Ingram, City Manager FROM: Steve Myrter P.E., Director of Public Works SUBJECT: ADOPT A RESOLUTION LISTING THE PROJECTS PARTIALLY FUNDED BY SENATE BILL 1: ROAD REPAIR AND ACCOUNTABILITY ACT AND AUTHORIZING SUBMITTAL OF THE PROJECT LIST AND APPLICATION FOR RMRA FUNDS TO THE CALIFORNIA TRANSPORTATION COMMISSION SUMMARY OF REQUEST: That the City Council adopt Resolution No. 6770: 1. Approving the project list for improvements that are to be partially funded by Senate Bill 1 (SB1); and 2. Authorizing the City Manager or designee to submit the project list and application for RMRA funds to the California Transportation Commission. BACKGROUND AND ANALYSIS: On April 28, 2017, Governor Brown signed Senate Bill No. 1 (SIB 1), the Road Repair and Accountability Act of 2017, as amended on September 16, 2017, pursuant to Assembly Bill 135. SB 1, which was created to address basic road maintenance, rehabilitation, and critical safety needs on the State highway and local road systems, increases per gallon fuel excise taxes increases diesel fuel sales taxes and vehicle registration , fees, and provides for inflationary adjustments to tax rates in future years. Beginning November 1, 2017, the State Controller will deposit various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). The State Controller will apportion, by formula, a percentage of RMRA funds to eligible cities and counties in accordance with Streets & Highways Code Section 2032. Pursuant to Streets & Highways Code Section 2030, RMRA funds must be used for projects that include but are not limited to, • Road maintenance and rehabilitation; Agenda Item F • Safety projects; • Railroad grade separations; • Complete street components including active transportation purposes, pedestrian and bicycle safety projects, transit facilities, and drainage and stormwater capture projects in conjunction with any other allowable project; and • Traffic control devices. According to information provided by the California Transportation Commission (CTC), the City of Seal Beach is estimated to receive approximately $170,387 of additional gas tax funds. SB 1 imposes several requirements on public agencies in order to receive the additional gas tax funds. These requirements are contained in the Streets & Highways Code, including Streets & Highways Code Section 2034, which provides: (a) (1) Prior to receiving an apportionment of funds under the program pursuant to paragraph (2) of subdivision (h) of Section 2032 from the Controller in a fiscal year, an eligible city or county shall submit to the commission a list of projects proposed to be funded with these funds. All projects proposed to receive funding shall be adopted by resolution by the applicable city council or county board of supervisors at a regular public meeting. The list of projects proposed to be funded with these funds shall include a description and the location of each proposed project, a proposed schedule for the project's completion, and the estimated useful life of the improvement. The project list shall not limit the flexibility of an eligible city or county to fund projects in accordance with local needs and priorities so long as the projects are consistent with subdivision (b) of Section 2030. As set forth in the statute, the road repair and maintenance projects must be approved by resolution of the City Council at a regular public meeting. The resolution must also contain a description and location of each proposed project, a proposed completion schedule, and the estimated useful life of each improvement. The listed project intended for SB 1 is: • ST1801 Annual Slurry Seal Program. The additional gas tax funds are currently budgeted in the approved FY 2017 -18 Budget for CIP Project No. ST1801 Annual Slurry Seal Program. Staff intends to combine ST1801 with ST1701 for a larger slurry seal project. Both original projects are outlined in the approved 2016 Pavement Management Program, under the Forecasted Maintenance Report FY 2016 -17 and 2017 -18, Maintenance Type — Slurry Seal. See Attachment B. The work will consist of surface treatment and traffic pavement markings. The notice inviting bids will be Page 2 released to contractors in the Spring of 2018, with construction completed by the fall of 2018. The City's Pavement Management System Program calculates a new useful life of 24 years for these repaired roadways. The purpose of approving the attached resolution is to satisfy the requirements of SB 1 relative to holding local governments accountable for the efficient investment of public funds to maintain public streets and roads, in accordance with Streets & Highways Code Section 2034. The criteria developed by the CTC requires that the first round of projects to be funded with RMRA dollars be submitted no later than October 16, 2017. The proposed Resolution is expected to be acceptable as confirmation that the project list is included in the City's CIP budget pursuant to a decision made by the City Council at a regular public meeting. ENVIRONMENTAL IMPACT: The proposed action is not a "project" as defined in the California Environmental Quality Act (CEQA), Public Resources Code Section 21065 and Section 15378 (b) (4) and (5) of the State CEQA Guidelines. The proposed action is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment, and the creation of government funding mechanisms or other government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. As such, the proposed action is not subject to environmental review. LEGAL ANALYSIS: The City Attorney has reviewed and approved the resolution as to form. FINANCIAL IMPACT: In the approved FY 2017 -18 Budget, $250,000 has been allocated for the Annual Slurry Seal Program CIP No. ST1801 and $150,000 for Annual Slurry Seal Program CIP No. ST1701 for total of $400,000. The $170,387 SB1 additional gas tax funds have already been incorporated into the approved FY 2017 -18 Budget for the Annual Slurry Seal Program CIP No. 1801. Page 3 Staff will combine both projects ST-I 701 & ST1801 for a total of $400,000. The funding source breakdown for each project is as follows $400,000 RECOMMENDATION: It is recommended the City Council adopt Resolution No. 6770 listing the projects that are partially funded by Senate Bill 1 (SB1), and authorizing the City Manager or designee to submit the project list and application for RMRA funds to the CTC. Project List Page 4 Attachment "A" RESOLUTION NUMBER 6770 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL ADOPTING A LIST OF PROJECTS PARTIALLY FUNDED BY SENATE BILL 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO SUBMIT THE PROJECT LIST AND APPLICATION FOR RMRA FUNDS TO THE CAIFORNIA TRANSPORTATION COMMISSION WHEREAS, Senate Bill No. 1 (2017 -2018, Beall), as amended by Assembly Bill 135 (2017 -2018) (collectively SB 1), known as the Road Repair and Accountability Act of 2017, established a Road Maintenance and Rehabilitation Account (RMRA) to help fund deferred maintenance on the state highway system and the local street and road system; and WHEREAS, pursuant to SB 1, the State Controller will apportion, by formula, a percentage of the RMRA funds to eligible cities and counties; and WHEREAS, SB 1 established requirements for holding local governments accountable for the efficient use of public funds to maintain public streets and roads; and WHEREAS, SB 1, as codified in Streets & Highways Code Section 2034(a)(1), requires that eligible cities submit a list of projects proposed to be paid for with these funds to the California Transportation Commission (CTC) in accordance with statutorily- defined criteria and a schedule established by the CTC; and WHEREAS, pursuant to Streets & Highways Code Section 2034 (a) (1), the list of projects must be approved by the applicable city council or board of supervisors at a regular public meeting; and WHEREAS, at a regular public meeting of the City Council held on September 25, 2017, the City Council reviewed the proposed project list and the previously approved City budget (FY 2017 -18); and WHEREAS, the proposed action is not a "project' as defined in the California Environmental Quality Act (CEQA), Public Resources Code Section 21065 and Section 15378 (b) (4) and (5) of the State CEQA Guidelines, because the proposed action is an organizational or administrative activity that will not result in direct or indirect physical changes in the environment, and the creation of government funding mechanisms or other government fiscal activities, which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE: Resolution Number 6770 Section 1. All of the above recitals are true and correct. Section 2. The City Council hereby approves the project list set forth in Attachment A, incorporated herein by this reference, as the list of projects of the Annual Slurry Seal Program ST1801, to be partially funded with Road Maintenance and Rehabilitation Account (RMRA) revenues. Section 3. The Budget for fiscal year 2017 -18 incorporates the project list, as set forth in Attachment A, planned to be funded with Road Maintenance and Rehabilitation Account revenues: Annual Slurry Seal Program ST1801. Section 4. The particulars of the proposed improvements, as set forth in the project list, are as follows: A. Anticipated Funding Sources: 2017 -2018 SB 1 ($170,387) and Gas Tax funds ($79,613) for a total project budget of $250,000. B. Project Description: The work will consist of surface treatment and traffic pavement markings and other related work. C. The City Manager, or her designee, is hereby authorized to submit the project list and application to the California Transportation Commission for any and all RMRA funds that may become available to the City, and to execute any and all documents necessary to implement and secure any and all such RMRA funds.
