I also request you read this letter into the record during the City Council Meeting of 3-27-00. You are selective and discriminatory about what you put in the record. You refuse to read communications with which you disagree and yet allow Ms. Campbell to read letters which she likes as happened at the last meeting. Attached please find copy of letter dated 1-4-00 to David Hood, Chairman of the Planning Commission and letter of 1-19-00 also addressed to David Hood along with exhibits A-G. I have repeatedly brought to your attention that Mr. Till does not comply with Public Records Requests. Nonetheless you have given him a 2% raise. I OBJECT TO ANY FURTHER CONSIDERATION OF ZONING TEXT AMENDMENT 00- 1 AND ANY OTHER ITEMS RELATED TO THE KRENWINKEL HOUSE, THE PROCTOR HOUSE, AND/OR BED AND BREAKFAST ESTABLISHMENTS AT 308- 310 7th STREET. The Public Records Requests of January 4 through January 6, 2000 which are exhibits B-G of my letter to David Hood of 1-19-00 have been ignored by Mr. Till. I feel I need these records to make appropriate comment/objection to ZTA 00-1 . You have no right to vote on an issue when you refuse to provide to the public items they need for preparation and research for comment. I request you: 1. Order staff to comply with the Public Records Requests noted above. 2. Put on the next Agenda an item wherein Mr. Till must produce all my Public Records requests with which he has not complied and that you order him to comply with same. I request a copy of what he provides to you. 3. Postpone action on ZTA 00-1 until I am provided complete copies of all documents known as exhibits B-G attached to 1-19-00 letter to David Hood. 4. Address the issues of Mr. Whittenberg's misrepresentation as to prior uses of the property at 308-310 7th St including the issue of toxic residue and clean-up. 5. Agenda items 5-7 all relate to special privileges for Chris Verhulst. I am opposed to ZTA Text Amendment 00-1 (#5), Zone Change 00-1 (#6) and Minor Plan Review 00-1 (#7). The above items are just more examples of special privileges for special people. This is nothing short of a payoff for Chris Verhulst. Mr. Verhulst is just another member of the City Hall crowd who does the dirty work for the City. This is Whittenberg's way of paying Verhulst back for his support of Mola and complaints he made against my husband, myself and our property. Furthermore, the sale of the Krenwinkel House was a sweetheart deal for Mr. Verhulst as there was a quick sale at a cheap price that was not properly noticed. You should make the City go back and do it right. This was not an arms length transaction. In addition to doing the City's dirty work in the past, Mr. Verhulst has had City contracts for his landscaping business. The land on which the Krenwinkel house will be situated at 301 7th St. was used for many, many years for a business which did marine repair as well as other kinds of repair. The nature of the prior business is such that there may well be toxic substances that need clean-up. This issue needs to be addressed publicly (no deals cut in City Hall) before any action is taken. Attachment 3 in your packet shows 3 photos of the Krenwinkel House at 106 Central Avenue. Each photo states, "Roof being replaced." This is another lie out of Whittenberg's office. These photos were taken very recently (drive by and see for yourself) as the house is being carefully dismantled before any action from the Planning Commission. You need to stop these deals in City Hall that allow people to go ahead with the work before it comes before you and the public Please deny items #5, #6 & #7 on your agenda. Re: Minutes of 1-5-00 Planning Commission The purpose of this letter is to object to the minutes of the 1-5-00 Planning Commission meeting and to comment on some of the content of the above meeting and/or errors and omissions in the minutes. I REQUEST THAT YOU READ THIS LETTER AT THE INITIAL ORAL COMMUNICATIONS PERIOD WHICH PRECEDES APPROVAL OF THE MINUTES. WHEN THE ISSUE OF APPROVAL OF MINUTES IS ADDRESSED I REQUEST THAT YOU AGAIN REFERENCE MY OBJECTION TO THE MINUTES. The City Council and Planning Commission minutes are almost always filled with errors--misrepresentations and omissions The minutes of the 1-5-00 Planning Commission are particularly bad. Following are some errors in the minutes as well as areas of concern. OLSON SEAL BEACH AUTO & MARINE REPAIR: In my initia' letter to you of 1-4-00 I made a typographical error and referred to the site to which the Krenwinkel House is to be moved as 301 7th St instead of 308-310 7th St. Knowing full well that this was a typo, Mr. Whittenberg chose to attempt to embarrass me. Seal Beach Auto Repairs is at 301 7th St and Olson Seal Beach Auto & Marine Repair was located at 308 7th St. (see Ex. A--copy of GTE directory "good through October 1996"). Mr. Whittenberg chose to use my typo to obfuscate the toxic waste issue. He stated, "This property previously was developed with a single family home and a garage structure which was demolished and we have a copy of the demolition permit. To our knowledge its only being used for residential purposes for the last twenty years and so we don't see any toxic issue to deal with on that particular issue." THIS IMPORTANT REPRESENTATION BY MR. WHITTENBERG IS ABSENT FROM THE MINUTES. As usual, Mr. Whittenberg is lying to you. The listing in the phone book shows the business as "auto and marine repair" and even testimony from the General Manager of the Radisson Inn (last paragraph pg 12) makes reference to the business, "...as it would be much better than having the business that was there before." She knows it wasn't residential as do the many, many residents of Seal Beach who had work done at Ole's- as it was called. I'll bet that the City even paid for services at the "Olson Seal Beach Auto and Marine Repair. " Correction needs to be made to the minutes in the last paragraph on page 16. VON'S COMPANY (PAVILION'S): Page 5 under Commissioner Questions contains dialogue with Whittenberg regarding the accuracy of the information about calls/comp!aints to the police. Whittenberg defends the absence of data by saying, "The issue was trying to have something available for you this evening." This slap- dash incompetence is unconscionable. Last minute incomplete or irrelevant information is not adequate. Whittenberg's exact quote needs to be in the minutes. MS. CORBIN'S COMMENTS: page 13: A great deal of her important testimony is missing. Among the missing testimony is her complaint that she was given an incomplete staff report by Whittenberg's office (missing numerous pages) and the fact that Whittenberg showed up at her home with a digital camera. The latter is particularly important for there has been threat of criminal charges stemming from the photography of City Manager Till's house and another resident was denied the right to show photos of a City Commissioners house/yard taken from the beach at a City Council meeting. and the fact that the police have done nothing about the City Commissioner's husband photographing my personal property. Something is either legal or illegal. Ms. Corbin's testimony is important as it relates to different standards and treatment for different people. KRENWINKEL HOUSE SALE: Page 17, top paragraph, Whittenberg's comments regarding the short bid period for the sale to Verhulst were omitted. The Department of Developer Services, under the guidance of Mr. Whittenberg, is playing games and lying to you. Toxic waste, asbestos removal, etc., involve State and Federal laws and these laws are being circumvented by Whittenberg's office. You rely on staff and in addition to lying to you, they refuse to comply with public records requests Attached please find public records requests dated 1-4-00 asking for permits for demolition of the Krenwinkel House, including asbestos removal reports (Ex. B) , and five public records requests dated 1-6-00 for the demolition permit for 308-310 7th which Whittenberg says he has (Ex. C) , copy of Historical Society Walking Tour discussed at 1-5-00 meeting (Ex. D) , documents regarding sale of Krenwinkel House to Verhulst (Ex. E ), staff report for the Radisson Inn (Ex. F) , and documents regarding land lot adjustment Verhulst testified he has applied for (Ex. G). NONE OF THE REQUESTED DOCUMENTS HAVE BEEN PROVIDED. You are not given the correct tools (information) to do your job, and the public is thwarted from helping you because the public cannot get access to documents even though the law requires access to public records. AGAIN I MUST STRESS THAT THE ABOVE COMMENTS ABOUT THE MINUTES ARE ONLY A VERY FEW EXAMPLES. THESE MINUTES ARE VERY INADEQUATE AND SOME OF THE WORST I HAVE SEEN. I RESPECTFULLY ASK THAT YOU ORDER AN EXACT TRANSCRIPTION OF THE MINUTES THAT CAN BE MADE AVAILABLE TO THE PUBLIC IN ADDITION TO MAKING THE FEW CORRECTIONS NOTED ABOVE.
