My office is located at 2 Venture, Suite 450, Irvine, California, 92618. On behalf of The Coalition Against LA Fitness, I express my opposition to the pending proposal by CPT Shops @ Rossmoor, LLC to develop a 37,000 square foot fitness club at The Shops at Rossmoor Shopping Center ( "Shopping Center ") located at 12411 Seal Beach Boulevard, Seal Beach, California. The two matters before you are the conditional use permit ( "CUP ") and the environmental impact report ( "EIR "). Based on the information that has been presented to you and that will be presented to you prior to the time that you vote on these two matters, I respectfully suggest that you must vote "No" on both the CUP and the EIR. In the EIR, in section 9.0, entitled Responses to Comments on DEIR, there are opposition comments presented by more than 220 people. The vast majority of these comments are from residents of the community affected. Most of the comments express concerns relating to traffic and transportation. On this subject, the EIR states that there are no significant environmental effects. Section 4.4 -10. Are 220 of your residents wrong? I don't think so. September 6, 2017 Page 2 Equally important is the fact that no one other than the developer expressed an opinion in support of this project. Why does no one support this project? The EIR states that the only significant environmental impact of the project that requires mitigation is noise from the HVAC and temporary construction noise. Section 5.1. The EIR could not be more wrong in its analysis. THE APPLICATION FOR THE CONDITIONAL USE PERMIT SHOULD BE DENIED A. WHAT IS A CUP? "A conditional use permit is administrative permission for uses not allowed as a matter of right in a zone, but subject to approval." Sounhein v. City of San Dimas (1996) 47 CA.4th 1181, 1187 The point here is that a CUP is a discretionary permit. The City has a choice to decide whether or not it should be issued under the circumstances of this case. B. UNDER WHAT CIRCUMSTANCES SHOULD A CUP BE GRANTED? "A conditional use permit may be permitted if it is shown that its use is essential or desirable to the public convenience and welfare and at the same time that it will not impair the integrity and character of the zoned district. It must also be shown that it is not detrimental to public health, public morals, or public welfare." Tustin Heights Association v. Board of Supervisors of County of Orange (1959) 170 CA.2nd 619, 626 "It is appropriate and even necessary for the [local agency] to consider the interest of neighboring property owners in reaching a decision..., and the opinions of neighbors may constitute substantial evidence on this issue." Harris v. City of Costa Mesa (1994) 25 CA 4th 963, 973, quoting Desmond v. County of Contra Costa (1993) 21 CA.4th 330, 337 In Saad v. City of Berkeley (1994) 24 CA. 4th 1206, the court upheld the denial of a CUP for one single family residence because of the detrimental effect on nearby residential neighbors. After an extended hearing, based on the opinions expressed by over 220 neighbors concerning traffic, parking and other matters, the Planning Commission denied the conditional use permit. There is insufficient evidence presented supporting the findings necessary for the City to issue a CUP, and the City Council should affirm the decision of its Planning Commission. II. THE EIR IS INADEQUATE AND SHOULD THEREFORE BE DENIED. A. WHAT IS REQUIRED FOR AN ADEQUATE EIR? An EIR must set forth the basis for its conclusion; a bare conclusion without an explanation of its factual and analytical basis is not a sufficient analysis of an September 6, 2017 Page 3 environmental impact. Laurel Heights Improvement Association v. Regents of the University of California (1988) 47 Cad 376, 404. If an EIR concludes that particular environmental impacts are not significant, it should explain the basis for that conclusion. Protect the Historic Amador Waterways v. Amador Water Agency (2004) 116 CA.4th 1099, 1111; San Joaquin Raptor /Wildlife Rescue Center v. County of Stanislas (1994) 27 CA 4th 713. The EIR in this case is woefully inadequate in explaining why there are no significant environmental effects for traffic, transportation and other issues discussed below. An EIR must propose and describe a reasonable range of alternatives to the project that have the potential to obtain most of the project's basic objectives, but would avoid or substantially lessen the significant environmental effects of the project. Public Resources Code Sections 21002.1 and 21100(b)(4); 14 Cal. Code Regs §15126.6. Project alternatives should include alternative locations as well as alternative designs. 14 Cal. Code Regs § 15126.6. The EIR provides an inadequate description of alternatives to the project, such as relocating the site of the fitness center to another location within the Shopping Center, reducing the size of the fitness center or selecting an alternative location for the fitness center outside the Shopping Center. An EIR must include a "no project" alternative, among the project alternatives, along with a comparative analysis of the impacts. 14 Cal. Code Regs, Section 15126.6 (c). Planning and Conservation League v. Department of Water Resources (2000) 83 CA. 4th 892, 917 (Even if the "no project" alternative will not reduce significant impacts of the project, the "no project" alternative must be discussed and considered.) The description in the EIR of the "no project" alternative is inadequate and unsupported. The EIR's response to comments on the draft EIR must provide a reasonable, good faith analysis. 14 Cal. Code Regs. §15088(b). The response to comments on the draft EIR are generally non - responsive. There is an inadequate analysis provided. The lead agency must not approve the project unless the agency finds, based on substantial evidence in the record, that the project will not have a significant effect on the environment, or the agency finds that all significant environmental effects have been eliminated or substantially reduced to the extent feasible and that any remaining unavoidable significant affects are acceptable due to specific economic, legal, social, technological or other benefits of the project. Public Resources Code Sections 21002, 21002. 1, and 21091; 14 Cal Code Regs. § 15021(a), 15091- 15093. The findings must be based on substantial evidence in the record. 14 Cal. Code Regs 15091(b) September 6, 2017 Page 4 City approval of a home improvement store improperly failed to make feasibility findings on a reduced -size alternative. Preservation Action Council v. City of San Jose (2006) 141 CA 4th 1336, 1355. There is insufficient evidence in the record that the proposed project will have no significant impact on traffic, transportation and the other factors described below.. 1. GREENHOUSE GAS EMISSIONS HAVE NOT BEEN ADEQUATELY CONSIDERED. Greenhouse gas emissions, including transportation, must be properly addressed in an EIR. Public Resource Code §21083.05(b); 14 Cal. Code Regs § 15064.4, 15126.4(c). EIR invalidated for failure to comply with the requirements for greenhouse gas emissions. Communities for Better Environment v. City of Richmond (2010) 184 CA 4th 70; Center for Biological Diversity v. Department of Fish & Wildlife (2016) 62 Cal. 4th 204; Friends of Oroville v. City of Oroville (2013) 219 CA 4th 832, 842. EIR's finding of no significant greenhouse gas emissions impacts was not supported by evidence that project's energy efficiency goal would be reached. Spring Valley Lake Association v. City of Victorville (2016) 284 CA 4th 91, 102 The EIR fails to consider the impact of greenhouse gas emissions from persons driving vehicles to and from the fitness center for one hour workouts all day long, from early morning to late evening, and particularly during rush hour traffic. 2. THE WATER SUPPLY REQUIREMENTS HAVE NOT BEEN ADEQUATELY CONSIDERED. The impact of the project on water supply must be assessed and analyzed. 14 Cal. Code Regs § 15155(b)(1); Water C § 10911(b). National Heritage Project v. County of Stanislaus (1996) 48 CA 4th 182 (EIR rejected- failure to properly analyze the impact of supplying water to the project); See also: Santiago County Water District v. County of Orange (198 1) 118 CA 3d 818; Santa Clarita Org. for .Planning the Enviroment v. County of Los Angeles (2003) 106 CA 4th 715; Preserve Wild Santee v. City of Santee (2012) 210 CA 4th 260 In the EIR, there is no analysis of the fact that persons will be using the swimming pool, the showers and the drinking fountains at the fitness center from early morning to late at night. There is no analysis as to how this water usage will affect the water supply. 3. TRANSPORTATION AND TRAFFIC HAVE NOT BEEN ADEQUATELY CONSIDERED. Public Resources Code 21099 - CEQA Guidelines must be developed for transportation and traffic. Whitman v. Board of Supervisors of Ventura County (1979) 88 CA 3d 39 (EIR insufficient for failure to adequately discuss traffic impacts.) There has been no adequate traffic study prepared that considered the traffic anticipated to be generated by this particular project. The County of Orange took the unusual step of September 6, 2017 Page 5 specifically requesting a traffic study for this project based on actual traffic members for similar facilities nearby. But no such traffic study has been presented for this project. The EIR states that there are no significant environmental impacts of this project for traffic and transportation. Section 4.4 -10. Yet, most of the 220 opposing comments concerned various aspects of traffic and transportation impacts, which I will not restate, but which are incorporated herein. 4. THE IMPACT OF CRIME HAS NOT BEEN ADEQUATELY CONSIDERED. Residents have presented statistical information that fitness clubs are "magnets for crime ", similar to bars. The EIR provides no analysis of crime. The EIR provides no response to this statistical information. 5. THE IMPACT OF PARKING SHORTAGES HAS NOT BEEN ADEQUATELY CONSIDERED. Taxpayers for Accountable School Board Spending v. San Diego Unified School District (2013) 215 CA 4th 1013, 1050 - all environmental impacts that could result from a parking shortage must be evaluated in an EIR. The EIR provides an inadequate discussion of parking shortages. Prior to the current fitness project, nearby community association residents could park in the Shopping Center. However, the residents have been informed by the Shopping Center that in order to allow adequate parking for the fitness center, the residents will no longer be permitted to park in the Shopping Center. This will cause parking problems for the nearby residents. This issue is not properly addressed in the EIR. There has been no parking study for this particular project, considering the parking requirements for the fitness center. 6. THE IMPACT OF VISUAL AND AESTHETIC RESOURCES HAVE NOT BEEN ADEQUATELY CONSIDERED. Visual and aesthetic resources must be considered. Public Resources Code Sections 21000(b) and 21065; Pocket Protectors v. City of Sacramento (2004) 124 CA 4th 903; Ocean View Estates Homeowners Association v. Montecito Water District (2004) 116 CA 4th 396; Quail Botanical Gardens Found., Inc. v. City of Encinitas (1994) 29 CA 4th 1597 The EIR fails to consider the impact of the close proximity of the 600 residential units at the nearby community associations to the proposed fitness center. The residential condominiums are approximately 200 feet from the entrance, 150 feet from the building and 15 feet from the parking lot. This creates issues of noise, crime, parking, visual blight and disturbance. The hours of operation of the fitness center are 5:00 a.m. to 11:00 p.m. Monday through Thursday, 5:00 a.m. to 10:00 p.m. Fridays, and 8:00 a.m. to 9:00 p.m. on Sundays and Saturdays. September 6, 2017 Page 6 7. THE MITIGATION MEASURES ARE INADEQUATE. An EIR must describe mitigation measures for each potentially significant environmental impact that it identifies. Pub Resources Code Sections 21002.1(a) and 21100(b)(3); 14 Cal Code Regs § 15126.4 A mitigation measure may reduce or minimize a significant impact without avoiding the impact entirely. 14 Cal Code Regs 15370(b); Pub Resources Code Sections 21002.1 (a) and 21081(a)(1). EIR is invalid because it fails to "adopt" mitigation measures. Murrieta Valley Unified School Dist. v. County of Riverside (1991) 228 CA 3d 1212, 1234 In the present case, the EIR erroneously concludes that there are no significant environmental impacts for air quality, greenhouse gases or traffic and transportation and therefore is not required to present any mitigation measures or consider any alternatives to address these environmental issues. As youl~aware, there is a movement to build a L.A. Fitness complex alongside our residential area, Rossmoor Regency. For years, our neighborhood and city planners have worked diligently to create green spaces and plant trees and other flora to maintain a healthy and wholesome environment. It is the communities understanding that the construction of the facility would require the removal of twenty or more mature trees that provide a natural, beautiful, and effective barrier from the noise and nuisance factor inherent to this commercial area that is now the Rossmoor Shopping Center. The construction of the Rossmoor Center L.A. Fitness Center will not only adversely affect the lives of those residents that border the facility, but to add insult to injury will have the trees they love destroyed, exposing these same people to more lifestyle abuse emanating from what will be an even more obtrusive commercial activity. Historically, it is important to note that the previous shopping center owner and the Rossmoor Regency Home Owners Association teamed up to jointly finance the installation of the trees. This is what can happen when commercial and residential areas work together and not against one another. Does it make sense to you, as protectors of our community to destroy trees, expose residents to commercial pollution, and negatively impact their health? Why would anyone want to destroy nature to plant an unwanted commercial entity literally in the backyard of these residents? We ask you to very carefully consider this impending injustice and tragedy to our neighborhood. Please do not approve the L.A. Fitness Center. We are raising our children in a wonderful community. Please do not take this away from them. We have lived in the neighborhood for 20 years. As new shops have been added, our neighborhood has received more attention, which draws more opportunists. We don't need any more high visibility business such as LA Fitness. I have been shopping at Sprouts since it opened, but actually prefer Trader Joes. If this gym goes in, I will NOT shop in the neighborhood any longer. I will go down the road to the Long Beach Trader Joes. Sprouts will lose my several hundred dollars worth of revenue each month. My entire family has vowed not shop at the local shops. We will go to Long Beach or Cerritos. Please do not approve this gym. It will diminish our quality of life. We can see it from our window. We strongly oppose the addition of LA Fitness. It will erect another huge building that there is not enough parking for, and the roads and access points are already too congested to support the additional traffic. As I have three sons who walk or bike to the shopping center, I am terrified of the increased traffic and possibility of accidents. Even one life maimed or lost is too much. This past Friday, I just witnessed a horrific accident at Farquhar and Seal Beach Blvd, just two blocks from my home. Right next to me, before my eyes, I saw a green jeep fly into the air and tumble 5 times and throw the passenger out. Glass shattered everywhere and the man who was ejected tried to sit up and then went limp on the ground. I don't know how it happened right on a neighborhood street. If something like that can happen in our neighborhood streets, it can happen for sure around the shopping center. It would be wonderful if we can all bike or walk to the shopping center as it is very close to Rossmoor and Seal Beach residents, but I already feel unsafe walking or biking there due to all the traffic. Let's create a bike friendly area where we can bike to the shopping center. That would greatly improve the neighborhood's quality of life. I realize that you represent all of the cities in Orange County. I am asking for your whole- hearted attention to be focused on the Seal Beach City Council and their upcoming decision regarding this project. There are simply too many negative impacts to thousands of the surrounding residents, your constituents, to mention in this letter. With all of the studies, the math, the confusing language, and the actions on the part of the property owner, the one thing that seems to be the most difficult for me to communicate is the reality of human behavior and how it defies" scientific" studies prepared to predict it. Therefore,you must listen to the members of the entire community most affected. We all live here ... we KNOW the reality. There's an old saying: "math seeks to quantify ... LOGIC CLARIFIES ". This is the case here. There is absolutely NO LOGIC being applied here. NONE. This is just not the logical location for this project when considering the immense negative impacts that accompany it. The test for everyone involved is this...would you truly want this to be 200 feet from where YOU live? If the answer to that is a resounding NO, then in all good conscience, you must vote NO. Let's put a project there that is grounded in sound judgment and bursting with LOGIC. Fitness Center Shops at RossmoorC.U.P. last year- The leadership, compassion, and integrity driving your decision helps to define you not only as a person of character, but helps ensure a great future for the city of Seal Beach. I have lived in Seal Beach since 1969. Like many "transplants," I chose Seal Beach from among many wonderful areas_ I have chosen to stay her as many members of my family and friends made their homes here. So many of us want to kee'O what Seal Beach has become. It is a community to families and businesses that respect one another and live symbiotically and respectfully. This community is one that protects family safety and nurtures a positive and upiPfting lifestyle for all. This community does not let "interests" from outside the community come in and pit one against the other. Historically the community leaders have listened to parochial interests of those most affected and respected their concerns. We need that leadership now. For 47 years I have seen some great things, and some not so great things come out of City Hall and the Council. When my wife and I moved to Rossmoor, 36 years ago, and raised our family here, it was the sense of community and a slightly less stressful way of life offered in Rossmoor that attracted us. Over the years, with the development of the Shops at Rossmoor and the Target Center across Seal Beach Blvd., that somewhat stress free way of life has deteriorated. Traffic has become an issue at every entrance to the tract as drivers try to find alternative routes to avoid the congestion along Seal Beach Blvd., and the re- opening of Weaver Elementary school and subsequent increased car traffic has become more than just inconvenient at times. I exit Rossmoor using Montecito Road and the 405 freeway and enter the tract via the same route giving me a very good idea of the kinds of traffic problems Montecito Road poses. I have seen parents from communities outside of Rossmoor, whose children attend one of the elementary schools here, routinely running stop signs and substantially exceeding the speed limits in order to get their children to school on time. Should the LA Fitness development be allowed to go forward, the traffic and the safety of the residents and children of Rossmoor WILL be further compromised. Those parents, already late in getting their children to school will be even later as they find themselves slowed by the increased traffic on Montecito Road. Now, in order to make up that time, they will drive excessively fast through the residential streets of our community to one of the four elementary schools in Rossmoor, three of which are located at the back of the tract, requiring driving completely through our residential community. I have no doubt we will see an increase of accidents and injuries as a result. PLEASE, keep Rossmoor a safe residential community for our children and those attending our schools. The development of LA Fitness is NOT a good fit here. The constant coming and going of club members would create an unsafe situation for all of us. When I purchased my home in the area over 20 years ago it was a quiet area. Seal Beach said the new "Shops at Rossmoor" would be small, upscale and quaint. Then of course, the same Seal Beach proponents that told residents that "Bixby" did not need to fund or to build an extra lane on Seal Beach Blvd. because the area would receive less than 14% increased traffic, at the same time told businesses it requested to be tenants at the "Shops" that it would receive an additional 27% increase in traffic. This was BEFORE, Seal Beach added drive through restaurants, which of course "drive thru" is meant to increase rate of traffic, and included In- and -Out and other fast food chains. When residents protested, even with formal protests at the site about these NEW additions, the city of Seal Beach said was because of the "Economy" they needed to add, instead of "upscale" businesses, also high traffic businesses. But this also wasn't true, as the original buildings are occupied by upscale businesses, but Seal Beach ADDED ADDITIONAL BUILDING FOOTAGE to add fast food, fast turn over (by intention) businesses. In addition, originally, some of this area was zoned "Recreation ", which Seal Beach changed to Commercial zoning and Seal Beach never fixed the mess they created, never changed the traffic lanes, and are now attempting to bypass this again. I guess if initially, I say i don't need to change the traffic lanes and it will not create issues to an area because I am building a small amount of stores so it will increase by XX %, then 5 years later say I am adding more stores so this will only increase traffic by XX %, then do the same every 5 years, which is exactly what Seal Beach has done with this center, it never addresses the security, traffic, pollution this has incrementally increased year by year. You must think all of us have lost our minds and memories, we haven't. We don't need another "incremental" shift, Seal Beach will never stop, and most of it's council live in another area and keep putting this crap in our back yard. A solution is there is a huge parking lot at the beach that is empty most of the day, especially during hours most people work out, there are Commercial Buildings on Main Street that are empty and Main Street shops are closing due to lack of business. Put the fitness center there and all these people could use the parking lot that is empty during the hours most people work out, then maybe they will stop at the businesses and shop on Main Street to help the businesses their that are dying, the fitness Center could fill the empty vacant commercial buildings on Main Steet, all a solution to Old Town, but of course, the SB Council members don't want it in their back yard although there is more capacity there then building more in North Seal Beach. No more incremental change for North Seal Beach, we are on to your tactics. I would like to further express my concerns regarding the traffic congestion resulting from the construction of LA Fitness in Shops of Rossmoor. As stated in prior articles the proposed project significantly increases traffic congestion entering and exiting the Shops. At present, traffic is at almost gridlock! The proposed Fitness plan attempts to alleviate the congestion by adding and /or extending turn lanes, or by adding an addition lane near Sprouts. This proposal does nothing to reduce or improve the flow of traffic. The Fitness Center only increases traffic! The shopping center acreage is limited. By changing a lane or increasing left turn lanes you will not reduce the number of cars or elevated congestion. Simply there are too many cars in the Center already. The Center was not designed to handle the increase flow. Nor, does the proposed traffic plans relieve the congestion flow on Los Alamitos Blvd. Emergency vehicles will find increased congestion causing delays as they attempt to use the main artery of Los Alamitos Blvd to Los Alamitos Medical Center. A delay of this lifeline and poor response to the surrounding community is not negotiable. LA Fitness members are bond to take short cuts onto Rossmoor's neighboring streets in an attempt to elevate the traffic congestion. Pedestrians and/or school children walking or riding bikes to school, library, or shops will be put in danger. Anyone presently wishing to cross Montecito from the south side to north side is already taking a risk with the speeding vehicles on Montecito. I can't imagine additional traffic endangering pedestrians and children lives. Finally, the Seal Beach residences who live in the Condos on Montecito will have their quality of life significantly changed because of LA Fitness daily operation: Increased noise, lighting, traffic congestion, parking problems, and increased crime. Seal Beach and Rossmoor communities should work in harmony to better use this land. It is your responsibility, as a City Council Member to make the best choice for the people who live adjacent to this project. I shop almost daily at Sprouts. There are frequent times now when getting into Sprouts parking lot is very difficult due to pedestrians and traffic. The addition of gym traffic will have an extremely negative affect regardless of extending and adding car lanes. Seal Beach residents as well as Rossmoor residents living in the immediate area of the gym will be subject to additional noise 24/7. There will be car doors slamming and car alarms sounding every time gym members and gym employees lock and unlock car doors from 5 A.M. to 11 P.M. This will continue along with loud voices and other noises even before and after gym hours. There are numerous large and small gyms available within driving distance of 10 to 15 minutes. I belong to 24 Hour Fitness which is within a few miles of my home. It does not make sense to put a 37,000 square foot gym inside a residential community within 15 feet of the Rossmoor Park Condominium wall. The real issue comes down to quality of life for the community. Please do not allow our wonderful residential area to be destroyed. I am concerned about the negative aspects of the development, specifically: noise, congestion and traffic. You have heard these arguments repeatedly so I won't belabor those points. What I do want to call your attention to is recent Yelp reviews about LA Fitness' high - pressure sales tactics and cleanliness. First, let me share my personal experience with LA Fitness. I went to the Valley View location several years ago. They use extremely high pressure sales tactics. When you don't sign up, they call relentlessly, sometimes 20 -30 times a day. No one should ever give them their cell number as I did in the beginning of the pitch. They harass you to the point where you must block their number. I tried to contact someone at the head office in Irvine could never reach anyone and no one responded to my multiple phone messages. A few days ago I commented to staff at the Garden Grove facility that it is ridiculous how often exercise equipment, amenities like pool, spa, sauna and even water fountains will be broken or non operational and not be repaired for several weeks or longer. Granted the owner of the property wants more money, but please consider small businesses that are services to our community. The editorial concludes "There is no reason why an LA Fitness cannot open at The Shops at Rossmoor. It's a shopping center, and that is where city planners have decided establishments like LA Fitness are supposed to go. The answer is because the homeowners associations of the unincorporated Rossmoor community and the Seal Beach condominium complexes on the boundaries of the Shops of Rossmoor have taken such a strong and extreme position against the construction of the LA Fitness that residents with opposing views have been made to feel that their views are not welcome. It is clear that those of us whose opinion differs from the board members of the various homeowners associations and their supporters will be ostracized. But as inferred from the OC Register editorial, this is purely a NIMBY response by a community made up of individuals who would otherwise typically be pro - business. To be sure there are issues: traffic is a concern, but the proposed mitigation measures will be effective as any other; they won't solve the problem, but they will help. All of the other factors of concern can -and I am confident will -be addressed as well, including noise from HVAC equipment and drainage pathways as the parking lot is reconfigured. Parking issues for those who have been "squatting" in the parking lot behind the Shops at Rossmoor for years without any official permission are unfortunate, but this is not the responsibility of the City of Seal Beach nor the Shops at Rossmoor. 3 There is one sentence, somewhat buried in the middle of the EIR, that is telling: "If the fitness center project is not approved, it is likely that another commercial land use would be established consistent with zoning regulations. Based on the type of use, trip generation could be less than the proposed project, similar to the project, or it could generate more traffic than the fitness center." To me this means that eventually the Shops at Rossmoor will be approved to build something back there. And it could be something a whole lot less acceptable to our communities than a gym. We might as well build the LA Fitness. Please vote "YES" for this project. It's the right thing to do. And we may as well get it over with! Dickey, Ph.D. Seal Beach, CA 90740 4 LA FITNESS, CITY OF SEAL BEACH, SUMMARY ANALYSIS WHY THIS PROJECT SHOULD BE DENIED Date: Wednesday, August 8t", 2017 Dear City Council of Seal Beach and Michelle Steels' Office of Orange County: For the last seven months' I have regularly attended public hearings in Seal Beach to discuss my objections to the LA Fitness Development Proposal. I am submitting this letter to help focus on the major reasons that the City should deny this project. I can certainly understand why the City would be interested in allowing this project to go forward, namely the frontend fees, and getting the developer to make certain improvements to the access of the center, and perhaps improving the property tax base over the long term. However, from what I understand, there is no sales tax associated with the membership fees, and the continuation of income from the operations is very minimal. In addition, the proposed left pocket lane and improving the access off of Seal Beach Blvd.to the Center is inconsequential. When people go to health clubs they very seldom shop after their work out; it is a single purpose trip to improve the quality of their health. The Health Club in this location is very poor planning and will have a long standing detrimental effect to the North Seal Beach /Rossmoor Community for the following major reasons. Traffic, the EIR is flawed. The traffic trips projected for visits to this Health Club are understated due to using outdated guide references. The traffic should have been determined by comparative analysis with existing health clubs. Members of the local community have done their research and performed actual counts of two local existing large health clubs. The results indicate the traffic counts are at least 3 x's the numbers shown by the EIR. The projection of the traffic through the residential streets is preposterous. It was stated to be 1 % of the new traffic would use the rear (westerly access to the club). The real number is more like 60 -70% of the traffic will use the Westerly Access. This was demonstrated by using Google Maps to route access to the Club from various locations near the proposed LA Fitness Site. The existing shopping Center, without the Health Club, has a major traffic problem due to poor access off of the major arterial, and congestion at the Sprouts /Pai Wei intersection. Now the proposals will be adding at least 3,000 more trips per day and the recommended improvements are inconsequential. Page 1 of 1 ii. Parking issues are grossly understated by the City of Seal Beach. The existing overflow parking onto the residential streets of Rossmoor is already a major detriment to homeowner usage and is a direct result of the City of Seal Beach's lack of planning for parking for High Density Housing. For many years the overflow parking was somewhat contained by use of the commercial property for the overflow cars. Now the Developer is abruptly pushing this traffic off this property and onto the residential streets. There has been no mention of mitigation of this problem (such as a parking structure) and "Quite Surprisingly" the City only requires 1 parking space for every 300 sf of the new building. That computes to 123 parking spaces for a Health Club that proposes a membership of 12000 -15000 members. This same size building in Los Angeles (a less restrictive area) requires 1 space for every 100 sf, which means the number would be 369 for this health club. Now, the already pverflowing parking problem is exacerbated by additional overflow parking. This is outrageous and clearly demonstrates a disrespect for homeowners and would not be approved if this proposal was located next to constituents of Seal Beach. iii. Noise pollution has been studied and exceeds the allowable decibel range for peaceful enjoyment of the surrounding residential property inhabitants. We have surveyed most of the surrounding communities and could not find an existing health club that is tucked between adjoining residential properties. We also could not find a Health Club that would be so poorly placed in alignment with the major arterial streets. Again, this is a preposterous poor fit for placement of a major commercial Health Club. iv. Crime has been closely studied for Health Clubs. We have surveyed major police departments in Long Beach, Cypress and Garden Grove and the statistical results have been presented to the planning commission and council. Clearly, there is more crime associated with Health Clubs then other types of retail operations. We strongly feel they are magnates for organized crime and add to criminal activity in the surrounding communities. They denigrate the area and contribute to the demise of surrounding residential property values. If the City of Seal Beach would not locate this facility in their own local commercial area, why do they assume that Page 2 o-r 2 this is such an ideal location for the North Seal Beach /Rossmoor Community. Please say "no" to this development. v. This project clearly does not add value when weighed against all the above stated negatives. There are many health clubs of various quality and affordability that are within easy driving distance of the Seal Beach community. I know through long personal experience that, despite the great diversity in age, race, and culture, members of the LA Fitness location I am familiar with are studiously courteous in their behavior — indeed, they are most assuredly better - behaved than typical shoppers at a mall. They are moderate in e use, content, and volume of their speech, clean and well - groomed, and much more inclined to keep to aiemselves than to chat up strangers. Club members are focused —they are there for a reason, to optimize their physical well- being; and they are serious about it. Beginners and the disabled or aged are treated with respect and indeed given silent encouragement —we were all beginners once! In all honesty, you could hardly ask for a better set of people to be coming to the Shops at Rossmoor. And not to be forgotten is that many if not most members will themselves be Rossmoor residents: The Club will serve as an additional resource to knit together and enhance our fine community. As to the question of traffic: For decades, I have passed the intersection of Rossmoor Center Way and Montecito every workday morning at some point approximately between 7:35 -7:45 AM. This is the nearest non -mall intersection to the site of the proposed LA Fitness. Some would assert that children going to school would be impacted by traffic at this time. This is inaccurate. Never do I see a significant number of vehicles with children at that intersection at that time, and never do I see pedestrian children there. The vast majority of the sparse number of vehicles observed are single- occupancy vehicles, clearly employees on their way to work (like myself). The few people who would be going to a fitness center at that early time of the day would have only the most minimal impact on traffic. Any impact of club traffic and parking will be diminished by the nature of the business. Members do not all come and go at particular set times. Indeed, when they perceive particular times of heavier use at a club, this very situation prompts them to change their time of arrival to periods when there are fewer members competing th them for use of the weights and machines. Attendance is consequently well scattered throughout the open hours —there are no times when crowds of people try to jam in all at once. We have been residents of Rossmoor since 1986 and we have never been more unhappy than with all the commercial construction that has occurred in the last several years. We moved to Rossmoor because of the schools and it was a peaceful neighborhood with relatively little traffic and it was not hard to get in and out of the neighborhood. Every day is getting harder, more traffic not only in Los Alamitos but in the turns to the shopping areas on both sides of the street that sometimes ends up blocking the traffic because the lines are so long to turn into the shopping areas. We are sure that the traffic is going to be even worse with the fitness center and we absolutely oppose to it. If our voices count please write us down as opposing the project. The last issue that bothers us is the increase in crime in the neighborhood. I am not sure if this is due to the fact that we have much more traffic entering Rossmoor than ever before but we are very concerned about this. There is a complete lack of Pedestrian Safety Mitigation. I had assumed that the current side walk behind the condos, originating at the intersection at Copa De Oro would be continued along the side of Home Goods. They just added parking there. How is our community expected to access the shops? By walking through the middle of a parking ',t? Why can't they put a side walk in, with lights so that we can at least, have a safe path to walk ? I don't see any oposed cross walks or anything to give Rossmoor residents on that side access through the lot. Also, note their parking lot layout. There is a diagonal section that will flow cars exiting right out through the rear exit at the Copa De Oro four way. If the intent is to flow cars in that direction that then Pedestrian Safety much be considered. Marty Potts stated last night that they have hundreds of parking spots, more than they need. Then why can't 20 or so be designated to the Condo owners? Where will they end up parking? It's all going to flow onto our streets. Please protect our community. I think a lot of the backlash from residents can be quelled if we implement a few relatively small requirements for the developer to adhere to. The addition of these commuters will cause further obstruction of traffic for people who live in the area already, go to school in the area, and people who bike in the area. We don't need LA Fitness for the area residents in the Shops at Rossmoor. There are several parks in Rossmoor, and plenty of biking opportunities. 24 Hour Fitness and Pure Barre are a reasonable distance away. The Orange County Register recently wrote an article detailing why Rossmoor residents are concerned with the proposed project. Rossmoor residents are not the only ones concerned with the impact that this proposed business will have on the area. As a Seal Beach resident who resides directly across from the entrance to the Shops at Rossmoor, I can personally attest to the fact that the traffic at that intersection (Plymouth and Seal Beach), especially during peak times, is horrendous. Adding an additional 1,200 cars entering/exiting the Shops every day will lead to an unbelievable logjam. The turn lane that JLL proposes will not solve the problem (I do not think it will even alleviate the current bottleneck). The site simply is not designed to facilitate this type of use. Obviously, no one expects the parking lot to sit vacant. But this project -- given its size and the amount of traffic it will generate --just does not belong in this location. It is a perfect example of trying to make a square peg fit in a round hole. Given all of the property that will be freed up when Boeing leaves, the Westminster /SB Boulevard industrial park makes entirely much more sense for this proposed project. Even placing the gym in the industrial park now makes more sense than the Shops -- in terms of the number of parking spaces available and the impact that an additional 1,200 cars would have entering /exiting from both Seal Beach Boulevard and Westminster (both of which are built to handle that type of capacity at that location). But from a general planning perspective, does the area we really need another gym? LA Fitness already has another location not three miles away from this proposed site. If you add all the mom and pop and big chain gyms together, in a 5 mile radius, there are over 30 gyms /fitness centers /trainers, etc. If we over - saturate the area with gyms, from where are the customers going to come? If there are not enough customers to sustain the business, then we end up with a big box of a building that will be vacant for how long? The Marie Callendars in the Shops at Rossmoor has been vacant for more than two years. The concern about the inability to lease space -- which will have limited use without an exorbitant TI expenditure when the gym fails -- is very real. Does this project truly benefit Seal Beach? The proponents seem to be myopically focused on short-term tax revenues without truly considering all of the relevant factors (environmental impact, traffic, crime /safety, conforming with the City's vision in terms of planning, etc.). Please do what you can to represent your constituents as there are far more against this proposal than are for it and veto the LA Fitness at the Shops at Rossmoor. However, I absolutely disagree with LA Fitness' efforts to build in a location that is clearly NOT the right place for the magnitude of the project. It is clear that the reasons they cite and the "data" they are using to support their motive are inaccurate. They have not addressed the community's concerns but rather have communicated that they know what is best for us. I find this offensive. They say we need a place to go to be healthy (we have many places including the Beach itself!). They say that the traffic impact will be negligible. They say that costs for the street modifications is not their responsibility; it is Seal Beach's. They say they don't live here so they don't know in response to the legitimate questions we ask. We are all residents and community members who love and are devoted to the Seal Beach community. With so many families, children and senior residents living here, LA Fitness will undoubtedly have a negative impact that will irreversibly change our community for the worse. They are not really interested in Seal Beach at all. Again, this is the WRONG fit. First, the neighborhood, with the "Target Magnet," is already hugely crowded. Driving in this neighborhood is getting more and more difficult each day, with the high concentration of popular stores and eateries. We are very lucky to have In N Out, Chipotlle, and Chick Filet so close. But this draws a lot of people to the area already. Combine that with the trifecta across the street of Target, Bed Bath & Beyond, and Ralphs, and you can tell how already busy this area is, primarily in terms of vehicle traffic. Second, this is a family /residential neighborhood. So there are a lot of kids here, going to and from the local stores, with or without parents. Safety is therefore a paramount concern to me. I myself have a young son. Third, LA Fitness has not yet shown that it has sufficient potential customers to justify its existence in this neighborhood. It requires a certain number of members to stay in business. If it cannot meet that number, it will close. And we will be left with an empty building. Based on its location hidden behind the Sprouts, it would likely not be visible enough to attract enough new customers to stay in business. I'm sure your experience with abandoned buildings shows that this is not a desirable element to any neighborhood. Fourth, while the idea of having a local gym may be appealing to some (including myself), there is already a 24 Hour Fitness just a few minutes away on Katella. A far more appropriate location for the LA Fitness would be away from residents but still close, near the intersection of Westminster and Seal Beach Blvd. That might also serve to increase customers at the hotel right there. In sum, putting an LA Fitness in the proposed location in the Seal Beach Rossmoor area would make the neighborhood more crowded and less safe, decrease property values, not be a sustainable business, likely result in an abandoned building, and be more appropriate elsewhere in the city. For these reasons, I respectfully request that you do all you can to prevent this LA Fitness from appearing behind the Sprouts or anywhere else in that shopping center. My favorite part about living in the condos was the access to shopping while still being in a quiet setting. I oppose the request by LA Fitness to build in the parking lot behind the condos. The peaceful, neighborhood feel of that center will severely diminish. The center right now is highly walkable, with walking routes actually mapped out with distances. If you build a gym, any gym, there, you will shatter the walkability of that entire center. I will never let my young children walk through there, as the increased traffic volume will make it unsafe for them to do so. I also worry about the increase of crime. I have a few friends who had their cars broken in to in the gym parking lot on Valley View and had hundreds of dollars of belongings each stolen. The police told them gyms are targets for thieves because people often go to the gym on their way home from other places, leaving many of their belongings in the car. I worry that these individuals will seep in to the streets of Rossmoor and that we will see an increase of property crime, especially on the streets nearest the center. I don't feel LA Fitness is being honest with the details and numbers that they project for membership. They claim they will only need 6500 members to maintain their gym. Their main competitor 24 Hr. located on Katella, just 3 miles away has 17,000 members. LA fitness couldn't survive with 6,500 members, half of what 24Hr. has. 70,000 people go to 24Hr. Fitness a month. (that is 2300 cars in and 2300 car out daily) .... 4600 extra cars a day! There is no way our community could support this kind of traffic coming onto Seal Beach Blvd. and into our neighborhood on St. Cloud and Bradbury. This is not safe for all the kids going to school, pedestrians trying to cross the street, not to mention all the crime it will bring to the neighborhood with people breaking into cars while people are working out. (This happens at 24 Hr.) The Village 605 that is going to be built in Los Alamitos is already going to bring increased traffic to the area. Our community cant handle 4600 more cars a day from LA Fitness coming in also. Trying to get to the high school or middle schools will be a nightmare! We need to stop LA Fitness coming into our neighborhood before it is too late. Once it comes in it will be too late to say what a mistake it was. And there is room to add yet another - but let's choose one that you all would be happy to have in Old Town - a business without all of the many negative affects of 24 Hour Fitness. My concerns center on a number of issues but the most critical negative impact would be from: 1. Traffic- Despite any and all efforts to direct traffic to Seal Beach Boulevard it is completely apparent that the majority of traffic will quickly find the shortest route is via Montecito Road through Rossmoor. I spoke to the traffic engineer, at length, and viewed their measures. I have absolutely no doubt that there will be a marked increase in traffic in Rossmoor with an expected increase in accidents /incidents and a seriously lowered level of safety for residents including children. Their "estimates" for traffic on Montecito are clearly "guesses" and ignore common sense. Traffic within the Shops at Rossmoor is already horribly congested and makes for a situation and place I try to avoid currently because of the danger of driving within it. This will be significantly worsened by the proposed construction and exploding amount of traffic 2. Safety- With the expected increase in traffic through Rossmoor and the knowledge that surge times for attendance at a fitness center seem to parallel school opening and closing times I have a very strong concern that should this fitness center be built there will be a corresponding decrease in the safety of school children, as well as residents, during those times particularly. 3. Crime- Fitness centers are known to be "hot spots" for crime. It is no secret that anyone entering a gym will likely be there for at least one hour. As such, it is all too common to have such places staked out by groups of criminals with the intent of car break -ins. Any female entering the gym without a purse almost certainly has one in their car and becomes a target. It would be impossible for Seal Beach to station a police unit at the fitness facility from 5 AM to 11 PM to prevent this. The location is secluded enough to make this a very real concern. My wife had exactly just such an incident at the 24 hour Fitness Center in Cypress recently. The Cypress police related that this is exceptionally common and opening such a center at the Shops at Rossmoor only invites a higher level of crime into Seal Beach and also into Rossmoor itself. I have a much longer list of additional negative impacts such a fitness center would have on my community, Rossmoor, but the above seem to be the most critical. Despite the letter from Marty Potts suggesting there is an ever - growing interest in such a fitness center to be built, I remain totally unconvinced there is any such interest. I am aware of an extremely strong concern in the community that such a center will be a severely negative influence. More traffic, more crime, more congestion in a space that is severely impacted currently does not match up with JLL's notion of an experience "aligned with the needs and desires of our customers ". Here is the Voice of Reason ringing out every day in the memory banks of my mind: The question is WHY? Why would a City allow a 37,000 -sf health club in an almost land locked area for a building of this size; and, planned, to attract 1500 workout trips per day or more. If you observe around So. Calif. you will note that most health clubs of this size and membership goals are located adjacent to a major arterial. This means four major traffic lanes for direct access to the site, and the site is not situated where one must traverse down what is much like an alley -way and can only be accessed on one side. The EIR study compared this site to all health clubs across the United States. Whereas, the most comparative analysis should have compared this site with other Health Clubs that are tucked away inside a shopping area with only limited access from a small alley- way of two lanes. Yes, it may be difficult to find such a comparative building and for GOOD reason: IIt is not a good fit.! This is obvious to a reasonable person, that this proposed Health Club does not suit this location primarily due to Page 1 of 1 access, and secondly, due to the proximity of Housing on the North, on the West, and to the South. In addition, parking is constrained due to the already existing overflow from housing projects that have been approved or apartments that have been converted to Condo's without sufficient onsite parking to accommodate the resident occupancy. The residents of Rossmoor living on access streets off of Montecito already are deluged with overflow parking from these housing projects. When City officials consider this site for approval, your voice of reason should prompt you to make a list of pros and cons on the following major points for discussion: Does it provide a service to the Community that the Community doesn't already have? Answer: "NO" there are several health clubs within a 5 -10 minute commute of various sizes, quality, and equipment. Seal Beach and or Rossmoor does not need another Health Club particularly of this Size. II. Does it provide continued revenue to the City that is sustainable and is greater than the additional cost and expense of future maintenance? Answer: "Not really" Yes the City will receive a windfall in fees and additional property tax, but probably won't receive any additional sales tax. Few people will shop at mall, people are there to work out and not shop. The trend today is to shop on the Web, that is why many retail stores are failing, shopping centers across the U.S. are failing in large numbers because people do not NEED to go to stores when they can shop on line and have it delivered. Other areas that need to be considered and pay particular- attention to added service expense: (1) Crime will definitely increase - Health Clubs attract crime, theft of wallets, valuables in cars, cars stolen, theft, burglary, organized crime, drug traffic, assault, a review of Health Club crime on the Web leads to many police activities and reports. (2) Parking lots will be trashed, bottles, wrappers, fast food throw -a -ways. (3) Noise complaints from residents resulting from loud music from the club, from the cars, from visitors in parking lots, motor cycles, loud trucks, doors slamming, people coming and going while residents are sleeping, and ambulances from injuries at the health club. (4) Traffic accidents will increase, bicycles, mothers walking on Rossmoor way with the children in strollers, cars crashing into each other due to the congested area. (5) It is estimated by realtors that homeowner within a 1000 feet of the Health Club and Montecito, St. Cloud, and Bradbury will have their property values decrease by at least $25,000- 50,000 per year. Yes, this is the responsibility of Seal Beach and Orange County -- -loss of Page 2 of 2 property taxes to Seal Beach and Orange County. Can you imagine losing $25 -50K of your home value so you can see more traffic coming and going in your neighborhood. It is totally absurd!! (6) The current parking at this site must be addressed. Residential overflow and Sprout customers are now parking at this site. Why? The 246 Regency Apartments were converted to condos many years ago. The parking for this site was never addressed, why because there was plenty of overflow parking in the commercial area. The same holds true for the Condos at the West of the site. Parking overflows have always used the commercial lot. In addition, overflow parking has sprawled into the Rossmoor streets collecting onto Montecito. So, the overflow was a direct result of poor planning by the City of Seal Beach. There should have been a parking structure on the commercial site. Now with a health club proposal, once again there should be a parking structure as part of the proposal ... We don't see one... why.... Same reason ...Poor planning. WHY WOULD THE CITY WANT TO BE A BAD NEIGHBOR TO THE ROSSMOOR RESIDENTS? The communities interact at community events, at the schools, at the parks, at the pools, and particularly at the High Schools. There are sporting events, academic projects, team funding, grad night and a host of other activities where it is essential that we have good neighborly relations. We both share the ambiance of a beach community. Allowing this health Club to be approved is ABSOLUTELY, POSTIVELY, not acting in the best interest of your neighbors. The aforementioned roads appear to be legitimate and designated Seal Beach roads that have ostensibly been "merged" into and /or overtaken by the developer for use as parking facilities. For all intents and purposes they are no longer distinguishable from the developer's parking lot. Aside from the possibility that public interest has been and is being undermined, I do believe there may be a public safety issue. These roads are used by pedestrians — including Rossmoor and Seal Beach residents - to access the shopping center from a variety of directions. The lack of a sidewalk(s) and appropriate provisions to safeguard pedestrians presents a hazard that will only be augmented by a significant increase in traffic along with frustrated drivers given the anticipated development of LA Fitness in this area. Your efforts to address public safety including an indicated need for public parking is likely to impact the LA Fitness development. Before authorizing and /or initiating the LA Fitness Development, I would respectfully suggest that you consider public safety and interest by allocating, room for a sidewalk(s) —even if you may need to do so by eminent domain. The Los Alamitos Unified School District, Rossmoor, and the County of Orange are constantly looking at the traffic impacts within and outside our community. At its own cost, the school district has even begun a program offering low cost bus service to all the schools from Seal Beach, Los Alamitos, and Rossmoor. For the first time in decades, the district has had to stagger the start times of all the elementary schools to help with the congestion of traffic. It just completely baffles me why the decision makers in the city of Seal Beach think that it will be okay to add in approximately 2,000 more car trips a day into 17 is Treacly congested area. Keep in mind this area is not j List Rossmoor Center Way/Main Way by Sprouts, it is the entire Seal Beach Blvd/Los Alamitos Blvd and the surrounding streets on the west side of The Shops at Rossmoor that are half in the city of Rossmoor and half in Seal Beach. It is already a nightmare trying to get children to /from all of the schools in the district, from elementary to the high school. So, as a city, you should be doing everything in your power to help with the traffic, not make it worse. The interesting marketing that the developers came up with say the LA Fitness will fill a void of a gym in the neighborhood. There is no void, there are 33 gyms in a 3.5 mile radius. I am one of hundreds of individuals in the Rossmoor community who are in this unfortunate situation. The reaction that you are getting from opponents of the project is similar to those who support the LA Fitness Project on the Nextdoor website. As soon as anything positive is posted regarding the benefits to the Seal Beach and Rossmoor community, it is drowned out by the same vocal opponents who throw out statistics and theories of increased crime, homeless issues, child endangerment, and unmanageable traffic issues with little factual basis and no studies to support their opinions. I have studied the EIR from start to finish and am convinced that the small increase in traffic due to the LA Fitness project will be alleviated through the improvements at the Rossmoor Center Way / Seal Beach Blvd area. The elephant sitting in the corner of the- room is the loss of the illegal parking for residents of the-condos / townhomes .on- -the edge of the commercially- zo -ned- for - decades.- .p.roperty-and the residents across Montecito in Rossmoor who will have cars parked in front of their houses just as I experience near the corner of St. Cloud & Yellowtail. The nature of the gym business requires many cars constantly coming and going all day, using this already crowded access road. A number of City Council and Planning Commission members mentioned parking as the major reason for voting against the Project. This was reported in the Sun newspaper and other places. I reviewed the traffic study data at the Town Hall meetings. The required spaces for the Project is approximately 374. The Project's plan designates 400 parking spaces for the Gym. There is no parking problem there. Articles in the Sun newspaper quoted the total number of spaces in the shopping center and the number of spaces that would be left after the Project. The numbers are within the limits with over 336 extra spaces in the whole shopping center. Once again no parking problems. It appears that the parking problem in Rossmoor is an issue that City Council and Planning Commission have taken into consideration concerning this project. I contend that the parking issues of the unincorporated area should not be considered as relevant to this Project. Rossmoor does not want overflow parking from the condominiums to park in front of their homes. That issue is an Orange County issue. The condos want parking outside the of their complex. A very small portion of the condo parking problem is related to condominiums within the City of Seal Beach. It is still not the responsibility of the Shops at Rossmoor or LA Fitness. Are the Shops at Rossmoor and LA Fitness being held hostage for the sake of the parking issues in the unincorporated area called Rossmoor? Are the Shops at Rossmoor and LA Fitness being held hostage for the sake of the condominiums lack of parking? The Project meets parking codes without any variances! Do not hold the Shops at Rossmoor or LA Fitness Project responsible for neighboring parking problems. Please base your vote on these facts not opinions, emotions, biased statements, or disinformation.
