SUBJECT: NOTICE OF COMPLETION FOR 7T" STREET ALLEY
WATERLINE AND SEWER REPLACEMENT PROJECT
CIP NO. WT1607
SUMMARY OF REQUEST:
That the City Council adopt Resolution No. 6757:
1. Accepting the 7th Street Alley Waterline and Sewer Replacement Project
CIP No. WT1607 by Cedro Construction, Inc. in the amount of
$477,626.45; and,
2. Direct the City Clerk to file a "Notice of Completion" with the Orange
County Clerk - Recorder within ten (10) days from the date of acceptance
and to release retention in the amount of $47,762.65 35 days following the
filing of the Notice of Completion.
BACKGROUND AND ANALYSIS:
At the July 25, 2016, City Council meeting, the City Council awarded a public
works agreement to Cedro Construction, Inc. (Contractor) for the 7th Street Alley
Waterline and Sewer Replacement Project CIP No. WT1607 (Project) in the
amount of $401,658.50.
At the January 9, 2017, City Council meeting, the City Council authorized
Amendment No. 1, amending the public works agreement with the Contractor for
an additional contingency with a total contract amount not to exceed
$495,658.50.
The Project, located north of Electric Avenue to Pacific Coast Highway, consisted
of replacing the sewer and waterline with 8 -inch pipes and the rehabilitation of
the alley pavement with a new concrete surface. During the course of
construction, several unforeseen conditions were encountered by the Contractor
that resulted in construction change orders. The City negotiated construction

change orders with the Contractor and accrued a credit due to additional delays
caused by the Contractor.
The Project is now complete to the satisfaction of the Deputy Director of Public
Works /City Engineer. The Project was inspected and it meets all standards and
requirements within the Project specifications. It is requested to formally accept
the Project and file a notice of completion with the Orange County Clerk -
Recorder.
ENVIRONMENTAL IMPACT:
This Project complies with all requirements of the California Environmental
Quality Act (CEQA) and is categorically exempt under section 15301 class 1
subsection (b) of the CEQA Guidelines.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
FINANCIAL IMPACT:
The approved FY 2016/17 Budget identified $470,000 of Water and Sewer
Capital Funds for construction of the Project. At the January 9, 2017, City
Council meeting, the City Council approved an $85,000 budget amendment from
Water and Sewer Capital Funds for a total Project budget of $555,000.00. The
table below presents the breakdown of expenses for the Project:

The total amount paid to Cedro Construction, Inc. for construction and change
orders is $477,626.45.

RECOMMENDATION:
That the City Council adopt Resolution No. 6757:

WT1607 AND DIRECTING THE FILING OF A NOTICE OF
COMPLETION FOR THE PROJECT
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE:
Section 1. The City accepts the completion of the 7th Street Alley Waterline and
Sewer Replacement Project CIP No. WT1607 (the 'Project') by Cedro Construction,
Inc. in the amount of $477,626.45 for the work performed.
Section 2. The City Clerk is hereby directed to file a "Notice of Completion" for the
Project with the Orange County Clerk- Recorder within ten (10) days of the date of
this resolution, and to release the retention of $47,762.65 35 days following the filing
of the Notice of Completion.
