.As the owners of the aforementioned subject property we have spent the last year attempting
to negotiate a deal to have Starbucks take over the existing Burger King restaurant. We
received word from Quinn Barrow your city attorney last Tuesday that the floor plan presented
by Starbucks (please see attached) would be viewed by the city as substantially different than
the existing floor plan approved with the current CUP.
Therefor it is our understanding that if Starbucks were to proceed with their remodel to the
floor plan they have requested the existing CUP 94.4 would be tendered null and void. This
would result in a tremendous devaluation of our property. In further discussion with the Seal
Beach City Attorney, he was asked if Starbucks or our organization at some later date restored
the subject property to its current condition, would the CUP then be able to be restored. Mr.
Barrow felt this was a reasonable request and he recommended that we write a letter to the
City Council for Seal Beach requesting as such.
As the owners of the subject property, we have taken great care of the property and have
operated the Burger King restaurant for several years without a single complaint from our
neighbors. It is unfortunate that the restaurant industry and more specifically the Burger King
system has changed in recent years forcing us to modify our store locations.

We are proud members of the community of Seal Beach and for that reason, we are not selling
our property just modifying its use at this time. We are asking you to please protected the
value of our property and to support our request to allow the existing CUP 94-4 as well as
Variance 94-5, to be reinstated at an unspecified later date, provided that the subject property
and its improvements were restored to the current configuration that exists with the existing
Burger Ki rig restaurant.
