HomeMy WebLinkAboutSupplemental - Item J Closed Session from Gary MillerDecember 11, 2017 Seal Beach City Council On October 5 as a former member of the Orange County Transportation Authority (OCTA) Board of Directors, I received a courtesy briefing at the invitation of OCTA regarding the Almond Avenue sound wall plans. Attendees were: ORA Executive Director Capital Programs Jim Bell, OCTA Director of Highway Programs Rose Casey, OCTA 1-405 Improvement Project Manager Jeff Mills, OCTA Public Outreach Acting Department Manager Christina Byrne, According to OCTA, east of Almond Park it is planned to relocate approximately 470 feet of the sound wail beginning approximately 100 feet east of the park and ending at approximately Primrose Circle. At the two extremities of the 470 feet, the relocation will be at zero feet. The lateral relocation is between approximately 0-8 feet. For approximately 175 of the 470 feet, Almond Avenue will be narrowed from 40 feet to between 36 and 40 feet. In this area where Almond Avenue will be narrowed to between 36 and 40 feet, there will be approximately 2 feet between the relocated sound wall and the north curb face of Almond Avenue. It was not clear to me what is planned in the remaining 295 feet of the 470 foot relocation, except that 295 feet of street should be at least 36 feet wide with a parkway of at least approximately 2 feet but 1 cannot say for sure. West of Almond Park approximately 1,550 feet of the sound wall will be relocated beginning approximately 300 feet west of park and ending at approximately Dahlia Circle. At the two extremities of the 1,550 feet, the relocation will be at zero feet. The lateral relocation is between approximately 0-8 feet. For approximately 975 of the 1,550 feet, Almond Avenue will be narrowed from 40 feet to between 36 and 40 feet, with a parkway of approximately 2 feet. Here again, it was not clear to me what is planned in the remaining 575 feet of the 1,550 foot relocation, except that 575 feet of street should be at least 36 feet wide with a parkway of at least approximately 2 feet. In this area west of the park most, if not all, of the street and parkway currently have a total width of 44 feet, 40 feet and 4 feet, respectively. When I pointed out relocating the wall 8 feet and reducing the parkway 2 feet the street would be 34 feet wide, the OCTA representative indicated the final design is still being developed. This 1,550 feet of Almond Avenue will parallel 10 northbound lanes of the freeway and if you applied the same design standards Caltrans is proposing for "Alternative 3 Modified" (attached) there would not be a need to relocate the 1,550 feet of sound wall. Steele, City Attorney The City Attorney reported that the City Council met in Closed Session. prior to the regular meeting and discussed the items identified on the agenda. The City Attorney noted that Council Member Vanpapa recused himself from discussion of Item A on the agenda due to his employer. The City Attorney reported that the City Council unanimously directed the City Attorney to file a legal California Environmental Quality Act (CEQA) challenge to the adequacy: of an Environmental Impact Report (EIR) prepared by the California Department of Transportation (Caltrans) and Orange County Transportation Autlgmy (OCTA) for the Id05 Improvements Project. The lawsuit will be filed in Orange; County Superior Court this week. The Cray's challenge will allege that Caltrans failed to follow CEQA and failed to identify, evaluate, and mitigate environmental impacts in a number of areas including traffic, noise, air quality, arid, specifically, the impacts on local residents as opposed to the regional parties the report addressed. The challenge will note that the report does not adequately evaluate, or identify and mitigate, the environmental impacts of moving the Almond Avenue r, sound wall and essentially stopping traffic at the Los Angeles County border. U The City's challenge will also allege that the EIR is essentially a rationalization for a project Caltrans and OCTA illegally pre -committed to several years ago, and not an adequate disclosure of the serious adverse environmental impacts the project will create. The City Attorney further reported that the City Council discussed Item B and mere was no reportable action. The City Council also discussed Item C and there cuss no reportable action on two of the cases identXled on the agenda.
