SUBJECT: BEACHES OF SOUTHERN CALIFORNIA MARKETING
COALITION AGREEMENT
SUMMARY OF REQUEST
Approve the attached agreement enabling the City to solicit and consider corporate
sponsorships and select advertising opportunities.

The City of Seal Beach currently benefits from limited sponsorships including the
lifeguards' use of Yamaha wave runners and Chevrolet vehicles. By allowing staff to
participate in the agreement before you, the Seal Beach City Council will determine on a
case by case basis whether to participate in each or any proposal offered to the city. This
is an opportunity for the city to enhance the current program. In each case, Council will
determine if a sponsor is appropriate for the city's needs.
In return for services, the coalition, administered by the Sate of California Division of
Marketing, will receive twelve percent of any funds provided or eight percent of the
value of the equipment provided by the sponsor, as approved by the Beaches of Southern
California participants in the program. This payment will be generated by the
enterprising fund developed by any approved sponsorship. Over the past four years, the
Adopt -a -Beach trash can program has generated enough revenue to cover the cost for
provision of Chevrolet sponsored vehicles. With this new coalition agreement, we
anticipate continued vehicle sponsorship for the Lifeguard Department and potential for
other city departments to receive vehicles as well other opportunities. Again, any
sponsorship the city accepts will be agreed to only following Council review.
This agreement has been reviewed by the City Attorney's office for both form and legal
substance.

RECOMMENDATION
Approve the agreement with the Beaches of Southern California Marketing Coalition and
authorize the City Manager to execute the same.

Dear Coalition Members,
Due to an ordering error, some members did not receive new vehicles as was required
under the Chevy Lifeguard Vehicle Sponsorship Agreement. Those members that were
affected were able to retain the vehicles they had under the old agreement or they were
able to swap vehicles ordered for another member. Due to the fact that some members
did not receive new vehicles, Chevy is requesting that we amend the contract to allow
consideration to include the provision of "used" as well as new vehicles.
Attached please find a copy of the amendment. Please have an authorized
representative of your agency sign two copies of the signature page and return it to me
as soon as possible.

LIFEGUARD VEHICLE SPONSORSHIP AGREEMENT
Between
BEACHES OF SOUTHERN CALIFORNIA COALTION
And
CHEVROLET MOTOR DIVISION
GENERAL MOTORS CORPORATION
THIS AGREEMENT, dated as of the date of the last signature herein, is an amendment
to the LIFEGUARD VEHICLE SPONSORSHIP AGREEMENT, dated March 10, 2003, by and
between
CHEVROLET MOTOR DIVISION,
GENERAL MOTORS CORPORATION, a
Delaware Corporation, hereinafter referred to
as "SPONSOR ";
AND CITIES of Seal Beach, Newport Beach,
Laguna Beach, Solana Beach, Oceanside,
Imperial Beach, Encinitas, and San Clemente,
all municipal corporations or general law
cities, hereinafter collectively referred to as
"CITIES ";
AND ORANGE COUNTY, specifically the Public
Facility Resource Department, a political
subdivision of the State of California,
hereinafter referred to as "ORANGE
COUNTY';
AND STATE OF CALIFORNIA, specifically
through the Department of Parks and
Recreation, limited to its Orange Coast District
hereinafter referred to as "STATE ".
The purpose of this Amendment is to amend the Lifeguard Vehicle Sponsorship Agreement only
as follows:
Section V, Paragraph A are hereby saperceded by the following:
A. For the rights and benefits granted to SPONSOR herein, SPONSOR agrees to deliver
to the Public Entity Parties sixty-seven (67) new or used Chevrolet vehicles as described in
Exhibit 3 for use by the Public Entity Parties' Lifeguard Divisions.
Except as modified herein, the terms and conditions for the loan of the Lifeguard Vehicles as
described in the remainder of paragraph A and the remainder of the previous Lifeguard Vehicle
Sponsorship Agreement remains in effect, without change.
