SEAL BEACH SPOILED DOGS SOCIETY — ZOETER FIELD USE..... what is proposed is a joint use of the Zoeter facility..... do not have apprehension to doing this for a trial period..... possibly with a caveat that it be limited to a certain number of days..... thereafter that it be sent to the Parks and Recreation Commission for review .... at which time they could make recommendations as to how the permit could be modified or revoke the permit for use, yet also be in accordance with the rest of the provisions of the Municipal Code to require indemnification, repair of the facility, a limit of the number of canine athletes allowed on the field at one time .... that could be in the form of a motion. there is no jurisdiction to approve this at this meeting ... the law says no dogs except in two parks ... the issue is does the Council want to change the law ... the Council must approve the decision of the City Manager because he has said he can not change the law... if the desire is to change it then it needs to be sent back to the Parks and Recreation Commission.... Council can direct the City Manager and City Attorney to come back with an ordinance but only after it has gone before the Parks and Recreation Commission.. Larson moved a substitute motion that this matter be referred to the Parks and Recreation Commission and that the decision of the City Manager be approved... Yost seconded. The Council would then be upholding the decision of the City Manager for the time being until the Parks and Recreation Commission can make a recommendation to change the law or not change the law ..... the use would be during hours that Zoeter is not in use .... from 6:30 a.m. to 8:00 a.m. There is still a question of setting precedent with an organization such as this.... CA: It would depend on the nature of the ordinance... if the Parks and Recreation Commission feels this would be a good idea, and after public input, that the Code should be changed at that point an ordinance could be fine tuned for exact wording.....
