Item C. Local Hazard Mitigation Plan:
We have used PlaceWorks in the past? No however the project manager worked for another company
and has worked with the City of Seal Beach previously.
The grant funds are not yet received? CalOES will disburse the funds (from FEMA) upon completion of
project milestones. We will pay the contractor, then receive reimbursement from CalOES. We met
with CaIOES some time ago and discussed payments, timekeeping, "in- kind" contributions
and disbursements. This is a cost - neutral project, with staff time being our "in- kind" contribution to
the grant effort.
Will the General Plan Safety Element include looking at Sea Level Rise? (I have a resident who is
very concerned that the city beginning planning for this). This is a community- driven process, so all
input from the community will be considered. In short, a committee of City staff, community
stakeholders and others will receive all input and set priorities. Additionally, the City is preparing a
Sea Level Rise Analysis as part of the development of a Local Coastal Plan utilizing grant funding
received from the Coastal Commission. Duplication of these efforts would not provide any increased
benefit to the City so an additional Sea Level Rise Analysis does not need to be conducted as part of
this project scope. Results and data from the Sea Level Rise Analysis will be made available to the
consultant working on the Local Hazard Mitigation Plan so that all documents refer to and work with
each other.
Item D. River's End:
Why are hours listed in the previous contract but they are not in new lease? Aside from the lease
agreement, this location is regulated by a Conditional Use Permit (CUP) for alcohol sales which
identifies hours of operation. Any change to the hours of operation would require approval from the
Planning Commission after a public hearing.
Old lease stated that tenant had to clean restrooms. Who is responsible for daily cleaning now? When
the space was initially leased there was no interior bathroom. Over the course of the lease a
permitted bathroom was added to the facility. Over the last several years the care of the public
restrooms has declined significantly and items in disrepair were not reported to the City. Additionally,
there were also times when the bathrooms were not unlocked. Based upon history, the City has now
taken over the cleaning responsibilities which have been absorbed into the current contract.
Are the first 4 months with no rent payment meant to offset the tenant paying for a city improvement?
How did previous tenant report gross receipts to the City? Why did it not pay in 2013 (and some of '14)?
The percentage rents were not being reported by nor asked for from the new property manager. This
oversight occurred during the transfer from one property manager to a new property manager.
What does phrase that it will be operated "primarily as a restaurant" mean exactly?
I also have concern about the phrase "reasonably acceptable to the city' in regard to special events. All
special events will go through the City's regular SE process, no exceptions.
Which events would city be asked to "waive or minimize parking costs for such special events "? This
would be determined on an event by event basis based upon the application submitted.
What would be the cost to the city for such parking concessions? The lost revenue, if granted, would
be dependent upon each application.
The restaurant presently has a swamp cooler? No heat? The City is upgrading to an HVAC system? We
will be starting our compressive facility assessment this month. As part of this evaluation, the
architectural team will perform a thorough assessment of the current HVAC equipment in place. The
current agreement is to replace "like for like" and therefore if there is only a swamp cooler with no
separate heating system then the work plan would be modified to reflect this actual field condition.
Deposit is equal to one month's rent. Is this standard?
If the tenant expanded the building or extended the hours of operation, could the lease change? Aside
from the lease agreement, expanding the building would require approval from the Coastal
Commission. Extending the hours of operation would require an amendment of the existing CUP after
a public hearing before the Planning Commission.
Item E. Dissolution of Countywide Public Financing Authority:
What were we paying per year on this loan? The final payment of $120,000 for this loan was made in
2011.
Item F. Emergency Water Main Repair:
Should this have come to Council for approval within 7 days of the emergency? Since this water main
break occurred along a water transmission main critical for conveying water from our water supply
well facilities (northern portions of our city) to the southern portions of the city, it was imperative
that repairs start immediately upon discovery of the leak.
The Council was notified of the emergency the day it occurred (Friday, December 8`h) and provided
with ongoing updates regarding the urgent need to hire and mobilize a contractor to be onsite that
same day to commence emergency work.
Item I. Pier Improvement Project :
Will the "plans and specifications" that we are approving be presented to us before approval? Staff will
provide an overview of the bid package at tonight's meeting. However, as stated in the staff report,
the actual plans and specifications are available for review in the Public Works Department (which has
been the City's standard practice for these types of Council items).
