SUBJECT: AWARD OF CONTRACT FOR REMOVAL AND
REPLACEMENT OF PLAYGROUND EQUIPMENT AT
ALMOND PARK
SUMMARY OF REQUEST:
The proposed City Council action will approve the proposal to remove and replace playground
equipment at Almond Park.
DISCUSSION:
In May of this year, the City received notice that it was the recipient of a.$40,000 grant award
from the California Integrated Waste Management Board as a part of their Park Playground
Accessibility and Recycling Act Grant Program for FY 2001/02.
The purpose of this grant program is to replace aging playground equipment using recycled
materials and to increase accessibility for disabled children.
In July of this year, the City received four proposals from qualified playground equipment
providers. After careful consideration from Staff, the Parks and Recreation Commission, and
area residents, Miracle Park was selected as the winning proposal. This proposal combined good
ADA accessibility with separated play structures for pre - school age and school age children.
This proposal was also within budget. The following_ proposals all include demolition, removal,
and replacement of the existing equipment.

The City of Seal Beach received a grant award of $40,000 from the California Integrated Waste
Management Board, and the matching funds of $20,000 have been encumbered from the 2000/01
Budget. Total cost estimate for the project is $56,450.25 creating a positive General Fund
impact of $3,549.75.
RECOMMENDATION:-
Staff recommends that the City Council approve the proposal to remove and replace playground
equipment at Almond Park, and authorize, the City Manager to execute contract documents.

I, Lynn Alan Ortlieb, President, have been working in this field for the
last 20 years. Our experience in all areas of playground improvement

SCOPE
General safety recommendations applicable to the installation and maintenance of play equipment supplied
by Miracle Recreation Equipment Company.
INSTALLATION
I. SURFACES All play equipment must be installed over an acceptable impact absorbing surfacing
material. It is the responsibility of the playground designer, installer and operator to ensure that the
size, type and depth of impact absorbing surfacing material used complies with the U.S. Consumer
Product Safety Commission "Handbook for Public Playground Safety (CPSC Handbook). This impact
absorbing surfacing material must cover the entire 'Use Zone" area to a depth appropriate for the
height of the play equipment. The 'Use Zone' is an area under and all around each piece of play
equipment. See the "Use Zones" section below for specific dimensional sizes for specific types of play
equipment. Please refer to the CPSC Handbook for a more detailed discussion of these issues.
Acceptable Surfaces Acceptable impact absorbing surfacing materials include unitary safety surfac-
ing such as pour -in -place rubber or rubber tile, and natural loose fill materials such as bark nuggets,
wood mulch, wood chips, pea gravel and sand. Appropriate thicknesses for the PlaysafeT or Fall
Saverl" materials can be obtained from your Miracle Sales Representative. For the loose fill materials
listed, Miracle recommends a minimum depth of twelve (12) inches.
Unacceptable Surfaces Unacceptable surfaces include turf, undisturbed natural ground, undisturbed
compacted sand, decomposed granite, asphalt, concrete or any other hard surfacing.
USE ZONES: Use zones are the areas under and all around each piece of play equipment that must
be covered with an acceptable impact absorbing surfacing material (see'Surfacing'section above.)
The specific size of these use zones depends upon the type of play equipment as follows:
Regular Swings: The use zone must extend at least two (2) times the pivot point height to both the
front and rear of the top rail. The use zone must extend at least six (6) feet out at each end from the
swing frame legs.
Tire Swings: The use zone must extend at least six (6) feet plus the length of the suspension mem-
bers in all directions. The use zone must also extend at least six (6) feet out at each end from the
swing frame legs.
Slides: The use zone must extend at least six (6) feet in all directions from the perimeter of the slide.
Also, in front of the slide exit measuring from the point where the slide slope is reduced to 5 degrees,
the use zone must extend a total of four (4) feet plus the height of the platform.
All other play equipment: The use zone must extend at least six (6) feet in all directions from the
perimeter of the play equipment

II. OTHER IMPORTANT ITEMS During the installation and maintenance process, ensure that:
A. Warning: Contact burn injuries can occur when metal play surfaces are located in direct sun. To
avoid the risk of such burn injuries, the United Slates Consumer Product Safety Commission
recommends in its "Handbook for Public Playground Safety" that metal play surfaces, such as
stainless steel slides and bare or painted metal crawl tubes, should be placedfinstalled in shaded
areas, and out of direct sunlight. The proper location of metal play surfaces must be addressed
during the play area planning process.
B. There are no exposed concrete footings to trip over or fall on. The top of all footings must be at
or below the bottom of the layer of impact absorbing surfacing material.
C. All bolt threads protruding beyond the nut are cut and peened smooth to the touch. Sharp edges
and/or points of any kind must be eliminated. No more than two threads may be exposed
beyond the end of-the nut.
D. All bolts, screws, set screws or other fasteners are tightened securely. Missing bolts, set screws
or other fasteners must be replaced immediately.
E. All 'S" hooks and clevises are free of any wear. That all "S" hooks are closed metal to metal
(0.04" gap maximum) and all clevises and supporting hardware are securely attached. A Miracle
'S' hook for swing seat use has the dimensions of 2 -314" x 4 -112" and looks like the following
drawing. "S" hooks must comply with ASTM 1487 section 6.3.1 on entanglement.
MAINTENANCE
REGULAR MAINTENANCE INSPECTIONS During the course of play (particularly with new play equipment
which is heavily used the first few weeks), d is common that holes and trenches develop in loose fill impact
absorbing surfacing material, i.e. under swings, around slides (exit, entry), around whirls, around and under
climbers and see saws, etc. The loose fill impact absorbing surfacing material must be maintained at the
appropriate depth of twelve (12) inches.
DURING REGULAR MAINTENANCE INSPECTIONS ENSURE:
A. There are no sharp edges and/or points of any kind.
B. All bolts, screws, set screws or other fasteners are tightened securely. Missing bolts, set screws
or other fasteners must be replaced immediately. See Specifications and Installation Guides for
replacement parts listed in the Bill of Material or Parts Carton. Use only original replacement
parts from Miracle.
C. All "S' hooks and clevises are free of wear with all 'S" hooks closed metal to metal (0.04" gap
maximum) and all clevises and supporting hardware securely attached. 'S" hooks must comply
with ASTM 1487 section 6.3.1 on entanglement.

D. All swings seats are in good condition. Some examples of things to look for indicating swings
seats/swing riders need to be repaired or replaced:
If the grommet area or any other part of the seat shows signs of wear such as rust or stress
cracks in the rubber, immediately remove the seat from service. Be sure that the grommet is in
good condition and that only the large 'S* hook passes through the swing seat grommet.

E. If any of the following conditions are present, immediately remove the seat from service:
Rusting, splitting, checking, warping, complete breakage, visible cracks, splintering, deteriorated
insert material, exposure of the rubber encapsulated metal in the seat, loose seats, heavy seats
with sharp edges or corners, loose bolts and nuts, exposed and /or protruding parts, pinch and/or
crush points and/or evidence of vandalism.
F. All of chains, rods, ropes or cables are in good condition. Replace chains, rods, ropes or cables
if any of the following are observed:

Cracking, rusting, complete breakage, chain links that have become thin with wear, bending,
warping, frayed rope and/or cable, deformation, wom, loose or sharp edges, exposed ends,
protrusions and /or evidence of vandalism.
Anything showing any sign of wear, fatigue or otherwise presenting an unsafe condition must be immediately
replaced. If not immediately replaced, the play equipment must be removed from service and no one permit-
ted to use the play equipment until the problems are corrected. Be sure to understand, apply and utilize the
CPSC Handbook For Public Playground Safety, all materials and information provided by Miracle, and your
own knowledge and experience in determining if wear, fatigue or any other unsafe condition exists.
All missing parts must be immediately replaced. The play equipment must be removed from service and no
one permitted to use the play equipment until the missing parts are replaced. Use only original replacement
parts from Miracle.
This is a partial listing of regular maintenance and inspection hems. Utilize the CPSC Handbook as an
additional guide and reference. You must develop a checklist specific to your needs as determined by use,
weather, etc. Maintenance is your responsibility. Only you can do it! Please protect the user of the play
equipment.
MISUSE
Any attempt to alter, adapt, change, attach to or assemble the play equipment for anything other than its
intended use as stated in the specification/installation instructions is strictly prohibited. Miracle's play equip-
ment by design has an intended specific use. Lack of maintenance and/or usage in a manner other than its
intended use can result in serious injury.
INSTALLATION POLICY
All play equipment is shipped unassembled. Miracle does not install play equipment. Miracle's products are
safe fof use when installed (which includes the installation of an acceptable impact absorbing surfacing
material as specified in Section 1); inspected and maintained in accordance with Miracle's Specifications, -
Installation Instructions and Safety Requirements (set out in this Brochure, Brochure 200, Brochure 300,
Preventative Maintenance For Safety Sake, catalog safely tips, information and illustrations and CPSC
Handbook). For specific step by step instructions on each piece of play equipment see Specification and
Installation supplied with each piece of play equipment. Also, follow the CPSC Handbook on play equipment
spacing, play area separation, supervision and other safety considerations.
INDEMNITY
Purchaser agrees to assemble, install, inspect and maintain the play equipment in accordance with Miracle's
installation specifications and Safety Requirements (set out in Brochure 700, Brochure 200, Brochure 300,
"Preventative Maintenance For Safety Sake, Catalog safety tips, information and illustrations and U.S.
Consumer Product Safety Commission Handbook For Public Playground Safety (CPSC Handbook). Pur-
chaser acknowledges it has complete control over assembly, installation, inspection and maintenance of the
play equipment. Purchaser further agrees to indemnify and hold Miracle harmless and free of any liability for
Purchaser's failure to assemble, install, inspect or maintain the play equipment in full compliance with
Miracle's installation specifications, safety requirements and CPSC Handbook. This indemnity shall cover and
include all Miracle's exposure to liability, judgments, settlements, damages of any kind, including punitive or
exemplary damages, reasonable attorneys fees, expenses and all other costs of defense or claims handling

resulting from Purchaser's failure to comply. This indemnity shall apply regardless of any finding or allegation
concerning Miracle's culpability so long as it is alleged or found that an accident was caused in whole or part

1. Scope
1.1 This consumer safety performance specification provides safety and performance standards for
various types of public playground equipment. Its purpose is to reduce life- threatening and debilitating
injuries. - '
1.2 The range of users encompassed by this consumer safety performance specification is the 5th
percentile 2 year -old to the 95th percentile 12 year -old.
1.3 Home playground equipment, amusement park equipment, sports equipment, fitness equipment
intended for users over the age of 12, and soft contained play equipment are not included in this
specification.
1.4 The values stated in inch -pound units are to be regarded as standard. The values given in parentheses
are for information only.

In 1981, the U.S. Consumer Product Safety Commission issued the first set of -voluntary- Federal Guidelines. in the publication
Handbook For Public PlaygrouncrSa&V.. As purpose was to help make public playgrounds safer for children ages 5 -12 years.
Volume I covereo general guidelines for new and existing playgrounds, and was Intended for end users: Me general public,

Under the Americans with
Disabilities Act (ADA), the
Access Board recently
published guidelines for play
areas. The highlights will be
presented here. The proposed
guidelines would add a new
chapter (section 16) on play
areas to the ADA
Accessibility Guidelines
(ADAAG). This chapter would
address only those play
areas that are newly built or
altered.
5everal defined terms are
key to understanding the
guidelines. They include, "play
comporents," which are
manufactured or natural
elements used for play,
socialization or learning. Two
types of play components are
distinguished: "ground - level"
and "elevated.'•
Ground -level play
components are those
approached and exiud at
ground level, such as spring
riders, swings, free - standing
slides and stand -alone
climbers. Elevated play
components are approached
above or below grade, and are
part of composite structures
that provide a variety of play
activities.

'Age appropriate' labels should be placed on a deck post at or near the deck access points (stairs,
ramps, transfer points, ladders, etc.). Each label should be positioned so it is readable by a person
entering onto the deck.
The appropriate age range of a playsystem is based on information provided by the CPSC Playground
Safety Handbook, ASTM F1487 Playground Safety Standard and the professional judgement of
Miracle Recreation Equipment Company.
Additional labels may be obtained by contacting Miracle Recreation or by contacting your Miracle Sales
Representative.
APPLICATION OF AGE APPROPRIATE LABELS
Prepare surface; remove any dust, oil or grime from the label location area on the post. Ensure the
area is dry. When area is both clean and dry, carefully peel off label from paper backing and place on
post so that it is flush and flat to the plane of the post with no wrinkles or tears.
REPLACEMENT OF AGE APPROPRIATE LABELS
If label should become illegible, torn or is removed it is necessary for the owner to replace the label.

PLAYGROUND SAFETY SURFACING
STATEMENT OF WARRANTY
JANUARY 1, 1997
OWNER:
GENERAL

DATE OF COMPLETION:
Spectraturf. Inc. (STI) hereby warrants that the Playground Safety
Surfacing System Installed on the above stated project conforms to the Specification Requirements as stated in the
complete Bid Documentation.
STI further warrants that the system installed will not be defective in terms of materials and workmanship for a
minimum period of FIVE YEARS from the above stated date of completion.
The FIVE YEAR warranty provides for 100% coverage in terms of cost for repairs during the initial year of use by the
OWNER and is prorated coverage for repairs over the balance of years two (2) through five (5) of use by the OWNER.
Prorated is further defined as follows:
Year Y.1- 100% coverage for cost of repairs
Year K2- 80% coverage for cost of repairs
Year C3- 60% coverage for cost of repairs
Year f3- 40% coverage for cost of repairs
Year N5- 20% coverage for cost of repairs
WARRANTY CLAIM REMEDY:
Warranty coverage begins with the date of FIRST USE by the OWNER and is contingent upon
receipt of full payment of the original contract value. Warranty coverage will be voided unless
full payment is received by STI within 90 days of FIRST USE by the OWNER
'Upon FIRST kOTICE of a suspected warranty claim defect. the OWNER shall notify, in written format, STI advising in
detail the suspected area of defect, the date of FIRST NOTICE of the suspected defect, and a request for a WARRANTY
CLAIM inspection. The OWNER is limited to
thirty (30) days from date of FIRST NOTICE of a suspected defect to advise STI and request action. NOTICE SENT LATER
THAN 30 DAYS FROM DATE OF FIRST NOTICE OF SUSPECTED DEFECT SHALL VOID THE WARRANTY AND
SUBSEQUENT WARRANTY CLAIMS IN THEIR ENTIRETY.
Upon proper receipt of request for a warranty claim inspection, STI shall respond, in wr. men form at, within 30 days and
ccnfirm a meeting with the OWNER at the site of the installation on a date to be determined.
Upon completion of inspection, STI will determine the cause of the suspected defect and make recommendations for
the proper method(s) of repair and itemized cost for same.
Upon agrae.ment with the OWNER„ the necessary repairs will be completed and the cost for same paid by the
responsible parties per the prorated schedule above and further definitions contained in this Statement of Warranty.
Any repair wore completed is limited in warranty coverage to the original date of installation of the system and does
not extend the original time of warranty coverage.
OPTIONAL WARRANTY COVERAGE:
STI, at its' so'- discretion, may elect to extend additional warranty coverage per warranty, requirements and project
specifications c' a particular project. NO REPRESENTATIVE OF SPECTRATURF, INC SHALL BE AUTHORIZED TO MAKE
ANY CHAP::= OR ASSUMPTION OF ADDITIONAL WARRANTY COVERAGE UNLESS A WP.ITTEN ADDENDUM IS
ATTACH --O AND MADE A PART OF THIS WARRANTY AT THE TIME OF BID AND AWARD OF CONTRACT.
OWNER AGREES THAT THIS STATEMENT OF WARRANTY IS EXCLUSIVE TO THE ORIGINAL OWNER AND IS IN LIEU OF
ALL OTHER `AARRANTIES, EXPRESSED OR IMPLIED, INCLUDING MERCHANTABILITY AND OF FITNESS FOR A
PARTICULAR, PURPOSE. OWNER FURTHER AGREES THAT IN NO EVENT SHALL STI, ON ANY CLAIM OF ANY KIND,
HAVE ANY LIAEILITY TO OWNER FOR LOSS OF USE, LOSS OF PROFITS, OR FOR ANY INDIRECT, INCIDENTIAL, OR
CONSEQUENTIAL DAMAGES.
