HomeMy WebLinkAboutCC Res 4491 1996-07-22 I I I RESO~UTION NO, !1!!21 , .A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, APPROVING GENERAL PLAN AMENDMENT 96- lA, AMENDING THE LAND USE ELEMENT TO MAINTAIN CONSISTENCY BETWEEN THE LAND USE ELEMENT AND THE MAIN STREET SPECIFIC PLAN AND TO REVISE THE RSUMMARY TABLE OF EXISTING AND PROPOSED LAND USES IN ACRESR OF THE LAND USE ELEMENT TO DEPICT THE INCREASE OF APPROXIMATELY 14.8 A~RBS OF RMAIN STREET SPECIFIC PLAN ZONEn LAND AND APPROPRIATE DECREASES OF OTHER LAND USE CATEGORIES WITHIN THE CITY THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: Section I. City staff has received direction from the City Council, pursuant to Section 28-2602 of the Code of the City of Seal ~"h, to prepare this matter for the appropriate public hearings, in accordance with the provisions of State law and local ordinances. The purpose of the proposed General Plan Land Use Element Amendment is to: (I) Amend the Land Use Element of the General Plan to change the land use designation from OService Commercial", OGeneral Commercial", and "Public Land Use" to RMain Street Specific Plan Zone" on the area proposed to be subject to the Main Street Specific Plan; and, (2) Amend the Land Use Element of the General Plan to amend several goals, policies and issues to reflect proposed revisions to the current "Main Street Specific Plan", and to have conformity between the Land Use Element and the specific plan. In addition, an amendment to the "Summary Table of Existing and Proposed Land Uses in Acreso by creating the "Main Street Specific PlIm Zone," and redesignating areas currently classified as "Service Commercial 0 , oGeneral Commercial", and "Public Land UseR to the new zone. Section 2. Pursuant to 14 Calif. Code of Regs. * 15025(a) and II II.C and ill of the City is Local CEQA Guidelines, staff prepared an Initial Study and a Negative Declaration, which were circulated for public review and comment from January 30, 1996 to February 21, 1996, in compliance with the provisions of the California Environmental Quality Act and the City's Local CEQA Guidelines. The Planning Commission has recommended adoption of Negative Declaration 96-1, through the approval of Resolution No. 96-10, which is incorporated herein by reference. The City Council has adopted Negative Declaration 96-1, through the approval of Resolution No. 96- _, which is incorporated hercln by reference. Said Negative Declaration represents the independent judgement of the City of Seal Beach. Section 3. A duly noticed public hearing was held before the Planning Commission on February 21, March 6, and March 20, 1996, to consider the various applications, the Initial Study and the Negative Declaration. Al the public hearing, the Planning Commission received both oral and written testimony regarding the matters under consideration. Resolution Number ~4It,f1 Section 4. The City Council conducted a duly noticed public hearing on June 24, 1996, and received into evidence the Report of the Planning Commission, including the Staff Reports dated February 21, March 6, March 20, April 3, and April 17, 1996, Planning Commission Resolution's No. 96-10 through 96-16, and the Minutes of the Planning Commission lIleetings of February 21, March 6, March 20, April 3, and April 17, 1996. In addition, the City Council considered all written and oral evidence presented at the time of the public hearing. . Section 5. The record of the hearing indicates the following: I (a) City staff has received direction from the City Council, pursuant to Section 28-2602 of the Code of the City of Seal HP.l!"h, to prepare this matter for the appropriate public hearings, in accordance with the provisions of State law and local ordinances. (b) The City of Seal Beach is requesting to change the General Plan and zoning designations of the existing properties from "Service Commercial", "General Commercial", and "Public Land Use" to "Main Street Specific Plan Zone" on the area proposed to be subject to the Main Street Specific Plan. The subject area is irregular in shape, and comprises approximately 14.8 net acres, and approximately 21 gross acres, including public roadways and alleys. I 1 I Resolution Number ~~$t/ (e) The subject area is the location of the historic commercial area of Seal Beach and comprises primarily commercial uses along Main Street, with public recreation uses provided at Eisenhower Park and the beach. Public uses along 8th Street which are included in the Main Street Specific Plan area include City Hall, Fire Station 44, and various public parking lots. (t) The General Plan and the zoning map indicate the subject area to be designated for and zoned for "Service Commercial", "General Commercial", and "Public Land Use". The proposed provisions of the implementing actions for the Main Street Specific Plan would change those designations for the subject areas to "Main Street Specific Plan Zone". (g) The surrounding General Plan Land Use designations, zoning designations, and current land uses are as follows: NORTH 1) General Plan Land Use designation: Service Commercial and General Commercial 2) Zoning designation: Service Commercial and General Commercial 3) Current Land Use: Commercial uses along Pacific Coast Highway SOUTH 1) General Plan Land Use designation: Public 2) Zoning designation: Public Land Use\Recreation 3) Current Land Use: Public beach parking lot and public beach EAST 1) General Plan Land Use designation: Residential High Density 2) Zoning designation: Residential High Density 3) Current Land Use: Detached single-family residential and attached multi-family residential WEST 1) General Plan Land Use designation: Residential High Density 2) Zoning designation: Residential High Density 3) Current Land Use: Detached single-family residential and attached multi-family residential (h) The proposed General Plan Land Use Element Amendment 96-lA is enclosed as Exhibit A and incorporated herein by reference. (i) The staff and consultant team conducted numerous surveys and interviews, in-person and by mail, with residents and business owners in and around the area affected by the proposed Main Street Specific Plan. The consultant team further conducted studies of existing land uses in the Main Street area, aesthetic evaluations, and an intensive parking utilization study. The results of those studies were compiled in the document entitled "Background Studies - Main Street Specific Plan," which has been reviewed by the Planning Commission, available for review and comment by the public, and made a part of the record of these hearings. G> Numerous residents, business owners, and other interested parties have provided written and oral testimony with regard to all or parts of the proposed revisions. (k) Based on testimony received at the Planning Commission and City Council public hearings, no additional General Plan amendments other than those proposed at the time of the Planning Commission public hearings have been proposed. Resolution Number t/4tJ / Section 6. Based upon the evidence in the record, including, without limitation, the facts stated in I 4 of this resolution, and in the environmental documentation prepared in conjunction with this project, and pursuant to .. 28-2600 and 28-2602 of the ~ of the City of Seal ~r,:h, the City Council hereby finds as follows: (a) General Plan Land Use Element Amendment 96-1A will not be detrimental to the short term or long term goals of the City of Seal Beach and is in the interest of the public health, safety and welfare. (b) General Plan Land Use Element Amendment 96-IA will amend the Land Use Element of the General Plan to amend several goals, policies and issues to reflect I proposed revisions to the current "Main Street Specific PIml", and to have conformity between the Land Use Element and the specific plan. In addition, an amendment to the "Summary Table of Existing and Proposed Land Uses in Acres" by creating the "Main Street Specific Plan Zone" to reflect the redesignation of areas' currently classified as "Service Commercial", "General Commercial", and "Public Land Use" to this designation. (c) The proposed General Plan Land Use Element Amendment 96-1A will result in an increase of 14.8 acres of "Main Street Specific Plan Zone", and a decrease of 8.0 acres of "Service Commercial", 0.4 acres of "General Commercial", and 6.3 acres of "Public" land use designated within the City. Section 7. The City Council hereby incorporates into the formal record of the General Plan Amendment relating to the "Main Street Specific Plan" the "Background Studies - Main Street Specific Plan' Report, revised and dated January 1996, by receiving and filing that document. Section 8. Based on the foregoing, the City Council hereby approves General Plan Amendment 96-1A to the City Council, as set forth in Exhibit A, attached hereto and incorporated herein by reference. Resolution Number ~~~I "EmmIT An General Plan Land Use Amendment 96-IA The following amendments to the General Plan Land Use Element are hereby adopted, to read as set forth below: a. Land Use Element - COMMUNITY GOALS - Goal 6 (page 5) I "The City should explore available means to support and encourage commercial development within the community. Local, state and federal facilities should be developed and maintained within or adjacent to business districts in the City. A specific plan should be developed for the coastal business district. This plan shall recognize the Main Street area as the heart and soul of Seal Beach. . b. Land Use Element - ISSUES AND POTENTIALS - Section 1.3, Central Business Commercial Area Along Main Street (pages 8 and 9) "1.3 Central Business Commercial Area Along Main Street ~ What is the importance of Main Street for Seal Beach? Potential : I The Main Street area is particularly important because it is a cohesive agent for a City that is geographically fragmented. The vision for Main Street is small town America. Important features include a family town with friendly people who care for each other. A pedestrian oriented area where people walk and feel safe on the street at night. An area with both architectural and economic diversity with a mix of offices and businesses. Main Street is surrounded by an area of mixed housing types and institutions, creating a complete small town community. Although it is recognized that the area will have businesses that serve both residents and visitors, the goal is to not have visitor serving uses overwhelm the area at the expense of the small town character. Land Use Element - COMMERCIAL LAND USE, second paragraph (Page 21) "The visual problems traditionally associated with commercial development is that each establishment is too often conceived and designed as though it is to exist alone or in a vacuum. Each development is often designed with only its particular economic requirements in mind, using materials and signs with no regard for adjacent developments. Even if the establishments are wel1-conceived as individual entities, the overall effect is commonly one of visual clutter. The commercial area along Pacific Coast Highway is particularly susceptible to visual clutter due to the lack of a design criteria applied to this area. A superior overall visual environment could be achieved through the Resolution Number #9/ application of criteria ensuring compatible materials, colors, textures, and architectural styles.' e. Land Use Element - COMMERCIAL LAND USE - Section 3.2 Proposed Service Commercial Uses (Page 24 and 25) '3.2 Proposed Service Commercial/Main Street Specific Plan Zone Uses The proposed Land Use Element would continue the Seal Beach Shopping Center and the Leisure World Shopping Center as functioning service commercial uses. Main Street commercial is also proposed to be designated as Main Street Specific Plan Zone. I As pointed out earlier, the proposed new land use designation would be a name change only, because the present existing uses are of a service commercial nature. Main Street commercial, with the attraction of the beach and with the proximity of relatively high density residential, has the potential to become a unique shopping area. With a strong attraction for beach users, this commercial area can and should turn to a more pedestrian-oriented environment through the design application of textured walkways, street furniture, sign graphics, landscaping, lighting, and other design features. The positive environment of a commercial area can act as a magnet to draw people, or if negative, the environment can repel potential customers. Of prime consideration is a pleasing environment, incorporating the following amenities: 3.2.a Street Graphics (Signs, Logos, or special lighting) I Well designed street graphics can be used to announce to the pedestrian, the cyclist, or the motorisl that he is approaching a distinctive area which contains a concentration of some special service or facility of the community. 3.2.b Walkways Walkways can guide the activities and movements of pedestrians, can even direct their attention, or prevent their intrusion on certain areas. The texture of the walkways is a very immediate and personal kind of experience for the pedestrian. The materials of walkways strongly influence usability and comfort; they can be patterned, textured, and colored. Smooth materials encourage walking, while rough surfaces inhibit walking. A change of texture in paving can cause a feeling of transition from space to space. An excitement can be created for the pedestrian whether he is a casual shopper or directed toward a destination. Pedestrian lighting needs to be created to be more in tune with pedestrian movement rather than vehicular travel. The use of landscape materials is the method that can be employed to soften the sometime harsh texture of circulation paths and building structures. I I 1 I Resolution Number ~~~I 3.2.c Street Furniture Street furniture is the small element in an outdoor space that creates an image for that space. Such elements are benches, signs, lights, mail boxes, drinking fountains, kiosks, trash containers, fire hydrants, traffic lights, newspaper stands, clocks and planters. We tend to pay far too little attention to streel furniture in their design and placement when in reality they are Important image-makers for the City.
