Badum, Director of Public Works /City Engineer SUBJECT: APPROVAL OF FINAL TRACT MAP #15832 — BEACKWALK 7, LLC (Former Shore Shop Property) SUMMARY OF REOUEST• It is requested that City Council find that Tract Map 15832 is in substantial compliance with the previously approved tentative tract map, approve Tract Map 15832 as presented, and instruct the City Engineer and City Clerk to execute said Tract Map as required. BACKGROUND: On February 12, 2001, a tentative map of the proposed subdivision was approved subject to Subdivision Laws, City Municipal Code, and to the requirements and conditions contained in Seal Beach City Council Resolution No. 4876. The approved tentative tract map (Tentative Tract Map 15832) established the residential development and subdivided this site into a total of eight residential properties for conveyance purposes. The property is located along the west side of Seal Beach Boulevard, between Landing Avenue and Pacific Coast Highway. Approval of the Final Tract Map will formally create the subject parcels, and allow them to be sold in accordance with the terms and conditions of Tract Map 15832. In accordance with the Subdivision Map Act, the subdivider has been conditioned to construct frontage improvements including curb, gutter, sidewalk, street trees, pavement, alley improvements, underground utilities, and one half of the cost to construct a landscaped entrance median island. These subdivision improvements will be constructed as a part of the City's Seal Beach Boulevard Rehabilitation Project. The subdivider has agreed to enter into a subdivision improvement agreement which ensures the construction of said improvements using bonds issued by an approved surety company. The Final Tract Map has been reviewed and approved by the County of Orange Public,. Facilities & Resources Department for compliance with all required Subdivision Map Act requirements and by the City Engineer and Director of Development Services for -,0GVw K Final Map -Tm L Ciry Council Agenddv,,R Am123, i compliance with all conditions of approval of the Beachwalk 7, LLC Development Project and Tentative Tract Map 15832, and it is appropriate for the City Council to approve Tract Map 15832 as presented. In accordance with the provisions of Government Code § 66474.1, the determination to approve a final tract map is a ministerial action and "A legislative body shall not deny approval of a final or parcel map if it has previously approved a tentative map for the proposed subdivision and if it finds that the final or parcel map is in substantial compliance with the previously approved tentative map ". FISCAL IMPACT: No fiscal impact. All costs will be paid or reimbursed by the developer. Appropriate plan check and building pertit fees will be charged as costs are incurred. RECOMMENDATION: It is recommended that the City Council: 1) Find that Tract Map 15832 is in substantial compliance with the previously approved tentative tract map, approve Tract Map 15832 as presented, and instruct the City Engineer and City Clerk to execute said Tract Map as required. 2) Approve and execute the City of Seal Beach and Beachwalk 7, LLC Subdivision Improvement Agreement, Tract 15382. e Whittenberg, Director o elopment Services tephe .
