SUBJECT: Orange County Fire Authority Renewal of Services
SUMMARY OF REQUEST:
That Council approve and execute the attached Fire Services and Emergency Medical Services
Agreement with the Orange County Fire Authority.
BACKGROUND:
Since becoming a member of the OCFA, the City and OCFA have executed an agreement for
fire services and emergency medical services. However, the amendments to the Joint Powers
Agreement necessitate changes to the service agreements with all member cities. The changes
brought about by the Amended Joint Powers agreement were first addressed in the service
agreements approved in January and March 2000 for OCFA's two new cities - Laguna Woods
and Rancho Santa Margarita.
Using the agreements for the two new cities as models, OCFA staff and General Counsel drafted
new services agreements for all member agencies. Drafts were first transmitted to the City
Manager Technical Advisory Committee in early February for review and comment. All OCFA
member agencies received draft copies of the agreements for review in March and OCFA staff
presented it on March 22, 2000 for further review and comment. An updated draft was
circulated for review in April incorporating comments from the workshop and other comments
from member agencies. On May 11, 2000, OCFA staff met with the City manager Technical
advisory committee for final review and comment on the proposed service agreements prior to
transmittal to the OCFA Board of Directors for conceptual approval. Finally, on May 25, 2000,
the OCFA Board of directors unanimously approved the agreements in concept and directed its
staff to distribute the documents to member cities for approval by their City Councils.
Attached to this staff report is the Agreement and the existing leases for the two city -owned fire
stations. Consistent with the OCFA's regional approach to service delivery, the proposed new
service agreements are standardized exempt for those few terms that differentiate between the
structural fire fund cities, the cash contact cities and the county. Key changes from the existing
service agreements include provisions for:

• Ten -year membership terms, consistent with the terms of the Amended Joint Powers
Agreement.
• Fire Chief to meet and confer with the City Manager prior to making any changes to
assigned engine or truck companies.
• Resolution of any disagreements over any proposed changes to assigned engine or truck
companies and appeal to the Board of directors if Fire Chief and City Manager fail to
reach agreement.
• SFF and redevelopment revenues to continue to pass through to the OCFA in the event
of any member city annexation of unincorporated territory, unless otherwise agreed to
by the parties. This is consistent with the OCFA Board of Directors' policy adopted on
March 23. 2000.
• Cash contact charges and caps on annual adjustments consistent with the terms of the
Amended Joint Powers Agreement.
FISCAL IMPACT:
Annual increases in cash contract charges (capped at 3.5% for the first fire years and 4% for the
last five years of the signed agreement are consistent with the Amended Joint Powers Agreement
adopted by the OCFA Board of Directors on September 23, 1999 and approved by all OCFA
jurisdictions.
RECOMMENDATION:
That the City Council approve the attached Fire Services and Emergency Medical Services
Agreement with the Orange County Fire Authority and authorize execution of contract
documents.
