AGENDA REPORT
DATE:
June 11, 2001
TO:
Honorable Mayor and City Council
THRU:
John B. Bahorski, City Manager
FROM:
Doug A. Dancs, P.E., Interim Director of Public Works
SUBJECT:
AUTHORIZATION DIRECTOR OF PUBLIC WORKS
TO EXECUTE "NO RIGHT OF WAY
CERTIFICATIONS"
SUMMARY OF REOUEST:
The proposed City Council action will authorize the Director of Public Works to execute
"No Right of Way Certifications" for federally funded projects.
BACKGROUND:
The "Local Agency — Agreement for federal -aid projects" Master Agreement No. 12-
5229 approved in January 1999 between the City and Caltrans requires the City to certify
right of way as detailed in Chapter 13 "Right of Way" of the Caltrans Local Assistance
Procedures Manual.
The City is not qualified to certify for acquiring new right of way but is qualified to
certify when no right of way needed. For federally funded projects and when no right of
way is needed, a "No Right of Way Certification" form is to be used. The document is to
be executed by a City official who is authorized by the City Council to execute such
document.
FISCAL IMPACT:
No fiscal impact.
RECOMMENDATION:
Staff recommends that the City Council adopt Resolution No. which authorizes
the Director of Public Works to execute "No Right of Way Certifications ".
