SUBJECT: Aquatic Center Update
SUMMARY OF REQUEST:
That the City Council approve Resolution No. 6819 authorizing the City Manager
to begin exploration of a potential lease agreement with the United States Navy
for use of real property at the Naval Weapons Station Seal Beach for a new
swimming pool, and authorize the City Manager to issue payment of $70,000 to
Navy real estate division for the cost of the Navy's administrative fees incurred.
BACKGROUND AND ANALYSIS:
The City of Seal Beach currently operates and maintains the public swimming
pool located at McGaugh Elementary campus at 1698 Bolsa Avenue. The facility,
which was built in 1964, is currently used to host City programs such as swim
lessons, water aerobics and adult lap swim. At this time, the pool has reached its
useful life and longer meets current health codes and is in need of replacement.
In December 2014, the City entered into a professional services agreement with
a design team to complete a feasibility study and preliminary design work for a
new aquatics center. The design team was tasked with performing an extensive
public outreach program to identify the preferred site and desired features for a
new facility. At the conclusion of the community outreach portion of the study,
there were two sites identified as possible sites for the future home of a new
pool. The sites identified were the Naval Weapons Station and the McGaugh
Campus (the current location of the City's swimming pool). The City's design
team has determined that both sites provide adequate size. However, both sites
also present unique challenges. During the City's outreach efforts, the
community identified the Naval Weapons Station as the preferred site.
City staff has worked closely with representatives of both sites to further develop
site plans. In February 2018, the City received notification from the Navy that the
City's initial request for land use was approved for the operation, installation and
maintenance of a public swimming pool, subject to environmental review and
other administrative tasks. With this approval, the City and Navy can now begin

to explore the feasibility of the project and negotiate a long term agreement that
would allow the City to place a public swimming pool on Navy property. The
prerequisite documents for the agreement will include environmental, survey, and
appraisal work. Under 10 U.S.C. 2695 the government is authorized to recover
its administrative fees incurred for this type of real estate use. The funding the
government is requiring for this work to move forward is $70,000 with any funding
not expended being returned to the City. These funds do not include the cost of
the land use or any future construction costs. This approval does not commit the
City or the Navy to moving forward with a project; it only allows the parties to
start the necessary environmental reviews and planning work.
The area that the Navy has identified on Base property is off Seal Beach
Boulevard between the submarine memorial and the credit union across from the
Seal Beach Police Station. The center would have a separate entrance off of
Seal Beach Boulevard and not require patrons to enter through the main gate.
The area identified is between 8 and 9 acres and provides ample space for a
pool and all of the necessary support features including parking.
ENVIRONMENTAL IMPACT:
There is no environmental impact related to this item at this time, as this request
would help fund the environmental study necessary to move forward.
LEGAL ANALYSIS:
No legal analysis is required for this item at this time however legal will review
and approve any agreements related to this item in the future.
FINANCIAL IMPACT:
Approval of this item will not necessitate a budget amendment, and will authorize
the City Manager to make a payment of $70,000 to the Navy from the Swimming
Pool Project CIP BG0904. There will be additional costs for staff and consultant
work.
RECOMMENDATION:
That the City Council approve Resolution No. 6819 authorizing the City Manager
to begin exploration of a potential lease agreement with the United States Navy
for use of real property at the Naval Weapons Station Seal Beach for a new
swimming pool, and authorize the City Manager to issue payment of $70,000 to
Navy real estate division to recover administrative fees incurred.

A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
AUTHORIZING THE CITY MANAGER TO BEGIN
DEVELOPEMNT OF A LEASE AGREEMENT BETWEEN THE
UNITED STATES NAVY AND CITY OF SEAL BEACH FOR
USE OF REAL PROPERTY AT THE NAVAL WEAPONS
STATION AND AUTHORIZE THE CITY MANAGER TO ISSUE
A PAYMENT OF $70,000 IN RECOVERABLE COSTS TO THE
NAVY
WHEREAS, the City of Seal Beach has identified the Naval Weapons Station as
the most desirable location for an aquatics center.
WHEREAS, the City desires to enter into real property negotiations with the
Navy to develop a long term agreement for placement of an aquatics center on
the Naval Weapons Station Seal Beach.
WHEREAS, the government is authorized under 10 U.S.C. 2695 to recover its
administrative fees incurred for real estate use.
NOW THEREFORE THE SEAL BEACH CITY COUNCIL DOES HEREBY
RESOLVE:
Section 1. That the Seal Beach City Council authorizes the City Manager to
enter into real property negotiation with Navy for the purpose of placing an
aquatic center on the Naval Weapons Station Seal Beach.
Section 2. That the City Council authorizes the City Manager to make a
payment of $70,000 from the New Swimming Pool Project CIP BG0904 fund to
the Navy to recover its administrative fees incurred for real estate use
