Honorable Mayor and Council Members:
In the Fall of 2000, it was brought to the attention of the Airport. Land Use Commission for
Orange County (ALUC) thaulfe Bixby Ranch project located imme ' tely adjacent to the
southwest fence line of the Los Alamitos Joint Forces Training Base w likely being
implemented in a configuration unlike any of the General Plan amendments/zone changes for
this area previously reviewed by the ALUC.
The Commission directed its executive officer and legal counsel to research this issue and report
back to the Commission. The Commission received background briefings on the issue from the
staff, received input from the Base Commander at the Los Alamitos Joint Forces Training Base
and from Mr. Lee Whittenberg, the Director of Development Services for the City of Seal Beach.
After reviewing all the information and after extensive discussion by the Commission, at its
special meeting of February 22, 2001, the Commission unanimously directed that a response to
the letter from the Seal Beach Director of Development Services dated January 28, 2001 be
prepared to inform you of the following: The Bixby Ranch projects immediately adjacent to the
Armed Forces Reserve Center of Los Alamitos were reviewed by the ALUC in 1995 and 1998
and found to be Consistent with the AELUP on those particular dates. The proposed General
Plan Amendment reviewed by the ALUC in 1995 subsequently was not adopted by The City of
Seal Beach. On August 3, 1999, the Superior Court ordered the City of Seal Beach to vacate all
actions taken by both its Planning Commission and City Council, which relied on EIR SCH
97091077 used in approving the project. Per the Public Utilities Code Section 21676(b), the
ALUC believes that the City of Seal Beach should have submitted its General Plan Amendment,
pertaining to the Bixby Ranch, to the ALUC for review and Determination of Consistency, prior
to the City's readoption of the Plan (August 16, 1999), subsequent to the Court order to vacate
the previous action. Since the project was not referred to ALUC, no consistency determination
has been made on the Bixby Ranch project.

While the Commission has recently seen a new and different version of the Bixby Project as
shown on Tract Map 15797/Preliminary Site Plan, the Commission has not been able to obtain
maps of the current General Plan designations and zoning although repeated requests have been
made to obtain those maps.
Because of the ALUC's serious concerns that the Bixby Ranch project General Plan Amendment
and Zone Change were not referred to the ALUC, the Commission wishes to notify the City of
Seal Beach that, since it is an Inconsistent Local Jurisdiction, and as permitted by Section
21676.5(a) of the Public Utilities Code, the ALUC will now require the review of all subsequent
Seal Beach land use projects, i.e. "actions, regulations and permits ", in the Planning Area of the
Los Alamitos Armed Forces Reserve Center, rather than just General Plan Amendments and
Zone Changes.
I will be pleased to provide any reply that you deem appropriate to the foregoing, promptly to the
Members, and to the responsible staff of the Commission.
