Subject: PROPOSED LEASE AGREEMENT — VERIZON
WIRELESS AND CITY OF SEAL BEACH
SUMMARY OF REQUEST
The proposed lease agreement would allow Verizon Wireless to install a cellular
telephone or "personal communications service" (PCS) facility at Zoeter Field.
BACKGROUND
On August 14, 2000, City Council authorized staff to research and, if warranted,
negotiate an agreement between Verizon Wireless and City of Seal Beach regarding the
installation of cellular equipment, antennas and a monopole (tower) at Zoeter Field. Staff
and representatives from Verizon have agreed on a cell site location at Zoeter Field as
well as a proposed contract for review by City Council members (attached). The cellular
telephone facility would be approximately 170 square feet in size and would be located at
the northwest comer of Zoeter Field (Exhibit `B"). A seven -foot trash bin, which
currently occupies this site, would be relocated to the southern end of the facility.
PROVISIONS OF THE CONTRACT:
TERM.'
The term of the agreement would be for five (5) years, subject to two (2), five (5) -year
extensions.
AESTHETIC CONCERNS:
Verizon will install a chain link fence around the perimeter of the cellular facility as well
as the relocated trash bin. In addition, fabric mesh will be applied to the fence in order to
visually screen the cellular equipment and the trash bin.
The principal aesthetic concern is the 50 -foot tower. Fortunately, this monopole will be
consistent in appearance with several 50 -foot poles (with light standards) currently in
place at Zoeter Field. In addition, Verizon's monopole will be devoid of the horizontal
"gargoyle" antennas --which typically sit atop so many cellular poles throughout southern
California. Instead, Verizon's antennas will be attached to the pole in a vertical,
unobtrusive manner.
Agenda Item:
Contingent on future community needs, the City can require Verizon to install light
fixtures to the tower at any time—the cost of the purchase, installation and wiring of
these lights would be assumed solely by Verizon.
SAFETYCONCERNS:
Verizon will provide evidence that its communications facility complies with all Federal
Communications Commission regulations and standards governing "radio frequency
radiation"(RF energy). In addition, the City may --at any time --require Verizon to test its
equipment for levels of radio frequency energy.
Verizon is also required to take appropriate steps to prevent interference with
communication frequencies used by public safety departments within the City of Seal
Beach.
CO--LOCAHON:
In order to mitigate the possible proliferation of cellular towers in the future, Verizon
will permit other cellular or PCS applicants to co -locate on its monopole.
LEGAL REVIEW:
The City Attorney has reviewed and approved the attached lease agreement.
FISCAL IMPACT
Pursuant to approval of this agreement, City will receive a rent payment of $36,000 per
year, with an annual CPI adjustment, and a one-time administrative fee of $20,000.
RECOMMENDATION
That Council approve the attached lease agreement and direct staff to execute the contract
between Verizon Wireless and City of Seal Beach.
