DISCUSSION
Existing state law requires every city, county, and city and county in California to revise the housing
element of its general plan not less than every five years. Councils of Government (COGs) are charged
with preparing a regional housing needs assessment (RHNA) for distribution of the housing needs
within their region.
State law specifies the dates for each region in the state and the local jurisdictions within each region to
complete their housing element updates. The state has historically appropriated money through the
state budget to fund the State mandate of preparing the RHNA. Due to fiscal constraints on the state
budget beginning in 1994, state funding of this mandate was suspended. Without the appropriation
from the state, COGs were unable to meet the deadlines for compliance with the RHNA process, and
therefore the Legislature annually granted extensions to COGS and local jurisdictions to comply with
the state law relative to housing elements.
In 1998 the Legislature resumed funding for COGS to prepare the RHNA. Furthermore, the
Legislature enacted, and the Governor signed into law, Senate Bill 256, which established new
deadlines for jurisdictions to complete their housing elements. In the six-county Southern California
Association of Governments (SCAG)region, the deadline was extended to June 30, 2000.

In June, 1999, SCAGs Community, Economic and Human Development (CEHD) Committee adopted
and reported to the Regional Council its support for new legislation extending the deadline by six
months for local jurisdictions to complete their housing elements. The six-month extension would be
from June 30, 2000 to December 31, 2000. The rationale for the six-month extension was based upon
the identified concern that SCAG's RHNA process was slowed, in part, due to delays in some state
actions including the Housing and Community Development Department's six-month delay in
providing SCAG with its share of the statewide need.
Preliminary conversations with the California Department of Housing and Community Development
(HCD) and League of California Cities suggest that a six-month extension as an urgency measure
would be appropriate and receive support. In addition, HCD has publicly indicated its support for a
six-month extension at a SCAG workshop held on September 23, 1999.
Staff is recommending a City letter in support of AB 1744 to accomplish this six-month extension for
the completion of the Housing Element. The City has recently entered into an agreement with Cotton,
Beland & Associates to prepare the Housing Element, and the six-month extension will allow for a
more reasonable time schedule for completion of this update to the Housing Element.

RECOMMENDATION
Authorize Mayor to sign letter supporting AB 1744. Instruct Staff to forward to the Planning
Commission for information. Receive and File Status Report.

Dear Assembly Member Longville:
The purpose of this letter is to express the City of Seal Beach's support of Assembly Bill
1744, and appreciates your action in introducing this important legislation. Seal Beach
favors the proposed legislation, which will provide a six-month extension of the due date for
completion of local housing element revisions.
The City of Seal Beach, as well as many other jurisdictions in the Southern California
Association of Governments (SCAG) subregion, is currently involved in a process of
determining existing and projected housing needs. The time extension proposed in this
legislation will provide the additional time needed to complete the needs assessment
process, which will provide a basis from which a meaningful housing element document
may be prepared.
Thank you for helping SCAG and its member cities and counties with this needed
adjustment to the planning schedule for implementation of the housing element update
process. The City of Seal Beach encourages efforts which will facilitate the preparation of

ISSUE PAPER
BACKGROUND
Existing state law requires every city, county, and city and county in California to revise
the housing element of its general plan not less than every five years. Each local
jurisdiction is required to submit its housing element to the California Department of
Housing and Community Development, the oversight agency for housing element
compliance. The housing element law requires local jurisdictions to identify and analyze
existing and projected housing needs, identifies sites, and make adequate provisions to
meet future housing needs. Councils of Government (COGs) are charged with preparing
a regional housing needs assessment for distribution of the housing needs within their
region.
State law specifies dates for cach region in the state and the local jurisdictions within
each region to complete their housing element updates. The state has historically
appropriated money through the state budget to fund the COGs' regional housing needs
assessment process. Due to fiscal constraints on the state budget beginning in 1994, state
funding of the regional housing needs assessment process was suspended. Without the

regional plans. Therefore, the Legislature annually granted extensions for COGs and

In 1998 the Legislature resumed funding COGs for preparation of the regional housing
needs assessment. Furthermore, the Legislature enacted, and the Governor signed into
law, SB 256 (Costa), Chapter 819, Statutes of 1998, which established new deadlines for
local jurisdictions to complete their housing element updates. In the six-county SCAG
region,the deadline was extended to June 30, 2000.
At its meeting of June 3, 1999, SCAG's Community, Economic and Human
Development (CEHD) Committee adopted and reported to the Regional Council, its
support for new legislation extending the deadline by six months for local jurisdictions to
complete their housing elements. The six-month extension would be from June 30,2000
to December 31,2000. The rationale for the six-month extension was based upon an
identified concern that SCAG's regional housing needs assessment process was slowed,
in part, due to delays in some state actions including the Housing and Community
Development Department's six-month delay in providing SCAG with its share of the
statewide construction need.
A six-month extension form June 30, 2000 to December 31, 2000 for local jurisdictions
in the SCAG region to complete their housing elements will enable SCAG to complete its

regional housing needs assessment process and provide approximately one year for local
jurisdictions to update their general plans. Preliminary conversations with the California
Department of Housing and Community Development and League of California Cities
suggests that a six-month extension as an urgency bill during the 2000 portion of the
current state legislative session would be appropriate and would receive support. Thus
far, any efforts regarding SCAG seeking longer term extensions have been strongly
discouraged as politically insupportable.
RECOMMENDATION
SCAG staff recommends that the CEHD Committee reinforce its previous decision to
seek a six-month extension for the following reasons:
• The current affordable housing crisis in Southern California requires immediate
attention and the implementation of every feasible approach to remedy the situation is
necessary; one of which is update of local housing elements.
• Current law provides that the next housing element revision for the SCAG region
after 2000 is due on June 30, 2005. Key census data from the 2000 census will be
available sometime during the period June - December 2002. The regional housing
needs assessment would be due by June 30, 2004.
• The State of California Housing and Community Development Department was six-
months late in providing SCAG with its estimated share of statewide construction
need.
• On July 13, 1999, San Diego Association of Government (SANDAG) received a six-
month extension via legislation, thereby creating precedent for a six-month extension
by the state.
• The State Housing and Community Development Department has publicly indicated
its support for a six-month only extension at a CEHD workshop held on September
23, 1999.
A core issue of the housing clement update discussion is the role of census as it relates to
the accuracy of the housing elements in each area. With the census occurring every ten
years and the requirement for housing element updates every five years, under existing
law, the second housing element update after each census will always reflect older data.
Given enough lead time, as was not the case during this most recent regional housing
needs assessment, alternative methodology could be developed which may, in part,
address the census data age concerns. It may also be appropriate to look at future
legislative, large-scale reforms that address the age of census information or other
mechanisms to reform the housing element update requirements.
