Danes, Director of Public Works/City Engineer SUBJECT: APPROVAL OF FINAL TRACT MAP # 16306 - CENTEX HOMES DEVELOPMENT SUMMARY OF REOUEST: It is requested that the City Council find that Tract Map 16306 is in substantial compliance with the previously approved tentative tract map, approve Tract Map 16306 as presented, and instruct the City Engineer and City Clerk to execute said Tract Map as required. BACKGROUND: On December 5, 2001, a tentative map of the proposed subdivision was approved subject to Subdivision Laws, City Municipal Code, and to the requirements and conditions contained in Seal Beach Planning Commission Resolution No. 01-46. The approved tentative tract map (Tentative Tract Map 16306) established the residential development for the subdivision of the property into three (3) residential lots, along with three (3) landscape parcels to be maintained by the Home Owners Association and one (1) twenty (20) foot wide parcel along the Seal Beach Boulevard frontage for landscaping purposes to be deeded to the City of Seal Beach but maintained by the Home Owners Association. The property is located along Seal Beach Boulevard, between the Bixby Old Ranch Town Center and Rossmoor Center Way/Plymouth Drive. Approval of the Final Tract Map will formally create the subject lots and parcels, and will allow the lots to be sold in accordance with the terms and conditions of Tract Map 16306. In accordance with the Subdivision Map Act, the subdivider has been conditioned to construct water lines, sewer lines, drainage system, and street frontage improvements including curb, gutter, sidewak street trees, pavement, and underground utilities. The subdivider has agreed to these conditions and has provided improvement plans for the construction of these improvements. Most of the improvements required have already been installed or are in the process of being installed as part of the previously approved and adjacent Tract No. 15797 improvements with the exception of landscaping. The subdivider has provided the City with a letter agreeing to construct the required landscaping and agreeing that the landscaping will be maintained by the Home Owners Agenda Item Association. In order to secure the establishment of the Home Owners Association and the maintenance of landscaping by the Home Owners Association the "Codes, Covenants, and Restrictions" for the previous and adjacent Centex Homes Tract 15797 "Codes, Covenants, and Restrictions" will be amended to incorporate this Tract 16306 Home Owners Association and landscape maintenance requirements, and other requirements, together into one overall set of "Codes, Covenants, and Restrictions" for both tracts. The amended "Codes, Covenants, and Restrictions" will be recorded and will run with the land. Therefore a formal subdivision agreement is not need for this subdivision. The Final Tract Map has been reviewed and approved by the County of Orange Public Facilities & Resources Department for compliance with all required Subdivision Map Act requirements and by the City Engineer and Director of Development Services for compliance with all conditions of approval of the Centex Homes Development and Tentative Tract Map 16306, and it is appropriate for the City Council to approve Tract Map 16306 as presented. FISCAL IMPACT: No fiscal impact. All costs will be paid or reimbursed by the developer. Appropriate plan check and building permit fees will be charged as costs are incurred. RECOMMENDATION: It is recommended that the City Council: Find that Tract Map 16306 is in substantial compliance with the previously approved tentative tract map, approve Tract Map 16306 as presented, and instruct the City Engineer and City Clerk to execute said Tract Map as required.
