HomeMy WebLinkAboutCC Res 6873 2018-11-13RESOLUTION 6873 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING A SUBDIVISION IMPROVEMENT AGREEMENT WITH SHEA HOMES LIMITED PARTNERSHIP (FINAL MAP NO. 17425) WHEREAS, on July 9, 2012, the City Council adopted Resolution No. 6275, approving a tentative map of the proposed subdivision. The approved tentative tract map (Tentative Tract Map 17425) was for a 32 -lot subdivision, allowing 32 single family detached single family units on approximately 4.5 acres in the northern portion of the property previously known as the DWP site ( "site "); and WHEREAS, on November 9, 2015, the City Council adopted Resolution No. 6607, approving the Final Map of the proposed subdivision subject to certain conditions. In accordance with the Subdivision Map Act, the Map has been conditioned to ensure site access to the public streets, public water lines, sewer lines, storm drainage system including the WQMP, and street frontage improvements including sidewalks. Shea Homes Limited Partnership (the "Subdivider") provided improvement plans for the construction of these improvements and the plans have been approved by the Public Works Director /City Engineer; and WHEREAS, pursuant to condition 7.2.2 of Resolution No. 6607, the Subdivider is required to enter into a Subdivision Improvement Agreement. That agreement, attached as Attachment B to the staff report, ensures the construction of the specified improvements within two years from the date the City executes the agreement. Per the Subdivision Map Act, the Subdivision Improvement Agreement is secured by both performance and payment bonds, in the amount of the estimated cost of the improvements. THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The Subdivision Improvement Agreement is approved.The City Clerk is directed to record Final Map No. 17425 and the Subdivision Improvement Agreement. Section 2. The City of Seal Beach hereby approves the Professional Services Agreement ( "PSA APP ") dated November 1, 2018 between the City of Seal Beach and Anderson Penna Partners, Inc. for Construction Management and Inspection Services in the amount not to exceed $350,000 , attached hereto as Exhibit "D" and incorporated herein by this reference as though set forth in full.The City Council hereby authorizes the City Manager to execute the PSA APP. Section 3. The City Clerk shall certify to the adoption of this resolution.
