ESTABLISHING A WATER SERVICE CONNECTION FEE (STANDBY FEE) FPR ALL FIRE SERVICES, ESTABLISHING THE NEW STANDBY FEES FOR WATER METERS AND FIRE SERVICE CONNECTIONS AS THE MINIMUM FEE CHARGED, ESTABLISHING A REQUIREMENT FOR PAYMENT OF A METER SERVICE CONNECTION FEE (STANDBY FEE) AND WATER SERVICE RATE FOR TEMPORARY SERVICES, ABOLISHING THE GRANTING OF ANY WATER ALLOWANCES AND RESCINDING RESOLUTION NO. 3809 THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: WHEREAS, the State of California is presently experiencing drought conditions throughout the state; and WHEREAS, the Orange County Municipal Water District and the Orange County Water District are the providers of water to the City of Seal Beach and regulating agency for the extraction of ground water respectively, and because of the existing drought conditions have, in conjunction with Metropolitan Water District, implemented a strict water conservation plan, and WHEREAS, said plan includes the potential of levying costly penalty assessments against the City for each acre foot of water purchased in excess of targeted reduction quotas specified in the plan; and WHEREAS, because of the existing drought condition and water conservation efforts, revenues from the sale of water has decreased but the cost of providing the water has increased at the normal inflation rate; and WHEREAS, said increases has required the Orange County Municipal Water District and the Orange County Water District to raise their rates to purchase water and their replenishment fees respectively; and ~EREAS, the city has not raised water rates for the last four -i years, a water rate study by the city's Engineering Department was prepared and specific recommendations regarding necessary adjustments to the existing water rate schedule was made; and WHEREAS, Section 26-8 of the Code of the City of Seal Beach does provide that the City Council shall establish by resolution the minimum monthly rates for water service. The "standby fee" charge specified in the schedule above shall be charged where water is furnished through a water meter or fire service connection and shall be the minimum rate to be charged for each water meter or fire service connection. 2. Upon the date the above meter and water rates becomes effective, the granting of any water allowance is abolished and granting of te~porary connection to the water system will cease. Any connection to the water system will only be allowed with the payment of a monthly meter standby fee and the payment of charges for the consumption of water through a meter shall be assessed at the same rate charged other similar sized meter service. I 4. Upon the effective date of the above water rates all unmetered fire service connections shall have installed at the owners expense a detector meter. Any consumption of water for other than fire protection is prohibited. Upon the discovery that improper water consumption is taking place, the city will disconnect such services which will not be restored until proof is provided by the property owner that the internal plumbing has been corrected and no further improper water consumption is occurring. I I I Resolution Number ~~~ BE IT FURTHER RESOLVED that a Water System Depreciation Fund be established to be used to replace existing facilities and make required improvements to the existing water system. The fund will be comprised of all excess revenue annually realized from the sale of water and a minimum annual contribution from revenues derived from the sale of water. Excess revenue is defined as the amount of money over and above the amount of funds budgeted annually to pay all operation and maintenance expenses of the Water Department. The amount of the annual minimum contribution shall be based on 1.40 t of the total investment made by the City on the water system. Future increases or decreases in the percentage rate cited shall be determined by the City Council at such time when increases or decreases are deemed necessary. BE IT FURTHER RESOLVED that Resolution No. 3809 is hereby rescinded and that the water rates and quantities set forth above shall be effective on the 1st day of January, 1993.
