm Director of Community Development City of Seal Beach — Planning Commission June 19, 2017 Chair Machen called the regular meeting of the Planning Commission to order at 7:01 p.m. in the City Council Chambers. Commissioner Klinger led the Salute to the Flag. ROLL CALL Present: Commissioners: Machen, Thomas, Aguilar, Klinger, Campbell Absent: Commissioners: None Staff Present: Amy Grayson, Assistant City Attorney Crystal Landavazo, Interim Community Development Director Steven Fowler, Assistant Planner Dana Engstrom, Deputy City Clerk APPROVAL OF AGENDA With no objections, Chair Machen so ordered the approval of the agenda as presented. ORAL COMMUNICATIONS Chair Machen opened Oral Communications. Speakers: None. Chair Machen closed oral communications. CONSENT CALENDAR Approval of Planning Commission Meeting Minutes from May 15, 2017 Motion by Thomas, second by Klinger, to approve the Planning Commission Meeting minutes from May 15, 2017. AYES: Machen, Thomas, Campbell, Aguilar, Klinger NOES: None ABSENT: None ABSTAIN: None Motion Carried SCHEDULED MATTERS There were no scheduled matters on the agenda NEW BUSINESS 2. Minor Use Permit 17- 4 34 B Surfside Avenue Applicant: Lawrence A. Zero Request: Minor Use Permit (MUP) 17 -4 to allow a covered roof access structure to exceed the maximum roof height of 35 feet by 5 feet at an existing single family residence in the Surfside Colony in the Residential Low Density (RLD- 9) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 17 -14, approving MUP 17-4 with conditions. Assistant Planner Steve Fowler provided a comprehensive overview of the information provided in the staff report as well as reported that staff has not received any correspondence regarding this item. Assistant Planner Steve Fowler clarified for Commissioner Campbell that the height was in compliance. Chair Machen opened the public hearing. Speakers: The applicant, Lawrence Zero spoke regarding his application explaining that the modifications were the only solution to prevent future flooding in his living room. There being no additional requests to speak, Chair Machen closed the public hearing. Motion by Thomas, second by Aguilar, to adopt Resolution No. 17- 14, approving MUP 17-4 with conditions. AYES: Machen, Thomas, Aguilar, Klinger, Campbell NOES: None ABSENT: None ABSTAIN: None Motion Carried Assistant City Attorney Amy Grayson stated that the 10 day appeal period begins tomorrow. PUBLIC HEARING 3. Environmental Impact Report and Conditional Use Permit 16 -7 12411 Seal Beach Boulevard Applicant: Marty Potts Request: Request for certification of Final Environmental Impact Report (Final EIR) and approval of Conditional Use Permit (CUP) 16- 7 to construct a 37,000 sq. ft. health club ( fitness center) at City of Seal Beach Planning Commission Agenda • June 19, 2017 12411 Seal Beach Boulevard within the Shops at Rossmoor in the General Commercial (GC) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 17 -15, certifying the Final Environmental Impact Report with a Mitigation Monitoring Reporting Program and approving Resolution No. 17 -16 approving Conditional Use Permit 16 -7 with Conditions. Chair Machen indicated that due to an error in the location on the posting of the public notice the City Attorney and staff recommend that the Planning Commission open the public hearing and continue this item to Tuesday, June 27, 2017 at 7pm so all interested parties will have adequate notice of the hearing and equal opportunity to comment on this item. Interim Community Development Director Crystal Landavazo indicated that due to City Policy, a person is only allowed to speak once during a public hearing. Therefore, those who are planning to attend the meeting Tuesday, June 27, 2017 are encouraged to hold off on any public testimony since they wouldn't be able to speak twice on the item. All commissioners agreed to allow any person who is unable to attend next Tuesday to present their testimony now and continue this item with the public hearing left open until June 27, 2017 at 7pm in the Seal Beach Council Chambers. Chair Machen opened the public hearing. Speakers: Glenn Duckett spoke in favor of the proposed LA Fitness project indicating he is aware that there are both benefits and draw backs identifying what he felt was considered benefits and provided a drawing of a configuration in which he rotated the building 90 degrees. Octabium Murray, a licensed real - estate agent in Rossmoor, spoke in opposition of the proposed LA Fitness project and feels the project is being imposed on the community and negatively impact real- estate values and increased crime. There being no additional requests to speak, Campbell moved, second by Aguilar to continue the Environmental Impact Report and Conditional Use Permit 16 -7 public hearing to Tuesday, June 27, 2017 at 7pm including allowing additional presentation of public comments at that time. DIRECTOR'S REPORT Interim Director Crystal Landavazo announced that between Memorial Day and Labor Day the Commission can wear casual dress attire. COMMISSION CONCERNS There were no Commission concerns.
