10 The Seal Beach Police Management Association hereby petitions the Personnel Director
11 and the City Council for recognition as the bargaining agent for all Police Sergeants, Lieutenants
12 and Captains employed by the City of Seal Beach. This Petition is filed pursuant to the Seal
13 Beach City Code, section 16A-9 and the Meyers-Milias-Brown Act. The unit designated above
14 includes:only peace officer supervisory employees of the Police Department. The
15 aforementioned proposed unit is the largest unit consistent with the provisions of City Code
16 section 16A-9(e). The recognition of this unit and employee organization will assure employees
17 the greatest freedom in the exercise of rights granted under the Seal Beach City Code, section
10 I6A-9 and the Meyers-Milias-Brown Act.
19 The proposed bargaining unit and Recognition of the employee organization will not
20 have a negative effect on the effective operation of the public service and sound employee
21 relations. The employees intended to be included within the unit have a community of interest.
22 The new organization will be known as the Seal Beach Police Management Association,
23 (hereinafter"SBPMA") an unincorporated association, under the laws of the State of California.
24 The mailing address of the Association is: 7752 Marisa St. Garden Grove, CA 92641 (714-894-
25 5056. The officers of the SBPMA are President Bob Mullins, Vice President Dean Zanone,
26 Secretary/Treasurer Michael Vasquez.
27 Attached hereto as Exhibit 1, is a certified, true copy of the constitution and bylaws of
28 Seal Beach Police Management Association.

• 1 The Seal Beach Police Management Association has as one of its primary purposes the
2 representation of the supervisory sworn employees of the Seal Beach Police Department in their
3 relations.with the City pursuant to the Meyers-Milias-Brown Act, California Government Code
4 section 3500 et sec.. The Seal Beach Police Management Association has no restrictions, based
5 on race, age, sex, color, creed, national origin, pregnancy, marital status or any other protected
6 class, on the eligibility for membership in the organization.
Evidence of employee membership in the Seal Beach Police Management Association is
a attached hereto as Exhibit 2.
9 By the signature below, the Seal Beach Police Management Association agrees to the
10 provisions Seal Beach City Code section 16-A9.

14 The Seal Beach Police Management Association hereby requests a waiver of the 15% of
15 the total full-time City employees requirement set for the in Seal Beach City Code section 16A-
16 9(b)because the restriction of this unit to supervisory employees, as well as the right of Peace
17 officers to be included in a separate bargaining unit pursuant to California Government code §
18 3508 which states in pertinent part:
19 [T]he governing body may not prohibit the right of its employees who are full-
20 time "peace officers" as that term is defined in Chapter 4.5 (commencing with Section
21 830)of Title 3 of Part 2 of the Penal Code,to join or participate in employee
22 organizations which are composed solely of such peace officers, which concern
23 themselves solely and exclusively with the wages, hours, working conditions, welfare
24 programs, and advancement of the academic and vocational training in furtherance of the
25 police profession, and which are not subordinate to any other organization.
26 Attached hereto is the showing of interest of at least 50% of the proposed bargaining unit. The
2'1 showing of interest is in the form of a payroll authorization cards for those employees.

Based on the aforementioned, we respectfully petition for recognition, inasmuch as the
2 Seal Beach Police Management Association has met the requirements of statute and City Code.

matters related to labor relations with the City of Seal Beach.
I hereby verify that I am within the classifications represented
by the Association. I also request that the City of Seal Beach
make payroll deductions from my salary effective upon recognition
