Badum, Director of Public Works/City Engineer Subject: DISADVANTAGE BUSINESS ENTERPRISE PROGRAM SUMMARY OF REQUEST The proposed action will pass a resolution approving the City's Disadvantaged Business Enterprise Program. DISCUSSION: The City has received Federal Financial Assistance for various projects including Marina Drive Bridge Replacement, Seal Beach Boulevard Pavement Rehabilitation, Lampson Avenue Pavement Rehabilitation, and various CDBG funding. As condition to receive Federal funding, the City must prepare a Disadvantaged Business Enterprise (DBE) Program in accordance with the requirements of the California Department of Transportation (Caltrans) or lose its funding. This ensures that DBEs, have an equal opportunity to receive and participate in DOT -assisted contracts. Each year the City must submit a DBE Program which defines a DBE participate goal. Our established goal is 5 %. In any project using federal funds, a minimum of 5% of the amount of the contract must be used to hire DBE contractors. Since the City has received Federal financial assistance from the Department of Transportation, and as a condition of receiving this assistance, the City of Seal Beach must sign an assurance that it will comply with Title 49, Part 26 of Federal Regulations. FISCAL IMPACT Funding availability for Federal financial assistance projects is directly related to passage of this resolution.
