SUBJECT: Notice of Completion for Westminster Avenue Rehabilitation
Project CIP No. ST1610 and CIP No. ST1509
SUMMARY OF REQUEST:
That the City Council adopt a Resolution:
1. Accepting the combined Westminster Avenue Rehabilitation Project by All
American Asphalt in the total amount of $817,822.83, including (a) the
Westminster Avenue Pavement Rehabilitation Project CIP NO. ST1610 (Task 1)
in the amount of $605,679.83; and (b) the Westminster Avenue Landscape
Median Rehabilitation Project CIP No. ST1509 in the amount of $212,143.00;
2. Direct the City Clerk to file a "Notice of Completion" with the Orange
County Clerk -Recorder within ten (10) days from the date of acceptance and to
release retention in the amount of $30,283.99 35 days following the filing of the
Notice of Completion for the Westminster Avenue Pavement Rehabilitation
Project CIP No. ST1610; and
3. Direct the City Clerk to file a "Notice of Completion" with the Orange
County Clerk -Recorder within ten (10) days from the date of acceptance and to
release retention in the amount of $10,607.15 35 days following the filing of the
Notice of Completion for the Westminster Avenue Landscape Median
Improvement Project CIP No. ST1509.
BACKGROUND AND ANALYSIS:
At the May 8, 2017 City Council meeting, the City Council awarded a public
works agreement to All American Asphalt (Contractor) for the combined project
of the Westminster Avenue Rehabilitation Project CIP No. 1610 and CIP No.
ST1509 (Project) in the total amount of $1,053,170. The work for the Project was
grouped into two tasks: Westminster Avenue Pavement Rehabilitation Project
CIP No. ST1610 (Task 1) and Westminster Avenue Landscape Median
Improvement Project CIP NO. ST1509 (Task 2). The table below presents the

Task 1, located along Westminster Avenue between the west City limit and Seal
Beach Boulevard, was limited to the rehabilitation of failed pavement sections,
cold mill, and pavement overlay. Task 2, located along Westminster Avenue
between the west City limit and Seal Beach Boulevard, consisted of soil
preparation, landscaping, and irrigation improvements to the existing median
planting areas. During construction, actual quantities of materials were installed
throughout the project.
The Project is now complete to the satisfaction of the City Engineer. The Project
was inspected and it meets all standards and requirements within the Project
specifications. It is requested to formally accept Task 1 and Task 2 and file a
notice of completion with the Orange County Clerk -Recorder for each task
individually.
ENVIRONMENTAL IMPACT:
This Project complies with all requirements of the California Environmental
Quality Act (CEQA) and is categorically exempt under section 15301 class 1
subsections (c) and (h) of the CEQA Guidelines.
LEGAL ANALYSIS:
The City Attorney has reviewed and approved as to form.
FINANCIAL IMPACT:
Task 1:
At the December 14, 2015 City Council Meeting, council approved Cooperative
Agreement No. C-5-3633 with Orange County Transportation Authority (OCTA),
awarding up to $500,000.00 in Federal Regional Surface Transportation Program
funds to be utilized for the Westminster Avenue Rehabilitation Project CIP No.
ST1610. This grant required that the City provide a minimum of fifty percent
(50%) of the Construction Phase costs in local matching funds.
The approved FY 2015/16 Budget identified $200,000 of State Gas Tax Funds,
$300,000 of Measure M2 Funds, and $500,000 of City Wide Grants Funds for
construction of the Project. All Design plans were prepared in-house, except
Signing and Striping plans. The table below presents the breakdown of expenses

The total amount to be paid to All American Asphalt for construction is
$605,679.83.
The total Construction Phase (excluding Design) cost is $665,713.58, of which a
minimum of fifty percent (50%) is required to be matched by local funds in
accordance with the terms of Cooperative Agreement No. C-5-3633. Below is a

Task 2:
The approved FY 2016/17 Budget identified $119,000 of Measure M2 Funds and
$122,000 of Community Facilities District Funds totaling to $241,000 for design
and construction of the Project. The table below presents the breakdown of
expenses for the Project:

$212,143.00. All remaining funds will be returned to Community Facilities District
Funds.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
ACCEPTING COMPLETION OF THE WESTMINSTER AVENUE
REHABILITATION PROJECT CIP NO. ST1610 AND CIP NO. ST1509
AND DIRECTING THE FILING OF A NOTICE OF COMPLETION FOR
EACH TASK 1 AND TASK 2 OF THE PROJECT
THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE
Section 1. On or about May 8, 2017, the City Council awarded a construction
contract to All American Asphalt for a combined Project in the total amount of
$1,053,170 and consisting of (i) the Westminster Avenue Rehabilitation Project CIP
NO. ST1610 (Task 1) in an amount not to exceed $815,527.00; and (ii) the
Westminster Avenue Landscape Median Improvement Project CIP No. ST1509, in
an amount not to exceed $237,643.00.
Section 2. The City accepts the completion of the combined Westminster Avenue
Rehabilitation Project in the total amount of $817,822.83 for the work performed by
All American Asphalt on the Project, including (i) the work performed on the
Westminster Avenue Pavement Rehabilitation Project CIP No. ST1610 (Task 1) in
the amount of $605,679.83; and (ii) the work performed on Westminster Avenue
Landscape Median Improvement Project CIP No. ST1509 (Task 2) in the amount of
$212,143.00.
Section 3. The City Clerk is hereby directed to file a "Notice of Completion" for the
Project with the Orange County Clerk -Recorder within ten (10) days of the date of
this resolution, and to release the retention of $30,925.99 35 days following the filing
of the Notice of Completion for the Westminster Avenue Rehabilitation Project CIP
No. ST1610 (Task 1).
Section 4. The City Clerk is hereby directed to file a "Notice of Completion" for the
Project with the Orange County Clerk -Recorder within ten (10) days of the date of
this resolution, and to release the retention of $10,607.15 35 days following the filing
of the Notice of Completion for the Westminster Avenue Landscape Median
Improvement Project CIP No. ST1509 (Task 2).
