SUBJECT: APPROVAL OF THREE -YEAR COOPERATION
AGREEMENT WITH COUNTY OF ORANGE FOR
PARTICIPATION IN URBAN COUNTY COMMUNITY
DEVELOPMENT BLOCK GRANT AND HOME
PROGRAMS
SUMMARY OF REQUEST:
Adopt Resolution No. , A Resolution of the City Council of the City of Seal
Beach, Approving the City's Participation in the Housing and Community Development
Block Grant Program with the County of Orange (FY's 2003 -2004 through 2005- 2006).
Adoption approves a cooperation agreement with the County of Orange to participate in
the Urban County application for Fiscal Years 2003 -2004, 2004 -2005, and 2005 -2006.
BACKGROUND:
As a non - entitlement city (population less than 50,000), Seal Beach cannot independently
apply for and receive funds from the Federal government's Community Development
Block Grant (CDBG) and HOME Investment Partnership Programs. The City currently
receives these funds through participation with Orange County through the Urban County
CDBG program. The City has only participated in the CDBG Program. In order to
participate, the City must have a cooperation agreement with Orange County. The City
has entered into the requested agreements since 1987.
Since 1987, cities have been required to commit to three years general participation in the
Urban County CDBG program or apply annually to the State of California Small Cities
Program. All eligible cities in Orange County elected to participate in the Urban County
application in 1987, 1990, 1993, 1996, and 1999.
The 1999 Cooperation Agreement will expire on June 30, 2003. All cities must now
either adopt general participation agreements with Orange County for Fiscal Years 2003- V'

2004, 2004 -2005, and 2005 -2006, or choose to participate in the State's Small Cities
Program.
Three Year Participation Commitment
In an effort to "pre- budget" moneys at the Federal level, cities are required to "opt -in" or
"opt -out" of the Urban County CDBG Program or Small Cities Program for a three year
period.
The City Council must by resolution choose whether to participate in the Urban County
CDBG Program, the State's Small Cities CDBG Program or determine not to seek CDBG
funding.
CURRENTSTATUS
This year is the last year of the current three -year commitment with the Urban County
CDBG Program. Cities must now renew the three -year commitment to the Urban County
CDBG Program or opt out of this program for future CDBG finding.
In order to remain in the Urban County Program, it is necessary for each city, by city
council resolution, to enter a cooperation agreement with the County of Orange for Fiscal
Years 2003 -2004, 2004 -2005, and 2005 -2006.
FISCAL IMPACT:
Failure to participate in the Urban County Program would result in potential loss of grant
funds available on a competitive basis through the Orange County Urban County CDBG
Program. The most recent funded activity within the City by this program was $250,000
for the recent improvement project to Seal Beach Boulevard between Pacific Coast
Highway and Electric Avenue.
RECOMMENDATION:
