SUBJECT: RESCISSION OF PROCLAMATION OF LOCAL
EMERGENCY PROJECTS EM1503, EM1602, EM1603
AND EM1701 '
SUMMARY OF REQUEST:
That the City Council adopt Resolution No. 6755:
1. Rescinding the proclamation of a local emergency declared by the City
Council on June 22, 2015 pursuant to Resolution No. 6573, for emergency
repairs of the Hellman Ranch Water Main Break, Project No. EM1503;
and,
2. Rescinding the proclamation of a local emergency declared by the City
Council on May 23, 2016 pursuant to Resolution No. 6649, relating to the
Pier Fire, Project No. EM 1602; and,
3. Rescinding the proclamation of a local emergency declared by the City
Council on June 27, 2016, pursuant to Resolution No. 6662, relating to
damage to the Seal Beach Tennis Center; Project No. EM 1603; and,
4. Rescinding the proclamation of a local emergency declared by City
Council on January 17, 2017 pursuant to Resolution No. 6708, as revised
by Resolution No. 6735, for the West End Pump Station, Project No.
EM1701.
BACKGROUND AND ANALYSIS:
Hellman Ranch Water Main Break
On May 25, 2015, a water main break occurred on the Los Cerritos Wetlands
Authority property. The break occurred in an 18 -inch pipeline approximately 800
feet from the intersection of 1 st Street and Pacific Coast Highway, adjacent to the
Hellman Ranch Property. The City has a 10 foot wide easement in which the
water line is located.

Staff responded to the break and closed the valves near the break to stop water
from escaping from the water line. At that time, the City applied for an
emergency permit from the California Coastal Commission ( "Coastal ") and
declared an emergency at the June 22, 2015 City Council meeting pursuant to
Resolution No. 6573, to allow for a contractor to repair the water line immediately
and place this critical water facility back online as soon as possible. Without this
line in operation, there was only one means of flow for water from the northern
parts of the City and the southern areas.
An emergency permit was issued by Coastal on November 18, 2015 and a
contractor made the necessary repairs immediately afterwards. On
December 10, 2015 the water line was placed back in service. The emergency
permit required that the City apply for a full Coastal permit after the repairs were
completed for full site restoration. The City has received the permit and is in the
process of scheduling the restoration work.
Pier Fire
A major fire on the Seal Beach Pier occurred on May 20, 2016. The fire caused
damage to the Ruby's Restaurant building, the old bait shop, the adjacent trash
enclosure, utility lines and structures, and parts of the structural supports at the
end of the pier, along with sections of decking. Due to the nature of the fire
damage above the pier and the instability of the damages that occurred below
the decking, the City declared an emergency at the City Council meeting on May
23, 2016, pursuant to Resolution No. 6649.
Demo contractors were hired to remove the charred remains of the above
surface structures as well as below surface support members that were
damaged. Destroyed utility lines, the pier sewer pump station and the existing
Southern California Edison transformer were all removed from the pier. After
most of the damaged parts of the pier were removed, contractors added new
stringers and sections to the bents in order to secure the pier in place before final
structural improvements can be designed, permitted and constructed. Staff has
been working with the Coastal Commission in securing a coastal development
permit to perform the permanent work.
Seal Beach Tennis Center
On June 3, 2016, staff was closed the workout room at the Seal Beach Tennis
Center due to concerns over the flat roof showing signs of deflection and
distress. Also, it was identified that the locker room area showed signs of wood
rot and damage from termites in the atrium area. On June 27, 2016, the City
Council approved Resolution No. 6662 approving necessary emergency repairs
in both the workout room area and the locker room area.
Prior to initiating work staff identified a unique opportunity to move the workout
room to the area of the locker room where the atrium previously was located.
The two spaces were the same size and gave the City the opportunity to utilize
the old workout area in new ways that would allow the City to better utilize the
space for the public.

West End Pump Station
At the end of December 2016 during a rain event, one of the large storm water
pumps at West End Pump Station registered a failure notification. Shortly
thereafter, during a rain event in January 2017, the second large storm water
pump at West End Pump Station registered a failure notification as well. With
both pumps non - operational and with rain forecasted, the City Council declared
an emergency on January 17, 2017 at a special City Council meeting, pursuant
to Resolution No. 6708.
A pump repair contractor was hired to remove the pumps and transport them to
the manufacturer for repairs. In addition, temporary pumps were ordered while
the permanent pumps were offsite for repairs. The pumps were repaired,
returned, tested and put back into operation in February 2017. Subsequently, an
audit was completed to determine the cause of the failures as well as
maintenance strategies moving forward to reduce the potential of future
emergencies at the West End Pump Station. The budget category was
subsequently revised by adoption of Resolution No. 6735 on May 22, 2017.
In summary, all work associated with each of these emergency projects is
complete. While there is still work to be done at all three locations, the work that
remains at each site is not of urgent necessity for the preservation of life, health,
and property and can be accomplished under normal permitting and contracting
procedures.
ENVIRONMENTAL IMPACT:
These projects were all exempt under the California Environmental Quality Act
(CEQA).
LEGAL ANALYSIS:
The City Attorney has reviewed and approved it as to form.
FINANCIAL IMPACT:
Expenditures from each project are shown below:

The funds budgeted were sufficient to complete the emergency portion of the
work on the projects. Future work will be budgeted accordingly.
RECOMMENDATION:
That the City Council adopt Resolution No. 6755:
1. Rescission of proclamation of a local emergency declared by the City
Council on June 22, 2015 pursuant to Resolution No. 6573 for emergency
repairs of the Hellman Ranch Water Main Break, Project No. EM1503;
and,
2. Rescission of proclamation of a local emergency declared by the City
Council on May 23, 2016 pursuant to Resolution No. 6649, relating to the
Pier Fire, Project No. EM1602; and,
3. Rescission of a proclamation of a local emergency declared by the City
Council on June 27, 2016, relating to the Seal Beach Tennis Center,
Project No. EM1603; and.
4. Rescission of a proclamation of a local emergency declared by the City
Council on January 17, 2017 for the West End Pump Station, Project No.
EM 1701.

RESCINDING THE PROCLAMATIONS OF LOCAL
EMERGENCIES PREVIOUSLY ADOPTED BY THE CITY
COUNCIL FOR THE HELLMAN RANCH WATER MAIN BREAK
PROJECT NO. EM1503, THE PIER FIRE PROJECT NO. EM1602,
THE SEAL BEACH TENNIS CENTER NO. EM1603, AND THE
WEST END PUMP STATION PROJECT NO. EM1701, AND
RESCINDING RESOLUTION NOS. 6573, 6662, 6649, 6708, AND
6735
WHEREAS, conditions of disaster or of extreme peril to the safety of persons
and property had arisen within the City, caused by a water main break within the
Hellman Ranch property on May 25, 2015;
WHEREAS, on June 22, 2015, pursuant to Resolution No. 6573, the City Council
declared a local emergency;
WHEREAS, conditions of disaster or of extreme peril to the safety of persons
and property had arisen within the City, caused by a fire on the Seal Beach
Municipal Pier on May 20, 2016;
WHEREAS, on May 23, 2016, pursuant to Resolution No. 6649, the City Council
declared a local emergency;
WHEREAS, conditions of disaster or of extreme peril to the safety of persons
and property had arisen within the City, causing damage to the Seal Beach
Tennis Center resulting in closure of the facility on June 3, 2016;
WHEREAS, on June 27, 2016, pursuant to Resolution No. 6662, the City Council
declared a local emergency;
WHEREAS, conditions of disaster or of extreme peril to the safety of persons
and property had arisen within the City, caused by failures of both storm water
pumps at West End Pump Station on or about December 22, 2016 and January
4, 2017; and
WHEREAS, on January 17, 2016, pursuant to Resolution No. 6708, the City
Council declared a local emergency, as subsequently revised on May 22, 2017
by Resolution No. 6735; and
WHEREAS, it is considered best practice to rescind proclamations of local
emergency when the emergency conditions have been relieved and emergency
authority is no longer needed.
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
Section 1. The City Council hereby rescinds the proclamation of a local
emergency for the Hellman Ranch water line break, as declared on
June 22, 2015, and rescinds Resolution No. 6573.
Section 2. The City Council hereby rescinds the proclamation of a local
emergency for the Pier Fire, as declared on May 23, 2016, and
rescinds Resolution No. 6649.
Section 3. The City Council hereby rescinds the proclamation of a local
emergency for the Tennis Center, as declared on June 27, 2016,
and rescinds Resolution No. 6662.
Section 4. The City Council hereby
