O INANCE NUMBER
AN ORDINANCE OF THE CITY OF SEAL BEACH,
AMENDING CHAPTER 1-B OF THE CODE OF THE CITY OF
SEAL BEACH TO PROVIDE FOR OFFICEHOLDER
ACCOUNTS, AND LIMITING CONTRIBUTIONS TO SUCH
ACCOUNTS
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Section 1B-1(e) is hereby added to the Code of the City of Seal Beach to read as
follows:
"(e) To minimize potential corruption and the appearance of corruption
caused by political campaign contributions that are perceived by the
public as being excessive, by establishing reasonable limits on the
amounts and timing of campaign contributions while still affording
candidates a meaningful opportunity to communicate with the
public and officeholders the means to communicate with their
constituents."
Section 2. Section 1B-10 of the Code of the City of Seal Beach is hereby renumbered as
Section 1B-11.
Section 3. Section 1B-10 is hereby added to the Code of the City of Seal Beach to read as
follows:
"Section 1B-10. Officeholder Accounts.
(a) Generally.
(1) Each Member of the City Council and the elected City Clerk may establish one
segregated officeholder account for expenses directly related to assisting, serving, or
communicating with constituents, or to carrying out the official duties of the elected officer,
provided contributions to such a fund and transfers from the elected officeholder's campaign
accounts do not exceed [ten thousand dollars ($10,000)] in the aggregate in any calendar year.
Expenditures from an officeholder account shall not be made in connection with, or to support or
oppose, any person's campaign for elective office in any jurisdiction or any ballot measure.
(b) Officeholder Account Contribution Limits.
(1) No person shall make, and no elected officeholder or his or her officeholder
account shall solicit or accept, a contribution or contributions to that person's officeholder
account totaling more than [two hundred fifty dollars ($250.00)] in any calendar year.

(2) Contributions to an officeholder account shall not be considered to be
campaign contributions for the purpose of this Chapter.
(c) Reporting and Recordkeeping.
Officeholder accounts are subject to the campaign disclosure, reporting, and
recordkeeping requirements of the Political Reform Act and this Chapter. Any funds remaining in
an officeholder account when the officeholder leaves office shall be turned over to the General
Fund of the City of Seal Beach within ten (10) calendar days of the date the officeholder leaves
office.
(d) Proposition 208.
In the event that the provisions of California Government Code Sections 85313(a)
and (b), as adopted by the voters as part of Proposition 208, are ordered to be enforced by a court
of competent jurisdiction, it is the intent of the City Council that the limits set forth in this Section
shall be as or more restrictive than the aggregate and individual contribution limits imposed
therein for officeholder accounts. The limits set forth in this Section shall therefore replace the
limits established in Proposition 208 for officeholder accounts."
