HomeMy WebLinkAboutCC Res 4223 1993-05-10 RESOLUTION ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH ADOPTING A MEASURE M DEVELOPMENT MITIGATION PROGRAM AND A MEASURE M DEVELOPMENT PHASING AND ANNUAL MONITORING PROGRAM IN COMPUANCE WITH THE CITY OF SEAL BEACH GROWTH MANAGEMENT ELEMENT AND THE COUNTYWIDE PROVISIONS OF MEASURE M'S COUNTYWIDE GROWTH MANAGEMENT PROGRAM WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, I on November 6, 1990, Orange County voters approved Measure M, the Revised Traffic Improvement and Growth Management Ordinance, which provides funding to Orange County for needed transportation improvements over a twenty year period through the impos~tion of a one-half cent retail transaction and use tax; and, portions of the monies received from the new sales tax revenue will be returned to Orange County jurisdictions for use of local and regional transportation improvements, subject to the jurisdiction's acquisition and retention of an eligible status for such Measure M revenues; and, in order to receive local street maintenance and improvement funds from the Orange County Local Transportation Authority, a jurisdiction must comply with Countywide Growth Management Program component requirements; and, I the City of Seal Beach has established a policy framework for the required Growth Managemen[ Program through the adoption of a . Growth Management Element to the City of Seal Beach General Plan; and, in conjunction with the Growth Management Element, the City of Seal Beach has established policy statements which identify traffic levels of service goals for its Measure M transportation system; and, in conjunction with the Growth Management Element, the City of Seal Beach has established policy statements which further commit to city participation in a development mitigation program which ensures that new growth is paying its share of the costs associated with that growth; and, in conjunction with the Growth Management Element, the City of Seal Beach has established policy statements which further commit to city participation in a development phasing and monitoring pre!;:".-,;,,> which ensures that transportation infrastructure is provided concurrent with new development and which provides for an annual evaluation of compliance with these programs towards the estAblished levels of service goals; and I I I I Resolution Number ~~~~ WHEREAS, the overall objectives of a development mitigation program and development phasing and monitoring program as required by Measure M are historically consistent with the City of Seal Beach's requirements for development proposals and the City of Seal Beach's participation in transportation fee programs to ensure that new growth is paying its share of the costs associated with that growth; and, WHEREAS, in compliance with the requirements of the Measure M program, the City of Seal Beach commits to continued implementation of its development mitigation and development phasing programs and further establishes an annual evaluation of compliance with these programs; and, WHEREAS, the Planning Commission reviewed the proposed "Measure M Growth Management Implementation Program" on April 21, 1993, and adopted Resolution No. 93-26, recommending that the City Council adopt the U Measure M Growth Management Implementation Program" on a unanimous vote. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That the City of Seal Beach Development Mitigation Program ensures that new growth in the City of Seal Beach is paying its share of the costs associated with that growth through continued participation in existing transportation fee programs which provide for funding for necessary transportation improvements through developer fee participation. Section 2. That the City of Seal Beach Development Phasing Program ensures that the provision of transportation infrastructure is provided concurrent with new development and is further implemented through conditions of approval of development proposals and citywide implementation of its Seven-year Capital Improvement Program. Section 3. That the City of Seal Beach Monitoring Program establishes an annual evaluation of compliance with the Development Mitigation Program and the Development Phasing Program. . Section 4. That the City Council of the City of Seal Beach hereby adopts the "Measure M Growth Management Implementation Program" in compliance with the provisions of the Growth Management Element of the General Plan and the provisions of Measure M, attached as "Exhibit A" and incorporated herein. PROJECT SUBMITTAL Development Project is submitted to Development ,Services Department B. PROJECT SCREENCHECK REVIEW 1. Development Services staff reviews project and determines: ~ Is project phared? b) Is project related to a previous approval? 2. Development Services staff routes project plans, project information and CMP/Measure M Screencheck form to Public Works Department for review of transportation issues. 3. Public Works staff reviews project and determines application of Measure M requirements: a) Project traffic study required? b) TDM Ordinance provisions applicable? c) Measure M baseline traffic impact mitigation fee applicable? d) City-wide transportation impact fee applicable? e) Required transportation improvements? c. TRAFFIC ANALYSIS 1. Public Works staff reviews previous traffic study and/or new revised traffic study and determines: a) Whether the existing levels of service of city arterials are impacted by project trips. Whether the additional project trips cause Measure M LOS goals to be exceeded, during or upon project build-out. Whether any of the impacted links/intersections are located in a neighboring jirisdiction. What mitigation is required to Measure M LOS goals. DEVELOPMENT MITIGATION AND PHASING 1. Public Works staff identifies traffic mitigation and timing of mitigation improvements necessary to maintain General Plan LOS goals and maintain a balance between transportation facilities and demand. This is achieved through individual or collective use of: a) Proposed conditions of approval which exact improvements benefitting the circulation system. b) Applicant participation in fee program(s) which include identified improvements to benefit the local circulation system. c) Local Capital Improvement Program improvements benefitting the circulation system. d) Transit/transportation demand management strategies. 2. Public Works staff routes project plans, completed eMP/Measure M Screencheck form, and screencheck,comments to Development Services staff. 3. Development Services staff schedules project before city approval body. E. DEVELOPMENT PROJECT REVIEW/APPROVAL 1. Development Services staff transmits staff analysis (including traffic analysis) to approval body in conjunction with approval body's review/action on project. 2. If project is approved, approval body shall make determinations that: a} Project has been reviewed for conformity with Measure M requirements; and b) The additional traffic generated by the project onto the City's circulation system does not cause the system to exceed General Plan LOS goals; or c) The additional traffic generated by the project onto the circulation system does impact specified links/intersections within and/or outside the city's boundaries. Project approval incorporates feasible mitigation measures (specify) and timing of implementation (specify) of mitigation measures, which shall maintain LOS goals upon the impacted circulation system. 3. Development Services staff completes CMP/Measure M screencheck form after project approval, and includes one copy in project file and one copy in "Measure M Projects File". F. INTERFACE WITH CITY CAPITAL IMPROVEMENT PROGRAM 1. INTERFACE WITH GROWTH MANAGEMENT AREA'S INTER-JURISDICTIONAL FORUMS 1. Development Services/Public Works staff maintains database on project approvals (project location, intensity, transportation mitigation> for review by GMA 2 and 6 Inter-Jurisdictional Planning Forums. H. ANNUAL MONITORING 1. Each November, Development Services/Public Works staff reviews all CMP/Measure M screencheck forms for project approvals during year and identifies: a) How transportation LOS goals are being maintained on arterials. b> What deficiencies are occurring on arterials. c) What corrective measures can be implemented to address identified deficiencies. 2. LOS assessment finqings are integrated into: a) b) c) d) City's annual and 7-year CIP. GMA Project List priorities to Orange County Transportation Authority. On-going implementation of existing transportation fee programs. On-going revision of General Plan, perticularly Circulation and Growth Management Elements. * * * * 3 Resolution Number ~K..s CITY OF SEAL BEACHj)ETERMINATION OF COMP.LIANCE~ MEASURE M: GROWTH MANAGEMENT PLAN Integral to achievement of the Growth Management Element goals and policies is an implementation plan to ensure that the required programs identified in the Element are I consistently applied to the City's development review process. Specifically, this pertains to the Measure MDevelopment Mitigation Program, the Development Phasing Program and the Annual Monitoring Program. Together, these three implementation programs provide a framework for responsible land use and transportation planning by requiring the following: · That the City commit to understanding how the additional traffic generated by a proposed development project will impact the levels of service (LOS) within and outside the City's boundaries (Development Mitigation Program). · That through this assessment, the City identify circulation improvements necessary to accommodate the increased traffic and to maintain the City's LOS goals set forth in the Growth Management Element (Development Mitigation Program). . That in conjunction with its review and action on a proposed development project, the City ensure that the new growth generated by the proposed development pay its fair share of costs associated with the development, including regional traffic mitigation. This can be accomplished through developer-participation in transportation fee programs established to implement transportation improvements on a city-wide basis; and/or through conditions of approval requiring exaction of specified transportation improvements (Development Mitigation Program). I · That the timing of transportation improvements provided through transportation fee programs, applicable capita{ improvement projects, and conditioned roadway improvements be coordinated with anticipated development construction. This ensures the infrastructure is logically added as development proceeds so that roadway improvements are in balance with demand (Development Phasing Program). · That the local jurisdiction conduct an annual evaluation of how its existing and proposed circulation system is meeting the demand necessitated by existing and approved development. This evaluation serves as a citywide checks-and-balance function on the City's ability to meet the circulation needs associated with the implementation of its General Plan land use program. It further provides a fine-tuning effort whereby identified transportation needs can be coordinated with the City's annual and seven-year capital improvement program, transportation fee programs, and Inter-Jurisdictional Forum (UF) efforts (Annual Monitoring Program). This five point program embodies planning practices which the City of Seal Beach currently implements in conjunction with approval of its General Plan land use program; adoption of citywide fee programs; and, approval of development projects. Also, the City's participation in the GMA 2 and GMA 6 Inter-Jurisdictional Forums I includes a sharing of the City's land use approvals with adjacent jurisdictions to enable those jurisdictions to understand transportation infrastructure needs at the GMA level, identify areas of deficiency, and prioritize candidate improvement projects for funding consideration by the Orange County Transportation Authority to address identified GMA-Ievel deficiencies. In addition, the City Council has adopted a resolution adopting implementation of the requirements of the Measure M Development Mitigation Program, the Development Phasing Program and the Annual Monitoring Program in conjunction with the City's development review process. * * * * , 2
