Consideration of"Tentative Order No. 99-56 and Approval of Comment Letter:
The California Regional Water Quality Control Board (RWQCB), Santa Ana Region, is proposing
to issue Order No. 99-56 regarding "Waste Discharge Requirements for the U.S. Army Corps of
Engineers—Outer Anaheim Bay Maintenance Dredging Project", and is requesting comments from
the City of Seal Beach prior to the RWCCB consideration of the proposed order on August 20,
1999. The RWCQB is requesting comments prior to July 30 so that those comments could be
incorporated into the formulation of the final draft permit.

As part of its continuing program or regular maintenance dredging, the U.S. Army Corps of
Engineers("Corps") proposes to remove approximately 260,000 cubic yards of sediments from the
Outer Anaheim Bay approach channel and outer and inner harbors, which are sheltered by a jetty on
the north and south side. Anaheim Bay is the port entrance to the Seal Beach U.S. Naval Weapons
Station, and the purpose of the dredging is to maintain draft depths for U.S. Navy vessels. Dredging
is scheduled to occur between September 20, 1999 and February 2,2000.
The proposed waste discharge requirements will regulate the impacts of both the dredging activities
within the bay and the beach replenishment activities. Because the material dredged from within
the breakwater (inner and outer harbors) is anticipated to contain higher amounts of silts and clays
(not suitable for beach replenishment), it will be transported to the EPA-authorized LA-2 offshore
disposal site, which is outside of State jurisdictional waters. As such, discharges to this site will not
be regulated under the proposed waste discharge requirements.
The requirements contained in the proposed order are intended to protect the beneficial uses of
Outer Anaheim Bay and the nearshore zone of the Pacific Ocean. The Basin Plan identifies
Anaheim Bay as a potential toxic hot spot for pesticides, but the discharger has conducted testing of
the sediments proposed for dredging in coordination with the EPA and has determined that the
dredged material does not contain toxic substances in concentrations harmful to human or marine
life.
Response Letter from City of Seal Beach re: RWOCB Tentative Order 99-56:
The RWQCB is requesting comments on the subject document by July 30, 1999. The EQCB would
not have considered this matter until July 28, with the City Council considering the matter on
August 9, after the requested comment period has ended. For that reason, staff has brought this
matter directly to the City Council for consideration.
The draft City comment letter of is provided as Attachment 1.

during working hours at City Hall, 211 Eighth Street. Hours at City Hall are 7:00 AM to 6:00 PM,

Dear Ms. Schneider:
The City of Seal Beach has reviewed the request from the Regional Water Quality
Control Board relative to "Order No. 99-56 regarding Tentative Waste Discharge
Requirements for the U.S. Army Corps of Engineers - Outer Anaheim Bay Maintenance
Dredging Project". Upon a review of the document by the Director of Development
Services and the City Engineer, the City has the following general and specific comments.
The City of Seal Beach strongly supports the continued activities of the Army
Corps of Engineers relative to beach nourishment activities in the Surfside-Sunset Beach
areas of Orange County, and in particular the continued capability to provide the required
beach nourishment material to adequately protect on-shore facilities and structures, and to
maintain the recreational opportunities afforded by the subject beach areas. The proposed
project is seen by our City as a positive action in further protecting valuable coastal
resources in the Southern California region.
Our City strongly supports the immediate implementation of Order No 99-56
regarding "Outer Anaheim Bay Maintenance Dredging and Beach Replenishment at Seal
Beach/Sunset Beach "and the proposed "Monitoring and Reporting Program No. 99-56",
as set forth in your information packet dated July 16, 1999. This maintenance dredging
and beach replenishment program is considered by our City to be a practical and effective

solution to the immediate problems existing in the Outer and Inner Harbors of Anaheim
Bay, including the approach channel, and in the Surfside-Sunset Beach areas. Any delay
in implementation may result in the potential for significant adverse impacts to on-shore
structures and facilities during the upcoming winter storm season. A "No Action"
alternative regarding the proposed beach nourishment portions of the project is not
acceptable to our City. This alternative would have the potential to consign substantial
public and private improvements; property values in Surfside alone are in excess of $
77,000,000.00, to almost certain damage during the upcoming winter storm season.
The subject document discusses the proposed waste discharge requirements,
indicating they should be adequate to protect the beneficial uses of the receiving waters, as
set forth below:
• navigation • water contact recreation
• non-contact water recreation • wildlife habitat
• rare, threatened and endangered species habitat • spawning reproduction
• development of fish habitat • marine habitat
• preservation of habitats of special significance • shellfish harvesting
• industrial service supply • commercial and sport fishing
Based on the review by our staff, we concur with those determinations, based on
the implementation of all monitoring conditions as set forth in the "Monitoring and
Reporting Program No. 99-56".
In reviewing the documentation provided, it is unclear as to the quantity of
dredged sand material proposed for deposition at Surfside. It appears the total amount of
dredged material, including material from the Outer and Inner Harbor areas, is 260,000
cubic yards. It would extremely helpful to specify the anticipated amount of sand to be
deposited at Surfside. This will allow the City and the adjoining residents within the
Surfside community to have a better understanding of the scope of the nourishment
project.
The provided documentation also indicates ". . the discharger has conducted
testing of the sediments proposed for dredging in coordination with EPA and has
determined that the dredged material does not contain toxic substances in concentrations
harmful to human or marine life." The City requests a copy of this documentation be
provided to Mr. Lee Whittenberg, Director of Development Services, for the files of the
City.
The City Council considered and discussed this matter on July 26, 1999. The City
Council authorized the Mayor to sign this letter indicating the official comments of the
City of Seal Beach regarding Order No. 99-56 regarding "Tentative Waste Discharge

Enclosed is a copy of tentative Order No. 99-56 for your review. This order contains waste
discharge requirements for the discharge of wastes associated with the dredging of sediments from
the approach channel, outer harbor, and inner harbor of Outer Anaheim Bay at the Seal Beach
Naval Weapons Station,as well as the deposition of dredged sand onto the adjacent Sunset-Surfside
Beach.
These waste discharge requirements are scheduled for consideration by the Regional Board at the
August 20, 1999 meeting. Although comments will be accepted by the Board up to and during the
August 20, 1999 meeting, receipt of your comments by July 30, 1999 would be appreciated so that
they may be used in the formulation of the final draft permit which will be sent to the Board for
their review prior to the meeting.

DISCUSSION:
As part of its continuing program of regular maintenance dredging, the U.S. Army Corps of
Engineers (Corps) proposes to remove approximately 260,000 cubic yards of sediments from the
Outer Anaheim Bay approach channel and outer and inner harbors,which are sheltered by a jetty on
the north and south side. Anaheim Bay is the port entrance to the Seal Beach U.S. Naval Weapons
Station, and the purpose of the dredging is to maintain draft depths for U.S. Navy vessels. Dredging
is scheduled to occur between September 20. 1999 and February 2.2000.
At the Surfside/Sunset Beach adjacent to the south jetty, the Corps has conducted an intermittent
"beach nourishment" program since the 1970s.using an offshore sand source area. This activity and
the Anaheim Bay dredging were both regulated by separate National Pollutant Discharge
Elimination System (NPDES) permits until 1993, when both permits expired. The Corps' pending
resumption of Anaheim Bay dredging and beach replenishment now coincide because they propose
to pump dredged sand from the approach channel, transport it through a conduit routed over and
outside the south jetty, and deposit it onto the beach out of the surf zone. The sand grain size is
reported to be compatible with that of the beach. The sand slurry will then be graded to match the
existing profile of the beach. Discharges of some of the deposited sand and runoff(tailwater) to the
surf zone will occur, creating the potential for turbidity in the receiving water.
The proposed waste discharge requirements will regulate the impacts of both the dredging activities
within the bay and beach replenishment activities. Because the material dredged from within the
breakwater (inner and outer harbors) is anticipated to contain much higher amounts of silts and
clays (not suitable for beach replenishment), it will be transported to the EPA-authorized LA-2
offshore disposal site, which is outside of State jurisdictional waters. As such, discharges to this
site will not be regulated under the proposed waste discharge requirements.
Dredging operations will be conducted with either a hopper dredge or a hydraulic cutterhead dredge.
The dredging activities are expected to create some degree of turbidity and may depress ambient
dissolved oxygen. During previous beach replenishment events,turbidity from flowing return water
(tailwater) and from general sediment introduction has discolored the nearshore water. The
proposed order prescribes limits on the degree to which the dredging and beach replenishment
activities can cause changes in turbidity and dissolved oxygen, relative to ambient conditions.

3. J The ..ve-referenced activities are expected to create some degree of turbidity and may
depress ambient dissolved oxygen in the receiving waters. Measures must be taken to
prevent these activities from depressing ambient levels of dissolved oxygen or from
producing significant amounts of turbidity. If turbidity cannot be controlled by the method
of dredging, silt curtains with boom devices, or other similar controls, will need to be
deployed to confine the turbidity within the project area.
4. A Water Quality Control Plan (Basin Plan) became effective on January 24, 1995. The
Basin Plan identifies water quality objectives and beneficial uses of waters in the Santa Ana
Region. The requirements contained in this order are necessary to implement the Basin
Plan.

7. The discharger has conducted testing of the sediments proposed for dredging, in
coordination with the EPA, and has determined that the dredged material should not harm
human or marine life.
8. The issuance of these waste discharge requirements is exempt from California
Environmental Quality Act (Public Resources Code, Section 21100 et seq.) in accordance
with Section 15304(g), Chapter 3, Title 14, California Code of Regulations, because the
activity being regulated is a maintenance dredging activity with spoil deposited in areas
approved by applicable agencies.
9. This order constitutes State of California review and permitting of the operation pursuant to
CWA Section 401 (33 USC 1341).
10. The Board has notified the discharger and other interested agencies and persons of its
intent to prescribe waste discharge requirements for the discharge and has provided them
with an opportunity for public hearing and opportunity to submit their written views and
recommendations.
11. The Board, in a public meeting, heard and considered all comments pertaining to the
discharge.

IT IS HEREBY ORDERED that the discharger shall comply with the following:
A. Discharge Specifications
1. No dredging or beach replenishment shall cause a nuisance or pollution as defined in
Section 13050 of the California Water Code.
2. The discharge of any substance in concentrations toxic to animal or plant life is prohibited.
3. No dredging or beach replenishment activity shall cause the background natural turbidity
(in Natural Turbidity Units,NTUs) in the receiving waters to be increased by values greater
than the following at a distance of 100 feet from the activity (in the case of dredging) or
outside the surf zone(in the case of beach replenishment):

4. No activity associated with the dredging project nor deposition of sediments on the beach
shall cause the dissolved oxygen in the receiving waters to be depressed below 5.0 mg/1.
When natural dissolved oxygen concentrations are less than 5.0 mg/1, the discharge shall
not cause a further depression.
B. Receiving Water Limitations
No activity associated with the dredging project nor deposition of sediments on the beach
shall cause a violation of any applicable water quality standard for receiving waters
adopted by the Regional Board or the State Water Resources Control Board, as required
by the Federal Water Pollution Control Act and regulations adopted thereunder. If more
stringent applicable standards are promulgated or approved pursuant to Section 303 of the
Federal Water Pollution Control Act, or amendments thereto, the Board may revise this
order in accordance with such more stringent standards.
C. Provisions
1. The discharger shall comply with Monitoring and Reporting Program No. 99-56 as issued
by the Executive Officer. The monitoring and reporting program may be revised at any
time during the term of this order, and may include a reduction or an increase in the
number of parameters to be monitored, the frequency of monitoring, or the number and
size of samples collected.

2. The discharger shall report any discharge of waste that may endanger health or the
environment. Such information shall be provided to the Executive Officer (909-782-
4130) and the Office of Emergency Services (800-852-7550), if appropriate, as soon as
the discharger becomes aware of the circumstances. A written report shall be submitted
within five (5) days of the time the discharger becomes aware of the circumstances and
shall contain a description of the discharge and its cause; the period of discharge,
including exact dates and times and, if the discharge has not been corrected, the
anticipated time to reduce, eliminate, and prevent recurrence of the discharge.
3. The discharger shall report promptly to the Board any material change in the character,
location, and/or volume of the discharge.
4. The discharger shall permit Board staff:
a. Entry upon the dredge or any premises where a discharge is located, or in which
any required records are kept;
b. Access to copy any records required to be kept under the terms and conditions of
this order:
c. To inspect monitoring equipment or records; and
d. To photograph or sample of any discharge.

5. The sampling locations, as well as the depths at which they were taken, shall be
recorded in a permanent log. Locations shall be recorded on a map.

6. The collected samples shall be analyzed for turbidity and dissolved oxygen. The
turbidity samples shall be analyzed by a certified laboratory. For dissolved oxygen.
determination shall be made onsite. In addition,once each month, a sample shall be
submitted for laboratory determination.
7. Daily, during dredging operations, visual observations shall be made for turbidity
plumes on all sides of the dredge and on all sides of moving. loaded barges/scows
within Anaheim Bay. Visual observations shall be recorded in a logbook.
8. During beach replenishment operations,visual observations shall be made on a daily
basis of the effects of discharges on receiving water quality (e.g. changes in
turbidity,turbidity plumes). Visual observations shall be recorded in a logbook.
B. Reporting
Monitoring reports shall be submitted on the 30th day of each month and shall include all
information collected in accordance with this monitoring and reporting program for the
previous month, including:
1. The estimated volume of material, in cubic yards. excavated during the previous
month. The volume placed on the beach and the volume towed away shall be
differentiated in the report. If no material is dredged during the reporting period, a
report to that effect shall be submitted in lieu of a monitoring report.
2. A copy of the log of observations, sampling locations, and depths, along with a
sampling location map. A statement regarding the use of any alternate sampling
locations shall be included in the report along with a map of alternate locations.
3. Copies of the analytical results of the tests for turbidity and dissolved oxygen. The
results of any analyses of samples taken more frequently than required shall be
reported to the Board.
4. For every item where the requirements and turbidity/dissolved oxygen objectives are
not met, the discharger shall submit a statement of the actions undertaken or
proposed which will bring the discharge into full compliance with requirements at
the earliest time and submit a timetable for correction.
All reports shall be signed by a responsible officer or duly authorized representative of the
discharger and shall be submitted under penalty of perjury.
