Dear Ms. Leibel:
The City of Seal Beach has reviewed your request of November 21, 2000 relative to
"Request for Applicable or Relevant and Appropriate Requirements" (ARARs) for Naval
Weapons Station (WPNSTA), Seal Beach, Site 5. Upon a review of your letter, the
information provided in Attachment A, and the attached EPA Fact Sheet "Overview of
ARARs", the City of Seal Beach has no input on potential ARARs regarding chemical -
specific ARARs. The City does have a "relevant and appropriate requirement" in relation
to Site 5, Wastewater Settling Pond. The City requests that the provisions of Section 6 —
Archaeological Resources Protection of "Archaeological Resources Protection Plan for
Installation Restoration Sites 5, 8, 12, 16, 21, 40, 44, and 46 at Naval Weapons Station, Seal
Beach, Orange County, California', dated March 1995 be required to assure compliance
with the provisions of Section 106 of the National Historic Preservation Act I am enclosing
a copy of that section of the report to indicate the monitoring and worker training activities
that should be included with the final conditions of approval for the subject removal action.
In addition, since there are agreements between the Navy and the State of California which
require the Installation Restoration Program to comply with State requirements and
regulations, all project activities would be determined a project pursuant to California Public
Resources Code Section 21065, and therefor would require an environmental analysis to be
performed in accordance with the provisions of the Califomia Environmental Quality Act,
Section 21000 et. sea., and the "Guidelines for the Implementation of the California
Environmental Quality Act with Discussions", prepared by the Governors office of
Planning and Research.
