Subject: RESOLUTION NO. 4841, APPROVAL OF PARCEL
MAP NO. 2000-191 (BIXBY OLD RANCH PROJECT —
RESIDENTIAL AND POLICE/COMMUNITY TV
PARCELS)
GENERAL, DESCRIPTION:
Bixby Ranch Company has previously received approval of the required land use entitlements,
including tentative tract map approval (Vesting Tentative Tract Map (VTTM) 15797) to establish
70 residential parcels and a parcel to be utilized for a City policetcommunity television facility on
property located immediately north of the Kitchell shopping center development currently under
construction as part of the Bixby Old Ranch Towne Center project.
DISCUSSION:
At the time of approval by the City Council of VTTM 15797, the parcel for City use was`
established as a 50' x130' parcel, indicated as Parcel 77 on the approved VTTM. Since that
approval, the size of the anticipated structure for the City police/community television facility has
increased over that set forth in the development agreement. In order to accommodate the increased
size of the structure and the necessary off-street parking areas, it is necessary to approve the
requested parcel map to increase the size of the City parcel from 6,500 square feet to approximately
22,651 square feet.
Approval of the Parcel Map will formally create the larger parcel for the City facilities and
readjustment the property line accordingly for the residential development. In approving the Parcel
Map, the City Council takes the following actions regarding approval of the map and easements:

Approve the Parcel Map by adopting Resolution No. 4841.
Approve the Parcel Map with the omission of signatures pursuant to Section 66436(a)3 of
the Subdivision Map Act, for certain easements within the boundary of this map, where
those interests are stated on the final parcel map, but are not shown on this map for the
following easements:
❑ Flight easement to the United States of America, recorded in Book 5149, Page 189 of
Official Records of the County of Orange.
❑ Perpetual, nonexclusive non -assignable aircraft operation, sound, air space and avigation
easement to the Military Department of the State of California, recorded as Instrument
No. 85-154248 of Official Records of the County of Orange.
o Easement recorded by deed to Old Ranch Town Center LLC, an Arizona Limited
Liability Company, recorded as Instrument No. 00-370715 of Official Records of the
County of Orange.
o Easement recorded by deed to Old Ranch Town Center LLC, an Arizona Limited
Liability Company, and Target Corporation, a Minnesota Corporation, recorded as
Instrument No. 00-370717 of Official Records of the County of Orange.
In accordance with the provisions of Government Code § 66474. 1, the determination to approve
a final parcel map is a ministerial action and "A legislative body shall not deny approval of a
final or parcel map if it has previously approved a tentative map for the proposed subdivision and
if it finds that the final or parcel map is in substantial compliance with the previously approved
tentative map". In this case, the Parcel Map is in substantial compliance with the previously
approved tentative trap for the Centex homes development. The number of residential lots and
the configuration of those lots are not changed by the subject parcel map. The only change is to
the configuration of the parcel identified for future City utilization as the City policelcommunity
television facility.
The Parcel Map has been reviewed and approved for compliance by the City Engineer for
compliance with all conditions of approval of the Bixby Old Ranch Towne Center development,
and it is appropriate for the City Council to approve Parcel Map 2000-191 as presented.
RECOMMENDATION:
❑ Find that Parcel Map 2000-191 is in substantial compliance with the previously approved
tentative map.
o Adopt Resolution No. 4841, approving Parcel Map 2000-191.
❑ Instruct the City Engineer and City Clerk to execute said Parcel Map, upon final approval
as to accuracy and compliance with all required Subdivision Map Act requirements by
the County of Orange Public Facilities & Resources Department.
