HomeMy WebLinkAboutItem KJune 26, 2000 STAFF REPORT To: Mayor Campbell and Members of the City Council Attention: Keith R Till, City Manager From: Lee Whittenberg, Director of Development Services Subject: ACCEPTANCE OF OFFERS OF DEDICATION (AREA "A" AND "B "), APPROVAL OF DECLARATION OF AMENDED FLOOD PLAIN EASEMENT LEGAL DESCRIPTION (AREA "C "), AND RECEIPT OF NOTICE OF PROPOSED ASSIGNMENT (AREA "A" AND "B ") — BIXBY OLD RANCH PROJECT SUMMARY OF REQUEST Accept offers of dedication; approve declaration of amended flood plain easement; authorize City Manager to execute said documents on behalf of the City of Seal Beach. Receive and File Notice of Proposed Assignment. DISCUSSION Offers of Dedication — Grant Deeds: As part of the approvals for the Bixby Old Ranch Towne Center project relating to Areas A and B, the acceptance of two separate "offers of dedication" by grant deeds are appropriate to transfer fee title to the City of Seal Beach of he "greenbelt areas" along Lampson Avenue and Seal Beach Boulevard. These areas of dedication are to be dedicated to the City for open space buffer area and trail systems for pedestrians and bicyclists in accordance with the terms and conditions of the approved Development Agreement. Acceptance of the offers of dedication and recordation of the documents will transfer fee title of the subject areas to the City. A landscape maintenance district is be formalized to require the adjoining private properties to landscape and maintain these areas in accordance with the provisions of the Development Agreement and the conceptual landscape plans - previously reviewed by the Planting Commission and City Council. Area "A" is the 26 -acre shopping center site on the east side of Seal Beach Boulevard, between St. Cloud and Rossmoor Center Way. Area `B" is the property located between the northbound 1405 Freeway off -ramp, Sea] Beach Boulevard and Lampson Avenue. Declaration ofAmended Flood Plain Easement Legal Description: The document will revise the legal description for the existing flood plain easement on the Bixby Old Ranch Golf Course to reflect the new flood plain easement boundaries established as part of the reconfiguration and regrading of the golf course property. The new flood plain easement is totally located on the new golf course property (Area "C "). The "Declaration of Amended Flood Plain Easement" is provided as Attachment 3. Notice of Proposed Assignment: This document informs the City of the transfer of title of Development Area "A" and `B" from Bixby Ranch Company to Old Ranch Town Center, L.L.C., an Arizona limited liability company, in accordance with the appropriate provisions of the Development Agreement. No action is necessary regarding this document and is appropriate to receive and file. Old Ranch Town Center L.L.C. is the master developer of all of the commercial developments approved for the Bixby Old Ranch Towne Center area with the exceptions of the Marriott Brighton Gardens Senior Care Facility and the County Inn by Ayres hotel development. FISCAL IMPACT None. Actions necessary to clear title to Development Areas "A" and `B" for the commercial developments previously approved by the Planning Commission and City Council. RECOMMENDATION Accept offers of dedication; approve declaration of amended flood plain easement; authorize City Manager to execute said documents on behalf of the City of Sea] Beach. Bixby, Founder a 1875 -1952 Ron Bradshaw is out of town but he has asked me to deliver you the following documents: 1. Declaration of Amended Flood Plain Easement Leal Description. This document retains the original Flood Plain Easement on the property and only changes the legal description. 2. Notice of Proposed Assignment. This is a Notice to the City of Seal Beach indicating that Bixby intends to transfer the Kitchell property on July 12, 2000. The assignment and assumption agreement from Kitchell will be forwarded in a few days. 3. Grant Deed. This Grant Deed conveys to the City the landscaped areas on the 13 acre and 25 acre parcels. Several of the legal descriptions contain blanks for insertion of recording information on the Kitchell /Target lot line adjustment. As the lot line adjustment will be recorded in the next day or two, we will be able to insert that information shortly. If any of these documents has been misdirected to you, please call my office as soon as possible and I will send them to the proper person at the City.
