SUBJECT: Allocation of StateCOPS Funds — 2001/02
(Supplemental Law Enforcement Grant)
SUMMARY OF REQUEST:
It is requested that a Public Hearing be held to consider the acceptance of funds provided
under State Assembly Bill AB 3229, Chapter 134. and that at the conclusion of that
hearing, approval be granted for the proposed expenditure of these funds.
BACKGROUND:
In 1996, State Assembly Bill AB 3229, Chapter 134, established the Citizens' Options for
Public Safety Program to provide funded to eligible local jurisdictions. Pursuant to the
current provision of this bill, monies allocated from the Supplemental Law Enforcement
Services Fund (SLEFSF) to recipient entities must be expended exclusively to provide
front line law enforcement services. These funds must also be used to supplement
existing services and by statute cannot be used to supplant any existing funding for law
enforcement services provided by that entity. Legislation related to these funds requires
that all reporting mandates are met and that these funds be expended in the prescribed
fiscal year to avoid forfeiture of the funds.
The City has received notification that the 2001/02 State budget appropriated funds to
Orange County, and based on population, Seal Beach has received $100,087.12.
As previously stated, these funds must be spend for `front line municipal police services,
in accordance with written requests submitted by the Chief of Police of that city or the
Chief Administrator of the law enforcement agency that provides police services to that
city. These written requests shall be acted upon by the City Council. " Government Code
Section 30061[c][2].
It is recommended that these funds be accepted and supplement our existing front line
services in the following manner:

Continuation of one Police Officer
It is proposed that funding will cover the salary and benefits of the additional police
officer hired under the 2000/01 Supplemental Law Enforcement funding for a second
year.
Overtime for Training and Community Policing Programs
SLESF funds have previously been used for Community Oriented Policing training and
to fund bicycle patrol overtime and foot patrol overtime. Funds from this grant would
again be used for this purpose.
FISCAL IMPACT:
The one-year cost of a police officer with benefits and the training and Community
Policing overtime can all be funded with this $100,000 grant.
These funds were initially proposed to be part of a five (5) year funding cycle and the
$100,087.12 for this 2001/02 grant is year two. The effort to secure the renewal of the
funds for subsequent years will be determined by the legislature in the three succeeding
years.
RECOMMENDATION:
It is recommended that a public hearing be held and that Council approval be given to the
acceptance of the 2001/02 Supplemental Law Enforcement (State COPS) funding of
$100,087.12; that the established SLESF be authorized to accept such funds; and that
approval be given to the Chief of Police to expend these funds as detailed in this report.
