Director of Public Works/City Engineer SUBJECT: EMERGENCY REPAIR — McGAUGH SCHOOL POOL HEATER REPLACEMENT, PROJECT No. 50033 SUMMARY OF REOUEST: The proposed City Council action will approve a resolution making findings regarding the urgency of the proposed repair and replacement, and authorize the City Manager to negotiate contracts at a cost not to exceed $35,000 to repair the City's Pool Heater. BACKGROUND: The City of Seal Beach operates a public pool for community recreation use at McGaugh Middle School. On June 16, 2002, the pool heater completely failed and it has been determined that complete replacement is the best option. Without the repair of the heater, the pool will not be heated and therefore, the use of the pool will decline. Fortunately, Proposition 12 funds have been budgeted for the heater improvements and staff is proposing to replace the heating system. The estimated cost of the replacement of the heater and repair of the piping and venting is between $35,000 including construction, management and inspection. The design life of the repair is estimated at ten years. The City's charter authorizes City Council to award contracts without advertising for bids, if such work is deemed by the Council to be of urgent necessity for the preservation of life, health, or property, and is authorized by resolution containing a declaration of the fads constituting such urgency. Due to the urgency of this repair project, staff recommends that the Council pass a resolution declaring emergency conditions and direct staff to negotiate contracts with qualified pool contractors at a cost not to exceed $35,000 to replace and repair the City's pool heating system. FISCAL IMPACT: Proposition 12 funds in the amount of $35,000 are currently available within the City's Capital Improvement Program budget for construction of these improvements.
