Dancs, P.E.,Director of Public Works SUBJECT: CALTRANS AMENDMENT TO COOPERATIVE AGREEMENT 12-386 A-1 SUMMARY OF REQUEST: The proposed action will approve an amendment to the cooperative agreement with the California Department of Transportation(Caltrans)to provide for the removal of concrete bridge debris on the banks of the Anaheim Bay Channel. This amendment extends the agreement termination date from December 31, 2000 to December 31,2002. BACKGROUND: During the 1999/2000 State Budget process, the City was successful in obtaining funding in the amount of $75,000.00 to remove concrete debris and related material from the former Coast Highway bridge over Anaheim Bay Channel. Since bids exceeded the budget, the City has sent a letter requesting additional funds in the amount of$407,000. The first step in this process is to obtain an amendment for an extension of time. FISCAL IMPACT: No fiscal impact. This amendment only deals with an extension of time. Staff is working with the State to secure the necessary funding. RECOMMENDATION: Staff recommends that the City Council approve the Amendment to Cooperative Agreement 12-386 A-1 between the City and the State and authorize the Mayor to execute the agreement. The previously submitted copies dated 10/22/2001 and signed by City officials will be discarded due to error of omitting Amendment A-I to Agreement. This amendment is extending the agreement termination date from December 31,2001 to December 31, 2002. Please have all of the enclosed Agreement signed by the appropriate CITY officials and return them to us approving the Agreement and authorizing its execution. The parties hereto entered into Agreement 12-386 (Document No. 014666) on December 28, 1999. Said Agreement defined the terms and conditions of a cooperative project to restore the natural banks at the Anaheim Bay Channel, referred to herein as "PROJECT" and to remove concrete debris at the Anaheim Bay Channel, referred to herein as "IMPROVEMENTS". 2. Said Agreement shall terminate upon completion of construction of IMPROVEMENTS and upon final payment to CITY by STATE, pursuant to Section II, Article (2) or on December 31, 2000, whichever is earlier in time. 3. The purpose of this Amendment A-1 to Agreement is to extend the termination date from December 31, 2000 to December 31, 2002 to allow for completion of IMPROVEMENTS and final payment to CITY by STATE. IT IS THEREFORE MUTUALLY AGREED: 1. The termination date specified in Section III, Article (10)of the original Agreement shall now be December 31, 2002 instead of December 31, 2000. 2. The other terms and conditions of said Agreement(Document No. 014666) shall remain in full force and effect. 3. This Amendment A-1 to Agreement is hereby deemed to be a part of Document No. 014666. 2 99% .
