Dancs, P.E., Director of Public Works/City Engineer SUBJECT: AUTHORIZE THE MAYOR TO EXECUTE THE AMENDMENT AND RESTATEMENT OF NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM STORMWATER PERMIT IMPLEMENTATION AGREEMENT WITH THE COUNTY OF ORANGE SUMMARY OF REOUEST: Authorize the Mayor to execute the amendment and restatement of National Pollutant Discharge Elimination System Stormwater Permit Implementation Agreement with the County of Orange. Congress passed the Clean Water Act, which requires that the Federal Environmental Protection Agency promulgate regulations for applications for permits for stormwater discharges. The City has been a co- permitte with the County of Orange to meet the requirements of the various regulations associated with the Act. The County and City cooperation is formalized in an agreement which specifies County, City and District responsibilities and costs that are associated with the permit. This agreement was originally entered into December of 1990, amended in October of 1993, and is being amended at this time to include additional cities. The agreement will not be amended unless it has to address other programmatic changes as a result of the third term permit requirements. - Agenda Item L FISCAL IMPACT: Execution of this agreement will permit the funding of services with co- permittees to improve the water quality in Orange County. Funds in the amount of $90,597 are currently available within the City's 2002/2003 proposed budget in the Storm Drain Intergovernmental Accounts. Staff recommends that the Mayor execute the amendment and restatement of National Pollutant Discharge Elimination System Stormwater Permit Implementation Agreement with the County of Orange.
