SUBJECT: AUTHORIZATION DIRECTOR OF PUBLIC WORKS
TO EXECUTE "RIGHT OF WAY CERTIFICATIONS"
SUMMARY OF REOUEST:
The proposed City Council action will authorize the Director of Public Works to execute
"Right of Way Certifications" for federally funded projects.
BACKGROUND:
The "Local Agency — Agreement for federal -aid projects" Master Agreement No. 12-
5229 approved in January 1999 between the City and Caltrans requires the City to certify
right of way as detailed in Chapter 13 "Right of Way" of the Caltrans Local Assistance
Procedures Manual.
The City is not qualified through Caltrans programs to certify for acquiring new right of
way but is qualified to hire qualified consultant(s) to perform any or all- respective right
of way functions as necessary. For federally funded projects and when a right of way
certification needed, a "Right of Way Certification" form is to be used. The document is
to be executed by a City official who is authorized by the City Council to execute such
document.
FISCAL IMPACT:
No fiscal impact.
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. which authorizes
the Director of Public Works to execute "Right of Way Certifications ".
