HomeMy WebLinkAboutSupplemental - Received from Robert Goldberg during Oral Communications1 A PROPOSITION 218 In November 1996 voters of the State of California passed Proposition 218 which added Article ?CHID to the Caliiornta Constitution requiring now procedures for assessment districts. Article XLIID requires that assessments comply with stated provisions by ,July 1, 1997, unless an assessment ciistr ct meets certain exemptions. The exemptions from the ,procedural and approval requirements are set forth in Section 6 of the Article and include the following: "(a) Any assessment imposed exclusively to finance the capital costs or maintenance and operation elpenses for sidewalks, streets, sewers, water, flood control, drainage erns or vector control." with the District funding items that are considered exempt under provision (a) quoted above, specifically street and sidewalk improvements. sing the definitions provided by the Office of the Controller for the States of Calftrnia - in the Guidelines Relating to Gas Tax Expenditures published by the Division of Lobal Government' Fiscal Affairs, street improvements include street lighting.
