Dear Mr. Narang,
The City of Seal Beach will hold a public hearing on September 24, 2001 at 7:00 p.m. to
consider an increase in street sweeping fees and services. As your organization contracts with
the City for its internal service as well as pays a general fee for its contribution to the overall City
program, we are notifying you of the upcoming meeting in the event that you may wish to
participate in the hearing process.
The hearing for street sweeping does not pertain to the hourly rate that Leisure World pays for
its internal street sweeping service. This is a negotiated contract between the City and Leisure
Word. Since our sweeper is at the end of its useful life and to provide more cost effective
service, the City plans, upon council approval, to contract out its in -house street sweeping
program instead of purchasing a new sweeper. Leisure World will have an option of having its
streets swept under the City's contract. Once negotiations with the contractor are completed,
Seal Beach Public Works Director Doug Dancs, will contact you regarding your internal service.
Monday's hearing will deal with the City's overall street sweeping. program. Currently, the City
sweeps most of its streets bi- monthly. Based on water quality concerns, the City is considering
sweeping all City owned streets weekly. Our records indicate that Leisure Word has not been
charged in accordance with the original ordinance and resolution. Instead of $65 per month as
originally designated, Leisure Word was charged $.50 per meter.
We know there is some complexity involving these multiple issues. For more information

IN CONNECTION WITH
CITY OF SEAL BEACH
PROPOSED STREET SWEEPING RATE INCREASE
NOTICE IS HEREBY GIVEN that the City Council of the City of Seal Beach proposes to adopt a resolution
approving an increase in the monthly street sweeping fees commenting with fiscal year 2001-02 and ordering the proposed
increase be submitted to a vote of the affected property owners. The street sweeping fees are levied pursuant to Chapter 22A of
Seal Beach Municipal Cade to pay for the drect costs of services furnished by the City. The City currently provides street
sweeping serrices on an every other week schedule. Based on concerns over water quality issues, the City intends to provide
weekly street sweeping services. The proposed increase is necessary to pay for increased street sweeping services to be
provided. The street sweeping fees charged to each property owner are based on the land use of a parcel. The current and
proposed formula for calculating the street sweeping charges by land use are set forth in Table A. The current amount levied
against each parcel and the proposed increase for fiscal year 2001 -2002 are set forth in Table B. In subsequent fiscal years, the
amount of the street sweeping fees may be increased automatically by the annual increase in the Consumer Price Index for all
Urban Consumers for the Los Angeles- Anaheim - Riverside Area, not to exceed seven percent per year.

BEACH, CALIFORNIA, RULING ON OBJECTIONS, DECLARING ITS
CONSENT TO A PROPOSED INCREASE IN STREET SWEEPING FEES,
AND ORDERING SUBMITTAL OF A MEASURE AUTHORIZING THE

WHEREAS, the City Council of V City of Seal Beach, Cali rnia, previously adopted
Ordinance Numb 273 adding Chapter 22A to a Seal Beach Municipal Code;
and,
WHEREAS, Chapter 22A a orizes the City Council to esta lish and fix charges and fees for
community se ices such as street sweeping;
WHEREAS, based on the au ority provided by Chapter 2 ,the City Council previously
adopted Resolu n Number 3788 establishi monthly charges for street
sweeping and tre 'coming services in the ity; and,
WHEREAS, the City currently pro 'des street sweepin services on an every-other -week
schedule; and,
WHEREAS, the street sweeping fees collecte t to Resolution Number 3788 are
intended to pay for the direct costs o ices famished by the City; and,

WHEREAS, due to concerns over water quality issues, the City intends to increase its services
to provide street sweeping services on a weekly basis; and,
WHEREAS, on August 9, 2001, and August 10, 2001, notice of the proposed increase in street
sweeping fees and of the time and place of the public hearing was mailed to each
owner of record of certain parcels of land in the City in accordance with the

provisions of Article XIIID of the California Constitution and the Seal Beach
Municipal Code; and,
WHEREAS, notice of the proposed increase in street sweeping fees and of the time and place
of the public hearing was published as required by law on August 23, 2001, and
August 30,2001; and,
WHEREAS, on September 24, 2001, at the time and place set forth in the notice, the City
Council conducted a hearing on the proposed increase in street sweeping fees and
heard and considered all objections and protests thereto; and
WHEREAS, at the public hearing held on September 24, 2001, written protest by a majority of
the landowners was not presented.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES
HEREBY DETERMINE, RESOLVE AND ORDER AS FOLLOWS:
Section 1. All of the foregoing recitals are true and correct.
Section 2. The charges proposed in Sections 4 and 5, below, do not exceed
the reasonable cost of providing street sweeping services and of making such services available.
Section 3. The Surfside Colony does not receive street sweeping services
from the City and is, therefore, exempt from the fees set forth in Sections 4 and 5, below.
Section 4. Except as provided in Section 5, below, the City Council hereby
consents to the following proposed fee schedule for street sweeping charges in the City of Seal
Beach effective on the first day of 200:
(a) Single Family Dwelling $1.46 per dwelling per month
(b) Multiple Residential Dwelling $0.88 per dwelling unit per month
(c) Non - Residential Property $1.46 per water meter per month
Section 5. 5.1 The following uses shall pay a fee of one - dollar forty-six
cents ($1.46) per water meter per month for street sweeping services or three cents ($0.03) per
lineal footage of public street or highway frontage served by the City street sweeper, whichever
is greater:
(a) Commercial and/or office centers zoned CO, Cl, or C2 with a minimum total lot
size of 3.5 acres;
(b) Manufacturing uses;
(c) Bixby Old Ranch Country Club;
(d) Public and institutional uses;
(e) Vacant properties with a minimum total lot size of 2.5 acres.

5.2 The Seal Beach Trailer Park shall pay a fee of three cents ($0.03)
per lineal footage of public street or highway frontage served by the City street sweeper.
5.3 Multiple family projects in excess of sixty (60) units shall pay a
fee of fifty -two dollars and fifty -six cents ($52.56) per month for street sweeping services
or three cents ($0.03) per lineal footage of public street or highway frontage served by
the City street sweeper
5.4 The Surfside Colony shall be exempt from the above fees.
Section 6. In accordance with the provisions of Section 6 of Article XIIID of
the California Constitution, the City Council hereby orders that the proposed fees set forth in
Sections 4 and 5, above, be and the following measure be submitted to a vote of the qualified
landowners of certain parcels of land in the City of Seal Beach:

SUBJECT: Tree trimming /street sweeping resolution /Public Hearing
RECOMMENDATION
Upon conclusion of the Public Hearing the staff recommends that the City
Council adopt the proposed resolution (copy attached) establishing tree
trimming and street sweeping charges.
BACKGROUND
to Te City Council meeting of May 2, 1988, Ordinance NO.1273 was given
its second reading and adopted, adding Chapter 22A to the Seal Beach City
Code. This chapter provides for Community Service Fees such as tree-
trimming and street sweeping, which may be set by City Council resolution
after a public hearing has been held.
It is estimated that new revenue to the City's General Fund will be created
by these two fees of $70,000 annually, defraying 90% of the 1988 -39 budget
for tree - trimming and street sweeping.
DISCUSSION
T e7ution as proposed, sets monthly fees for residential property as
follows:
SINGLE MULTIPLE
DWELLING DWELLING
Tree - trimming cents 0 cents
Street Sweeping 50 cents .30 cents
Residential projects with more than 60 units pay a flat monthly fee of $54
or 3 cents per lineal foot of street served by the City, whichever is greater.
Leisure World with approximately 6400 units and 6500 feet of City street
served by only the street sweeper would pay an estimated $65 monthly (6500 x 1¢).
Surfside incurs no fee as it receives no service covered by the resolution.
Finally, it is proposed that non - residential property (including, manufacturing,
commercial and office centers at least 3.5 acres, and vacant properties at
least 2.5 acres) shall pay 50¢ per water meter per month for each type of
service received, or one cent per foot for street sweeping and two cents per
foot for tree trimming, whichever is greater. For example Bixby Old Ranch
Country Club with approximately 9,500 feet of City street served only by the
sweeper would pay an estimated $95 monthly, (9500 x 1 cent).

Dear Mr. Thomas:

We have reviewed the revised ordinance and resolution
providing for the establishment of "community services fees"
which you sent to us this week. Enclosed please find our
suggested revisions to the resolution establishing charges
for tree trimming and street sweeping services.
As we discussed, the ordinance authorizing the
City Council to impose community services fees on residents
and property owners of the City for public services provided
by the City must not be passed within five days of its introduction.
Therefore, the enclosed ordinance may be introduced at the
Council meeting on April 18, 1988 and the ordinance may
then be passed at the Council meeting on May 2, 1988. An
ordinance becomes effective 30 days after its passage.
Therefore, if the ordinance is passed on May 2, 1988, it
will become effective on June 1, 1988.
Within 15 days after passage of the ordinance,
in the Seal Beach Journal the City Clerk must cause the
ordinance to be published at least once with the names of
those City Council members voting for and against the ordinance.
Alternatively, the City Council may publish a summary of
the proposed ordinance which is prepared by an official
designated by the City Council. In such case, the summary
must be published and a certified copy of the full text
of the proposed ordinance must be posted in the office of

the City Clerk at least five days prior to the City Council
meeting at which the proposed ordinance is to be adopted.
Then, within 15 days after adoption of the ordinance, the
City Council must publish a summary of the ordinance with
the names of those City Council members voting for or against
the ordinance and the City Clerk must post in the office
of the City Clerk a certifeid copy of the full text of the
adopted ordinance together with the names of those City
Council members voting for or against the ordinance.
The City Council may not adopt the enclosed resolution
establishing fees until the ordinance authorizing the imposition
of community services fees becomes effective. Prior to
adopting the enclosed resoltion, the City Council must hold
a public hearing, at which oral or writtten protest can
be made, as part of a regularly scheduled meeting. Notice
of the time and place of the meeting, including a general
explanation of the subject matter of the resolution, must
be published two times with at least five days intervening
between the dates of the first and last publication, not
counting the publication dates. The period of notice commences
on the first day of publication and terminates at the end
of the tenth day, including therein the first day. Although
the ordinance will not become effective prior to June 1,
1988, the public hearing may be scheduled for the Council
meeting on June 6, 1988 and notice of the public hearing
may also be published prior to June 1, 1988. In such case,
notice of the public hearing should be published in the
Seal Beach Journal on Thursday May 26, 1988 and on Thursday,
June 2, 1988.

SUBJECT: Implementation of Tree Trimming & Street
Sweeping fees
INTRODUCTION
Imposition of Tree trimming and Street sweeping fees was approved
in concept by adoption of the 1987 -88 City budget.
Implementation of those fees can now be accomplished by (a)
enactment of the proposed ordinance and (b) adoption of the
proposed resolution, copies of which are attached for your
consideration. Approval of these enabling documents by the City
Council should result in new revenue to the City's General Fund
of an estimated $70,000 per year. Tree trimming expense for
1988 -89 is estimated at $48,940; street sweeping at $77,320.
PROPOSED ORDINANCE
The proposed ordinance adds Chapter 22A to the City Code and
provides for Community Services Fees to be charged to residents
and property owners of the City for any type of public service
including, but not limited to, tree trimming and street sweeping.
PROPOSED RESOLUTION
The resolution sets monthly fees for tree trimming and street
sweeping at $1 for single family dwellings and sixty cents for
each multiple family dwelling unit, to be collected by means of
the existing water billing system.
Multiple family projects in excess of sixty units would pay $54 a
month for combined services received or a penny per foot for
street sweeping and two pennies per foot for tree trimming
service received, whichever is greater. For example, an
apartment building with 61 units (or more) receiving both tree
trimming and street sweeping would pay $36 monthly unless lineal
footage served exceeded 1800 ($36 divided by 2 cents), in which
case it would pay the lineal foot rate of 2 cents for tree
trimming. In addition, if over 1800 feet ($18 divided by 1 cent)
it would also pay the lineal foot rate for street sweeping of 1
cent per foot. Leisure World with approximately 6400 dwelling
units and 6500 feet of City street served by the sweeper service
but not by tree trimming would pay an estimated $65 monthly (6500
lineal feet times 1 cent).
Non - residential properties incur a monthly fee of one cent for
street sweeping and two cents for tree trimming for each lineal
foot served by the City with a minimum of one dollar. Section 3
of the resolution lists a miscellany of uses and properties
subject to similar fees, including vacant properties over 2.5
acres. Surfside incurs no fee as it receives no service covered
by the resolution.
RECOMMENDATION
The Staff recommends that the City Council (a) give first reading
to the proposed Ordinance providing for Community Services Fees,
and (b) hold a public hearing prior to adoption of the proposed
Resolution setting fees for Tree Trimming and Street Sweeping
Services.

the institution of fees to offset the City's coat for the
provision of street sweeping and tree trimming services. It was
proposed to institute a $0.50 per month per water meter charge
for street sweeping and a $0.50 /month per water meter charge for
tree trimming. The implementation of these fees will bring in
approximately $60,000 annually.
That the City Council adopt the attached resolutions establishing
fees for street sweeping and tree trimming services.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SEAL BEACH, CALIFORNIA, ESTABLISHING FIXED
FEES AND CHARGES FOR COMMUNITY SERVICES
INCLUDING TREE TRIMMING AND STREET SWEEPING
SERVICES
THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY RESOLVES:
WHEREAS, Chapter 22A of the Code of the City of Seal Beach,
California, authorizes the City Council of the City of
Seal Beach to establish and fix charges and fees for
community services such as tree trimming and street
sweeping services; and
WHEREAS, the City Council hereby finds and determines that the
charges and fees as hereinafter set forth do not exceed
the reasonable cost of providing tree trimming and
street sweeping services and of making such services
available; and
WHEREAS, the City Council hereby finds and determines that the
Surfside Colony receives neither tree trimming nor
street sweeping services from the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH HEREBY
FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS:
Section 1. Except as provided in Section 3, below, the City
Council hereby adopts the following fee schedule
for tree trimming charges in the City of Seal
Beach effective on the first day of pi/g��,
1988:
(i) Single Family Dwelling Fifty Cents ($0.50) Per Month
(ii) Multiple Residential Dwelling
(iii) Non - Residential Property
Thirty Cents ($0.30) Per
Dwelling Unit Per Month
Fifty Cents ($0.50) Per Water
Meter Per Month
Section 2. Except as provided in Section 3, below, the City Council
hereby adopts the following fee schedule for street
sweeping charges in the City of Seal Beach effective on
the first day of rTL'51 , 1988:
(i) Single Family Dwelling Fifty Cents ($0.50) Per Month
(11) Multiple Residential Dwelling Thirty Cents ($0.30) Per
Dwelling Unit Per Month
(iii) Non- Residential Property Fifty Cents ($0.50) Per Water

Section 3. (A) The following uses shall pay a fee of fifty cents
($0.50) per water meter per month for tree trimming and
fifty cents ($0.50) per water meter per month for street
sweeping, or one cent ($0.01) per month per lineal
footage of public street or highway frontage served by
the City street sweeper and two cents ($0.02) per month
per lineal footage of public street or highway frontage
served by the City for tree trimming, whichever is
greater:
(i) Commercial and /or office centers zoned CO, Cl, or
C2 with a minimum of 3.5 acres;
(ii) Manufacturing uses;
(iii)Bixby Old Ranch Country Club;
(iv) Public and institutional uses;
(v) Vacant properties with a minimum total lot size of
2.5 acres

The Seal Beach Trailer Park shall pay a fee of one cent
($0.01) per month per lineal footage of public street or
highway frontage served by the City stret sweeper and
two cents ($0.02) per month per lineal footage of public
street or highway frontage served by the City for tree
trimming.
(C) Multiple family projects in excess of sixty (60)
units shall pay a fee of $36.00 per month for tree
trimming and $18.00 per month for street sweeping
or one cent ($0.01) per month per lineal footage of
public street or highway frontage served by the
City street sweeper and two cents ($0.02) per month
per lineal footage of public street or highway
frotage served by the City for tree trimming,
whichever is greater.
(D) The Surfside Colony shall be exempt from the above
fees.
Section 4. For each property or premises not receiving water
service from the City, the charges for tree trimming and
street sweeping services as determined by the fees set
forth in Sections 1, 2 and 3 of this Resolution shall be
due and payable annually on or before the first day of
July.
