Minutes Approved by: m City of Seal Beach — Planning Commission November 6, 2017 Vice Chair Thomas called the regular meeting of the Planning Commission to order at 7:01 p.m. in the City Council Chambers. Commissioner Aguilar led the Pledge of Allegiance. ROLL CALL Present: Commissioners: Grgas, Campbell, Klinger, Thomas, Aguilar Absent: Commissioners: None Staff Present: Craig Steele, City Attorney Crystal Landavazo, Interim Community Development Director Steven Fowler, Assistant Planner Robin L. Roberts, City Clerk APPROVAL OF AGENDA Motion by Campbell, second by Grgas, to approve Agenda with the reversal of items 3 and 4. AYES: Grgas, Thomas, Klinger, Aguilar, Campbell NOES: None ABSENT: None ABSTAIN: None Motion Carried ORAL COMMUNICATIONS Vice Chair Thomas opened oral communications. Speakers: None. CONSENT CALENDAR 1. Approval of Planning Commission Meeting minutes from October 2, 2017. Motion by Klinger, second by Campbell, to approve items on the Consent Calendar, noting that Grgas abstained. AYES: Thomas, Klinger, Aguilar, Campbell NOES: None ABSENT: None ABSTAIN: Grgas Motion Carried SCHEDULED MATTERS 2. Reorganization of Planning Commission -Election of new Chairperson and Vice -Chair Person Motion by Klinger, second by Aguilar, to nominate former Vice -Chair Michael Thomas as Chairperson. Motion by Thomas, second by Aguilar, to nominate Commissioner Klinger as Vice -Chair. AYES: Thomas, Klinger, Aguilar, Campbell, Grgas NOES: None ABSENT: None ABSTAIN: None Motion Carried CONTINUED ITEMS There were no continued items. PUBLIC HEARINGS 4. Conditional Use Permit (CUP) 17-4 311 Main Street Applicant: Scott Levitt Request: Request for a Conditional Use Permit (CUP) 17-4 to permit a shared parking agreement for the remodel of an existing multi - tenant commercial building and expansion of a nail salon in the (MSSP) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No.17-26, APPROVING Conditional Use Pennit 17-4 with Conditions. Assistant Planner Fowler provided a comprehensive staff report. There was general discussion regarding parking concerns. Chair Thomas opened the public hearing. Scott Levitt spoke on behalf of the applicant, discussing parking concerns. Aguilar moved, second by Klinger, to adopt Resolution No. 17-26, approving Conditional Use Permit 17-4 with Conditions. AYES: Thomas, Klinger, Campbell, Aguilar, Grgas NOES: None ABSENT: None ABSTAIN: None Motion Carried City Attorney Steele noted that the ten-day appeal period starts tomorrow. NEW BUSINESS 3. Minor Use Permit (MUP) 17-12 249 16'h Street Applicant: Felipe Contreras Request: Request for a Minor Use Permit (MUP) 17-12 to allow the removal and reconstruction of a porch and addition of an accessibility ramp in the street side setback on a property that is a duplex and is nonconforming due to setbacks, parking and density in the Residential High Density (RHD -20) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No.17-25, APPROVING Minor Use Permit 17-12 with Conditions. Commissioner Grgas recused himself from the hearing and vote due to the proximity of his residence and left the meeting. Assistant Planner Fowler provided a comprehensive staff report. Chair Thomas opened the public hearing. Speakers: Seeing none, Chair Thomas closed the public hearing. Aguilar moved, second by Campbell, to adopt Resolution No.17-25, approving Minor Use Permit 17-12 with conditions. AYES: Thomas, Klinger, Campbell, Aguilar NOES: None ABSENT: None ABSTAIN: Grgas Motion Carried City Attorney Steele noted that the ten-day appeal period starts tomorrow. DIRECTOR'S REPORT Interim Director Landavazo announced that the November 20, 2017 Planning Commission meeting has been cancelled. COMMISSION CONCERNS In response to Commissioner Aguilar's questions regarding parking meters, Interim Director Landavazo indicated that there was an extension to the parking meter pilot program in City lots on Main Street with exception of the lot adjacent to the 311 Main Street property.
